Martin (cmartin @williamsmullen.com); Pascarella, Jonathan (DEQ); Owens, Amy (DEQ) Subject: Avon Street Landfill Site Development Plan Approval 2 Dear Mr Werner, DEQ is in receipt of the final revisions to the document dated February 20, 2013 titled "Avon Street Project, Albemarle County, Virginia, - Investigation Program, Findings, and Proposed Site Development Work Plan" (Workplan), prepared by Draper Aden Associates (DAA) on behalf of Avon Holdings, Inc. (Owner). The Workplan details certain road construct and environmental remedial measures to be undertaken at the closed Avon Street Landfill by the Owner. After careful review of the document and in consultation with the project engineer and County of Albemarle, the Workplan is deemed approved. Implementation of the Workplan shall proceed as soon as practical and be completed with two years. DEQ will follow -up this email with a formal letter confirming this position. Waste excavation shall be minimized to the extent possible in order to maintain the integrity of the landfill and limit human exposure. Waste exposed at the site may be re- interred over other waste at the site provided that two feet of clean compacted soil is provided to cover the burial area. This Workplan approval process went forward independent of other required construction and environmental approvals. It is the responsibility of the owner to indentify and secure any other federal, state and local permits and approvals which may be required. Should current or future conditions vary significantly from those presented in the Workplan, including, but not limited to, location of additional areas of exposed waste, new landfill seeps, waste or landfill shifting, the owner should contact DEQ regarding these conditions and prepare a plan to mitigate any adverse impacts to human health and the environment. Institutional control and continued maintenance of the closed landfill property shall be the responsibility of the Owner. We understand that no additional improvements or parcel development on the landfill property is under consideration at this time. The Owner shall contact DEQ if additional construction beyond that included in the Workplan including the street, landscaping, and signage are contemplated. This Workplan evaluation did not include the evaluation of the geotechnical aspects of the proposed construction. Please note that pursuant to Va. Code § 10.1- 1455(G), this email is not a case decision under the Virginia Administrative Process Act, Va. Code § 2.2 -4000 et seq.
