I told him we would pursue this as a site plan violation for the original site plan and the site plan amendment if they did not correct this. Justin indicates they will pursue this, but anticipates it will take six months or longer to get through the lenders. My experience in getting drainage easements approved by mortgage holders on residential lots has been this takes between 3 -9 months. This will eliminate any increase in runoff or water quality concerns from added impervious surfaces. With this modification, we understand that a WPO application would not be required. Concerning the easements, we have reviewed the title report and inspected the plats of record. It appears that drainage easements have not been recorded on the storm sewer in front of the building that we will be leasing and renovating. Given the fact that our improvements are not changing the drainage patterns, nor adding impervious area that would trigger a WPO review, it is our opinion that new easements would not be required for this minor site plan amendment. Considering the above items, we request approval for this minor site plan amendment be granted as soon as possible. I do not believe for one that our site should be considered by zoning to be in the floodplain since the fill and building was on an approved siteplan. Am I correct in my understanding that the fill required approval by the County at the time the siteplan was approved? Aside from that, even if one did consider the floodplain to be per the line, I don't think anything we propose to change within that boundary would be prohibited under the ordinance. The only disturbance is for a very small bit of cut for a new drain structure and the installation of some new underground utilities. It's possible this plan proposes additional disturbance, but it looks like their waiver request was not nearly as detailed as what we require now. It didn't give a specific area of disturbance, it just simply asked for a waiver to disturb critical slopes. Additionally, the plan didn't show the specific areas of disturbance...it was a 1995 plan, so the plan requirements were a little different. Anyway, I'm going to check with David tomorrow when I get back to the office, but its possible this one won't require an additional waiver. If you want, you could ask Glenn as well to get his take. Part of what I discovered in my research is that a critical slope waiver was granted during the preliminary plan review. However, I'm not sure it covers the area you are proposing to disturb currently. I am working from home today, but plan to talk to David about it tomorrow and will let you once I do. If a new waiver is required, the first available BOS date is May 1st but that is likely unrealistic because my report would be due on the 17th and the request hasn't even been submitted. June 5th is more probable, but I'll talk to David about the timing as well if we determine the waiver is necessary. Let me know if you need anything additional.
