Subject: SDP 05 -005 Pet Supplies Plus Final Site Plan
The Albemarle County Department of Community Development Current Development Division will
grant final tentative approval of the above - mentioned site plan for review when the following items
have been addressed satisfactorily. Please note that the following conditions are those that have been
identified at this time. Additional conditions may be added or eliminated based on further review.
[Where appropriate, comments are preceded by the applicable reference.]:
C I [32.5.6(k,)] Approval and recordation of a plat showing the relocation of the drainage easement.
i2. [32.5.6(n)] The dimensions of the proposed dumpster pad shall comply with the minimum
design requirements that are set forth in Section 4.12.19. This includes the provision of at least
feet of concrete beyond the front of the dumpster.
3. [32.7.9.7(b)] An interior landscaping area equal to five (5) percent minimum of the paved
parking and circulation area shall be provided. Please note that this shall be a calculation of the
total ground area dedicated to those interior plantings and not the sum of the canopy to be
provided by those items at ten (10) years maturity. Shrubs screening the parking lot shall not be
counted toward interior landscaping.
4. [32.7.9.91 Provide individual canopy values for each of the qualifying tree species listed in the
Plant List. Please be aware that only plant materials that will exceed five (5) feet in height at a
maturity of ten (10) years after planting shall be included in canopy calculations.

professional engineer, land surveyor, or certified landscape architect when submitted for final approval.

Dear Mr. McCardle:
Our letter to you dated August 26, 2004 indicated in error that a Certificate of Appropriateness was issued for
the above referenced project. I am sorry for the confusion. To receive a Certificate of Appropriateness, please
submit two copies of revised drawings addressing each of the conditions outlined below, together with a memo
indicating how you have addressed each issue. If you add or change information other than that requested,
please also include an itemized list of these changes in the memo. When staff's review of the revised
drawings indicates that each condition of ARB approval has been met, a Certificate of Appropriateness may
be issued.
1. Identify the tree species on the landscape plan (to cross - reference the plant list) so a complete review of
the landscape proposal can be accomplished.
2. Provide verification that easement holders do not object to the proposed improvements in the easements.
3. Include a note on the elevations and sign drawings indicating that total area of window signs shall not
exceed 9 square feet per business frontage.
4. Provide all submittal items listed on the Final ARB Site Plan Review Checklist for review.
5. Mortar shall be tan or buff. The cement plaster band shall match the mortar color. The preferred metal is
"Patina Green ". The preferred brick is "Colonial ".
6. Vertical mullions shall be added to the windows.

Your firm has requested permission to plant trees and scrubs in the Dominion Virginia
Power easement areas on the above mentioned lot.
Regarding this specific property, Dominion Virginia Power will allow trees and scrubs to
be planted in the easement area as long as they do not interfere with the safety, operations
and maintenance of our facilities. We have the right to keep the easement clear of
buildings, structures, trees, roots, undergrowth and other obstructions and will do so
should become necessary.
As a reminder, Miss Utility must be called and underground facilities located before any
excavation in the vicinity of our underground begins. Also, the Overhead Line Safety
Act prohibits any work within 10' of our overhead lines. I am enclosing a copy of the Act
for your information.

Re: SDP 04 -065 Pet Supplies Plus Preliminary Site Plan
Dear Mr. McCardle:
The Department of Community Development hereby grants administrative approval of the above - referenced
site plan. In accordance with Zoning Ordinance Section 32.4.3.1, approval of the preliminary site plan is valid
for one (1) year. Therefore, this approval shall expire September 30, 2005. If the preliminary site plan
approval expires before all final tentative approvals have been granted, a new application must be filed and
processed.
Please address all of the requirements and conditions listed below and submit eight (8) copies of the tentative
plan to the Current Development Division, in care of the Community Development. This letter must be
submitted with the tentative plans, as a checklist, to document that you have addressed all requirements and
conditions, or the tentative plan will be denied.
The Erosion and Sediment Control Plan and the BMP Stormwater Management Plan, with the associated
applications and fees, may also be submitted with the eight (8) tentative plan copies. Failure to do so will result
in a separate application to be filed at a later date.
After the initial tentative plan submittal, each department/agency will contact you to discuss any remaining
conditions. After all aforementioned departments /agencies have granted tentative approval, you may submit the
final mylars (2 sets), one blueprint or paper copy, the final site plan application along with the final site plan fee
($410), and a copy of all written tentative approvals to the Department of Community Development by 5:00
p.m. on any week day. Assuming that the site plan mylars reflect the required conditions of all final tentative
approvals, signing of the plans will occur within one week.
The final site plan will be subject to all final site plan requirements (Zoning Ordinance Section 32.6), in
addition to the following conditions.
The Planning Depailment shall not accept submittal of the final site plan for signature until tentative approvals
for the following conditions have been obtained. The final site plan shall not be signed until the following
conditions are met:

