Thank -you for the PDF version of the deed. As you will note in the chain of communications below, Andy
requested an MS Word version of the Deed so that we could make the final additions. When Alex
Morrison stopped by to pick up the deed, Marsha sent an email to you regarding Roy Via sending the MS
Word version of the deed to our office so that we could make the changes. As far as I know, we have not
yet received the MS Word version in order to make the final additions and have the deed signed by the
County Executive.

Andy handles real estate transactions where the County is the grantor and he reports that it is in process. When the
County is the grantor, we need to ensure that granting the easement will not limit the County or, in this case, the School
Division, from using the property in the future as it may need to use it. It took a little time for them to get back to Andy
but they did on Friday and they confirmed that the easement will not restrict future use of the property.

Tom can sign the easement plat and it need not go to the Board of Supervisors, provided that the deed has language
that incorporates the plat by reference or makes the plat part of the deed. Common phrases to look for are "which is

incorporated herein by reference" oi' ihich is made a part hereof." With this larige''age, the plat is clearly part of the
deed.
The deed needs to be reviewed and approved by me as to form before I send it on to Tom, so I'll be certain the language
is there.

Signing the deed: With the County the owner of TMP 04500- 00 -00- 09400, Tom can sign the deed on behalf of the
County and it need not go to the Board to authorize him to sign the deed if the deed falls within the scope of the
attached Board resolution.
Signing the plat: I assume this is an easement plat so the owner's signature is required under County Code 14- 208.2.
Tom would be the signatory on behalf of the County. The plat would be referenced in the deed. I'll try to get back to you
tomorrow as to whether the attached Board resolution can be extended to apply to the plat that accompanies the deed.

County GIS records) and the signatory is the Chairman, Steve Koleszar. ACSA should check the deed at DB 1128 P 650 to
confirm the exact name in which the School Board has title.
The School Board needs to approve Steve signing the deed.

Hi Greg,
I am reviewing an easement plat for ACSA where the proposed easement crosses the Agnor -Hurt School property. It is
actually a modification /enlargement of an existing easement. Bill has said that Mr. Foley needs to sign the plat and that
he may have to go to the Board to obtain approval to sign. Bill seems a little unclear on the details and says it's ACSA
responsibility to obtain the signatures. There was also some discussion in our distribution meeting amongst other
planners who thought maybe the signature isn't required. Alex, with ACSA, is asking me for guidance on how to get this
done. Can you provide any insight? Is Mr. Foley's signature required? If so, what's the process?

Andy handles real estate transactions where the County is the grantor and he reports that it is in process. When the
County is the grantor, we need to ensure that granting the easement will not limit the County or, in this case, the School
Division, from using the property in the future as it may need to use it. It took a little time for them to get back to Andy
but they did on Friday and they confirmed that the easement will not restrict future use of the property.

This DEED OF EASEMENT, made this 24`" day of January, 2013 by and
between BOARD OF SUPERVISORS OF ALBEMARLE COUNTY, VIRGINIA,
( "Grantor "), and the ALBEMARLE COUNTY SERVICE AUTHORITY (the
"ACSA "), ( "Grantee "), whose address is 168 Spotnap Road, Charlottesville, Virginia
22911.
WITNESSETH:
That for and in consideration of the sum of ONE DOLLAR ($1.00), receipt of all
of which is hereby acknowledged, the Grantor does hereby GRANT and CONVEY with
SPECIAL WARRANTY of TITLE unto the Albemarle County Service Authority a
perpetual right of way and easement to construct, install, maintain, repair, replace and
extend one or more water lines consisting of pipes and appurtenances thereto, over, under
and across the real property of the Grantor located in Albemarle County, Virginia, the
location of the easement granted and the boundaries of the property being more
particularly described on the following plat:
A (625 sq. ft.) variable width water line easement, shown and described on plat of
Roudabush, Gale & Associates, Inc., dated January 23, 2013, a copy of which is attached
hereto as Exhibit A (the "Plat), as it crosses property of the Grantor shown and described
on the Plat and acquired by the Grantor by the instrument recorded in the Office of the
Clerk of the Circuit Court of Albemarle County, Virginia, in Deed Book 467, Page 623.
Reference is made to the Plat, a copy of which is attached hereto to be recorded
herewith, for the exact location and dimension of the permanent easement hereby granted
and the property over which the same crosses.
As part of the easement the ACSA shall have the right to enter upon the above
described property within the easement for the purpose of installing, constructing,
maintaining, repairing, replacing and extending a water line and appurtenances thereto,
within such easement and the right of ingress and egress thereto as reasonably necessary
to construct, install, maintain, repair, replace and extend such water line. If the ACSA is
unable to reasonably exercise the right of ingress and egress over the right -of -way, the
ACSA shall have the right of ingress and egress over the property of Grantor adjacent to
the right -of -way.
Whenever it is necessary to excavate earth within such easement, the ACSA
agrees to backfill such excavation in a proper and workmanlike manner so as to restore
surface conditions to the same condition as prior to excavation, including restoration of
such paved surfaces as may be damaged or disturbed as part of such excavation.
Grantor, its respective successors or assigns, agree that no new trees, shrubs,
fences, buildings, overhangs or other improvements or obstructions shall be placed within
the easement conveyed herein.
The easement provided for herein shall include the right of the ACSA, to cut any
trees, brush and shrubbery, remove obstructions and take other similar action reasonably
necessary to provide economical and safe water and /or sewer line installation, operation
and maintenance. The ACSA shall have no responsibility to the Grantor, its successors

