We are glad to take this opportunity to respond to the comments and suggestions of staff as they relate to our Special Use Permit application to raise the number of students being educated on the property to 120. Based on concerns from the Health Department and subsequent meetings with Old Dominion Engineering we are revising our Special Use Permit request to no more than 96 persons (students and teachers included) for the 2013 -2014 school year. Old Dominion Engineering has indicated to us that they will use the time between now and September 2013 to determine what if any modifications need to be made to increase the number of students to 120 for the 2014 -2015 school year. Planning (Christopher Perez) 1) The school has considered the comments regarding fencing of the property. We have also had a few members of the Board of Supervisors out to visit the property and view the children playing and engaging in physical education activities. Even with an increase of 30 students, we do not think fencing is necessary at the present time. Factors that are difficult to describe without being on the property are the extremely thick foliage and slope of the hill behind the play structure and sports field. It is doubtful that a child could get through the brush and all the way to the train tracks. It resembles jungle conditions with vines, different levels of foliage and a steep climb up to the train tracks as well. In order to be as accommodating as possible, we would like to propose that we replace the temporary orange "snow" fencing that CAM put up behind the .la structure to . revent ball . down th - I - ., anent board fence that we can move from another area on the property. This section of fencing is approximately 60 feet wide by 4 eet tall. It is not visible from the road, but it will . e an attractive board fence that can be painted black so that it disappears. It is much better looking than the temporary fence that is there now. Children at Regents School are very well supervised and cognizant that the area past the tree line is a septic drain field they would not wish to travel towards. The area near Broomley Road is just not a space that the children at Regents venture. It is not anywhere near the play structure and the sports field is utilized during physical education classes with a teacher. Less structured play and ball throwing is common on some of the black top areas right next to the building as well as near the play structure. Virginia Department of Health (Josh Kirtley) 1) RSC has consulted with a PE and determined that the capacity of the existing system is suitable for 96 total students and teachers. The PE has submitted a report to the Health Department with outlines their findings. We will also work with the PE to determine if any modifications to the system will be necessary to increase the number of students in future years. Initially this PC meeting had a large load and was "full "; however, per today's discussion it appears that one or two of those large projects may be coming off the agenda, which gives staff flexibility to schedule your SP on that meeting, thus we can move forward with the July 16 meeting date. This is the soonest date for the PC which is possible based on the required review time for all required staff to provide me comments before I have to write my staff report for the project. If we put the project onto that PC meeting (July 16 we can have a "placeholder date" for the August 7 BOS meeting provided nothing large comes up at the PC meeting. If something does come up which needs to be addressed, we have another BOS meeting date Aug 14 which this project may be able to go on. Does the above suit you? As to potential conditions; at this point it's tough to say if any new conditions would be put on this SP, as I have not received all pertinent information in response to answer all the initial comments from the initial review. The applicant has assured me they will provide all the documents I have requested by this Friday at the latest, at which point I'll distribute the resubmittal to all appropriate reviewers. Once I receive all the resubmittal documents from the applicant I'll be in a better place to discuss any additional conditions which may be required (if any). The biggest issue for this project was getting approval from the Health Department for the increase in students, which I just received from the Health Department today via email. PDF Courtney, I have read over your response letter in detail and feel that the submittal is lacking information on the location of the fencing for ARB staff and myself to make any findings on this item. Attached is your original Concept Plan, on this document please draw in the location of this proposed fencing. Also your letter states that the fencing is already existing onsite and is being relocated, where it is being moved from, this would be good to show too. Send the above revised document to me as soon as possible (before May24th would be good) and I'll include it with the resubmittal for the required reviewers to take into consideration. Also, to follow up with you about the Planning Commission date for your project. After speaking with the scheduler, it appears the July 16 meeting is full with a bunch of large detailed projects. The next public hearing which this project can be schedule on is July 30 Either way you are still looking at a September BOS meeting. Per their application they have been running school there for 51 students and 10 teachers. • I would also ask what the hours of operation for the school are and are the students bussed in or do parents do drop off and pick up. Per their application: many families send multiple children to the school, and most teachers also send their children to the school. They estimate 15 additional vehicles drop off and pickup students at Sam — 3pm. There is not any type of bus system for this school. They estimate that with the school's proposed increase to 120 students that this would generate an extra 25 vehicles dropping off and picking up students for a total of 40 vehicles total per day. At 120 students I would start to be a little concerned with the operations at the intersection to Route 250 and may want to see some traffic analysis for left turn queues and time needed to get out on Route 250. I would expect that the afternoon hours may not overlap with the peak hour of traffic but the morning hour may be during the peak. Please not that kindergarten releases at 12:15. Josh is concerned that the system septic design may not have taken into consideration that the facility was to be served by up to 120 students plus additional staff. That is why he is recommending that the applicant consult with a PE to determine if the wastewater strength and flows from the school will be similar to the original design. A septic system design for a school of 120 students is outside the permitting ability of the local health department and he feels more comfortable for everyone involved (County, VDH, and the applicant) that a PE review the proposed use and determine if the existing system can accept the wastewater. Josh provided me the attached Capacity Assessment which was submitted to the HD for the initial SP application review. He is looking to have a similar review completed and submitted by a PE for your latest proposal. At this point he is concerns that you may need to expand the system or potentially add pretreatment, thus the reason for his comments. I have looked through my files for the project and find nothing of such Health Department comments, do you have any of Bill Craun's written comments where he said this to you?