A. Current Development Planner's approval to include:
❑ 1. [32.7.9] Approval of a landscape plan depicting the species types, number and location
of all proposed planting materials. Please note that this requirement must include the

aware that installation of such luminaires in the future that are not shown on this plan
shall require an amendment to this plan.
❑ 5. [32.6.60) and 4.17.4(b)] Include a photometric plan on the site plan demonstrating that
parking area luminaries are in compliance with Section 4.17.4(b).
❑ 6. [30.6] The final plan approval is subject to the issuance of a Certificate of
Appropriateness from the Architectural Review Board.
❑ 5. [4.15.14] Please be aware that all signs will require separate permits.
B. Current Development Engineer's approval to include:
❑ 1. Please include copies of Deed Book 403, Page 381 with the Final Site Plan. The deed
listed on Deed Book 1548, Page 0040 may have abandoned this easement. The owner
or applicant must verify this. The County Attorney may need to review these
documents before Final Site Plan Approval. The owner of Tax Map and Parcel
10061 W0010A00400 TMP and their agents are responsible to assure all easements
associated with this site plan are maintained. County approval of any site plan does not
alleviate the property owner of legal obligations imposed by deeded and/or recorded

❑ 2. Some offsite grading work is shown on Tax Map and Parcel 10061 W0010A005A0 (tie -
in for grade line elevation 504). The applicant will need a temporary grading easement
for this earthwork before Final Site Plan approval [DM1102, 18- 32.5.6j,k]
❑ 3. The submitted plats show an offsite gas line along the northwestern edge of this site.
Please show that gas line and easement on the Final Site Plan.
❑ 4. The deflection angle of the lateral pipe connecting to the proposed manhole must be 90
degrees or less (between inflow lateral and the outflow trunk). Please meet this
requirement on the Final Site Plan. As an alternative, a deflection angle greater than 90
degrees may be used of the lateral is (1) low flow, (2) the lateral invert is at the crown
of the outlet pipe or higher, and (3) submitted hydraulic grade line computations
consider the lateral line inflow as "drop inlet inflow" in adjusting the total "junction
loss" (Ht) for "plunging loss ". [Design Manual Section 505.E.12 "Junction Angles "]
❑ 5. The following items must be submitted with the Final Site Plan for review by the
Engineering Department.
A. [17 - 203, 17 - 303] A completed application and fee for erosion control.
B. [17 - 203] An erosion control plan, narrative and computations.
C. [17 - 303] Drainage /pipe computations for the 10 year storm.

C. Albemarle County Service Authority approval to include:
❑ 1. Final approval will not be granted until plumbing fixture information has been provided.
❑ 2. Approval of the final landscaping plan by the Service Authority with regard to existing
water and sewer easements.
D. Virginia Department of Transportation approval to include:
1. The entrance width scales 30', however it should also be labeled.
❑ 2. Shown an entrance standard.
❑ 3. Standard CG -12 handicap ramps are required in the entrance radii.
❑ 4. As previously noted the first two parking spaces on the left as you enter the site should
be assigned for employee parking to minimize the impacts at the entrance.

Attached are a revised vacation deed and exhibit for the stormwater easements through the site. We have
determined to the best of our ability based on a title search and inspection of the site that the easement to be
vacated is not in use for carrying stormwater (and may never have been so used). Because no adjacent property
owner benefits from the easement, title to the easement area may be cleared by recording a vacation instrument
signed by the County. I also added language memorializing the relocation of the other drainage easement that
had to be moved to accommodate the building footprint and made the change to paragraph 4 that Greg
suggested in prior comments.
Once the vacation deed is signed and recorded we will be on track for final site plan approval.

I am assuming that lots within the original subdivision were sold, so the vacation is governed by Virginia Code §
15.2- 2272(1). Under that subsection, a plat may be vacated by written instrument stating agreement to the
vacation. Virginia Code § 15.2 - 2272(1). Generally, the instrument must be signed by all of the owners (including
creditors whose debts are secured by a recorded deed of trust or mortgage) of lots shown on the plat and by a
representative of the County. Virginia Code § 15.2- 2272(1). In this case since only drainage easements would be
vacated and the vacation would not impede or alter drainage or access for any lot owners other than those lot
owners immediately adjoining or contiguous to the vacated area, then only the owners immediately adjoining or
contiguous to the vacated area must sign the instrument. Virginia Code § 15.2 - 2272(1). It would appear that only
the owner of the parcel to the west needs to also be a signatory to the instrument vacating the easement (as well
as their creditors identified above). Under Albemarle County Code § 14- 240(G), the instrument is signed by the
subdivision agent on behalf of the County. Once duly executed, the instrument is recorded with the clerk of the
circuit court. Virginia Code § 15.2 - 2272(1).
I have attached an electronic version of the deed with suggested changes as we discussed. It is in a "track
changes" format. I have also attached the language that should be included in a note on the site plan to
explain the rights and responsibilities of the parties with respect to the new drainage easement. The drainage
easement should be "dedicated to public use" via the site plan, using language required by Stephen.
Stephen and Mark -
The site plan will be revised to include a note explaining the rights and responsibilities of the parties with respect to
the new drainage easement. If it doesn't do so already, the drainage easement should be dedicated to public use
using language required by Community Development. A deed of easement that would otherwise do the same will not be
required.
Amelia -
The site plan that is pending final approval will be establishing a new 43' wide drainage easement. The owners
vvish to vacate two existing drainage easements that are unnecessary. The easements may be vacated by vacating a
portion of the plats that created them in an instrument under Virginia Code § 15.2 - 2272(1) and Albemarle County
Code § 14- 240(C). Your are authorized to sign the instrument on behalf of the County under Albemarle County Code §
14- 240(G).