or assigns, to replace or reimburse the cost of said trees, brush, shrubbery and
obstructions that are removed or otherwise damaged.
The facilities constructed by ACSA within the permanent easement shall be the
property of the ACSA which shall have the right to inspect, rebuild, remove, repair,
improve and make such changes, alterations and connections to or extensions of its
facilities within the boundaries of the permanent easement as are consistent with the
purposes expressed herein.

Ellie -
Tom can sign the easement plat and it need not go to the Board of Supervisors, provided that the deed has language
that incorporates the plat by reference or makes the plat part of the deed. Common phrases to look for are "which is
incorporated herein by reference" or "which is made a part hereof." With this language, the plat is clearly part of the
deed.
The deed needs to be reviewed and approved by me as to form before I send it on to Tom, so I'll be certain the language
is there.

actually a modification /enlargement of an existing easement. Bill has said that Mr. Foley needs to sign the plat and that
he may have to go to the Board to obtain approval to sign. Bill seems a little unclear on the details and says it's ACSA
responsibility to obtain the signatures. There was also some discussion in our distribution meeting amongst other
planners who thought maybe the signature isn't required. Alex, with ACSA, is asking me for guidance on how to get this
done. Can you provide any insight? Is Mr. Foley's signature required? If so, what's the process?

I don't know the answer to these questions. It is actually your (ACSA) responsibility to obtain the signature...just like
anyone submitting a plat must get the owner's signature before CDD will sign it. I can send an email to the County
Attorney's Office to see if they have any insight, but other than that I'm pretty much in the dark as well.

straightforward and since ACSA would be the only reviewer other than the planner, it should be pretty quick. All of the

Ellie,
The existing easement is for the water main that feeds the Greenfield Trailer Park. The line that runs across county
property is a 4" thin walled PVC main that should have ruptured by now. Due to the new water pump station that will
come online in early to mid -2013, the pressure increase will rupture the main. We will be extending a line from the
south along Berkmar and making a new water main connection near the proposed easement. Unfortunately there is a
gap between the existing easement and the parcel boundaries (on the county property). This plat will pick up the small
corner piece (roughly 600 sf) which will allow the water main extension to be made and the 4" line to be taken out of
service, prior to the pressure increase from the pump station. This easement is on county property and is amending a
previously approved and recorded easement. If you would like a marked up schematic to show the proposed work I can
do that as well.

I'm a little confused about exactly what's being proposed...can either of you explain if this easement is required by a site
plan or other function of our ordinance? If so, we would need to review it just like any other plat with all the associated

We are doing a waterline easement plat for ACSA at the SE corner of Parcel 94, owed by the County of Albemarle. It is
our understanding that you need to review this with the BLA /Easement Plat submittal form. This easement is an
extension of an existing, platted easement (DB 1473 p. 696), contains 623 sf and basically amounts to very little; kind of
fills out the area from the existing easement to the remainder of Parcel 94 along Berkmar Drive and Parcel 152. Does
this plat require all of the notes we would put on A BLA plat? Vicinity Sketch, flood statement, etc., etc? We have been
told that the County does not sign this on the typical Owner's Approval block but uses the Approved for Recordation
block only. Correct?