Dear Mr. McCardle:
I have reviewed the submittal consisting of the following drawings:
• Sheet A201 with revision date of 2/15/05 sheet and ARB 305 with date of 2- 15 -05, and
• Site plan with sheets dated 12- 23 -04.
I have the following comments regarding the architectural drawings and lighting plan:
1. The metal color ( "Patina Green ") is not identified on the drawings.
2. The color for the cement plaster band ( "to match the mortar") is not identified on the drawings.
3. A note indicating that glass is clear and untinted is not included on the drawings.
4. A note has been added to the drawings regarding the green and yellow Pet Supplies Plus sign on the
west elevation, noting that the design is "typical." To avoid confusion, this note should be revised to
indicate that these colors shall not be used for signs visible from the Route 29. The drawing shall
clearly show that the bronze and white colors are to be used for signs visible from Route 29.
5. The plan does not clearly identify the .5 footcandle lines. It appears that light spillover exceeds
allowable limits along the south and west sides of the site.
6. A gray finish has been proposed for all lights. I am not able to approve this color administratively. It
appears that the pole fixture is also available in graphite and black finishes. I can approve a bronze or
black finish. The graphite finish may be approvable; an accurate color sample is necessary to
determine this. (I spoke with the Holophane rep today, but I have not yet received additional color
information.)
Please revise the drawings to include the materials notations discussed in numbers 1 through 4, above.
Also, correct the drawings to eliminate excessive spillover, identify the .5 footcandle lines, and revise the
finish of the site light fixtures and poles, as indicated in comment numbers 5 and 6, above. Then forward
two copies of all revised drawings together will a memo indicating how these issues have been
addressed. If you make changes other than those requested, address those in the memo, as well. When
staff's review of this information indicates that all issues have been resolved, a Certificate of
Appropriateness may be issued.

these plans resolve the ARB issues outlined in my previous letter, with the exception of one area of

may not exceed .5 footcandles at the property line.
I can approve this plan administratively for the ARB with the condition that the spillover be resolved with

I am assuming that lots within the original subdivision were sold, so the vacation is governed by Virginia Code §
15.2- 2272(1). Under that subsection, a plat may be vacated by written instrument stating agreement to the
vacation. Virginia Code § 15.2- 2272(1). Generally, the instrument must be signed by all of the owners (including
creditors whose debts are secured by a recorded deed of trust or mortgage) of lots shown on the plat and by a
representative of the County. Virginia Code § 15.2- 2272(1). In this case since only drainage easements would be
vacated and the vacation would not impede or alter drainage or access for any lot owners other than those lot
owners immediately adjoining or contiguous to the vacated area, then only the owners immediately adjoining or
contiguous to the vacated area must sign the instrument. Virginia Code § 15.2- 2272(1). It would appear that only
the owner of the parcel to the west needs to also be a signatory to the instrument vacating the easement (as well
as their creditors identified above). Under Albemarle County Code § 14- 240(G), the instrument is signed by the
subdivision agent on behalf of the County. Once duly executed, the instrument is recorded with the clerk of the
circuit court. Virginia Code § 15.2- 2272(1).
I have attached an electronic version of the deed with suggested changes as we discussed. It is in a "track
changes" format. I have also attached the language that should be included in a note on the site plan to
explain the rights and responsibilities of the parties with respect to the new drainage easement. The drainage
easement should be "dedicated to public use" via the site plan, using language required by Stephen.
Stephen and Mark -
The site plan will be revised to include a note explaining the rights and responsibilities of the parties with respect to
the new drainage easement. If it doesn't do so already, the drainage easement should be dedicated to public use
using language required by Community Development. A deed of easement that would otherwise do the same will not be
required.
Amelia -
The site plan that is pending final approval will be establishing a new 43' wide drainage easement. The owners
wish to vacate two existing drainage easements that are unnecessary. The easements may be vacated by vacating a
portion of the plats that created them in an instrument under Virginia Code § 15.2- 2272(1) and Albemarle County
Code § 14- 240(C). Your are authorized to sign the instrument on behalf of the County under Albemarle County Code §
14- 240(G).

RE: Request to change the pavement section for Pet Supplies Plus
Dear Mr. Chambers,
We are requesting a change of the pavement section for the Pet Supplies Plus project that was
approved by the County on June 29, 2005. The approved plan shows a total pavement thickness of 13"
(see attachment A) and we are requesting that the new thickness be 8" (see attachment B). We are still
recommending that the loading area stay at a thickness of 13 ".
We trust that the attached documents will adequately address your requirements to approve a change.
