I spoke to the applicant and in.' .ted that they would need to s •mit soils work for BOTH of the parcels in
order to obtain HD approval. Pleas- 'ote that one of the parc: s has an existing dwelling and also has a
proposed mobile home (recent BP appli ion). There exists oils work for the proposed new construction
that is associated with a recent Health Depa ent permit :pproval, so a Reserve Area is required for the
existing dwelling ONLY. The smaller parcel with le exis • g dwelling will also require that a Reserve Area is
found. To the best of my knowledge, each parcel is -r ed by its own well, although I don't know if the
existing dwelling and the proposed mobile home will h e a well or not.
I guess at this point, the ball is in their court. Th- should sub ''t the packet and plat to you, and the process
should be normal from there in the way of req esting VDH revie

1)There is no additional fee,they were all paid with the initial submittal. 2)Whether or not you get signatures is really
up to you....if there are any remaining comments you'll have to get the signatures again, so given the number of
comments you may want to hold off. But, if you feel confident you've addressed everything it's fine to get them now. 3)
I will try to do my review within 14 days of submittal...but your limiting factor is likely going to be VDH approval. I know
Ms. Kirby said she had someone doing the soils work, but I haven't seen it yet. Once it comes in to me, I send it to VDH
for review which could take a while depending on their workload.

Mr. Landes,
As discussed on the phone,the County does not require survey of the entire parcel in order to approve SUB201300101
Kirby—Rural Subdivision. The parcel that's being subdivided off of the parent parcel must be surveyed (it is), but the
residue parcel acreage may be referenced from County GIS and the boundary can be referenced from previous plat(s).
This parcel had two dwellings prior to 2009, so no certification of road frontage is required; and the lot sizes are well
above the minimum allowed in the rural areas.
As an aside,you will need to add a signature line for the owner(s)of TMP 84-50A1...this is a bit of a unique situation, but
after thinking about it a little more, I think they should be party to the application.

The existing shared entrance is safe for accessing these two parcels with good sight distance in both directions and I
would highly recommend that it remain a shared use entrance if possible.There is a location that can be used for an
independent driveway for the other lot if it is required by the county. Prior to issuing a permit at this location I would
like verification that the county would be fine with issuing an entrance going into a vertical slope due to the
requirements that I would place on this type of entrance. If you should have any other questions or concerns please let

Hey Josh,
I have a crazy subdivision situation I was wondering if you might be able to help me with! Ms. Kirby apparently had a
subdivision plat prepared for her property and got it recorded in 2012 without going through County approval. The
parcel she divided off had an existing home and it's been sold. Obviously,this is an illegal subdivision that shouldn't
have happened,so she has now submitted her subdivision plat for review. She is really struggling with understanding
what she needs to do to get this plat approved and claims her surveyor is not being helpful. I told her she needed to
provide soils work or health department approval in some way but I'm not sure she fully comprehends what I'm asking
for...so I was wondering if you might able to tell me if these two parcels have existing permits? I have attached the
County GIS Map...it's parcel 84-50 and 84-50A1 (the piece illegally subdivided off). I have also attached the plat that was
illegally recorded as she has submitted the exact same plat for review. Apparently the house on the parent parcel was
built in 1900 and the one on 50A1 was built in 1967.

I have a soil consultant coming tomorrow to do the necessary work to get the permits
for the two parcels.

You would need copies of the drainfield permits from the Health Department showing the locations of the
primary drainfield and reserve drainfield on each parcel. This applies to both parcels, not just the one that's less
than 21 acres. The VDOT representative is Dennis Seale. I have contacted both VDH and VDOT in hopes of
getting information from them and will let you know what I find out. If VDH does not have permits on file, soils
work may be required in order to get the subdivision approved. I'll keep you posted.

I am currently reviewing the plat. I will send my comments to you as soon as I have completed my
review...hopefully no later than tomorrow. I spoke with you previously about this (back a couple of weeks ago)
and I passed along at that time that you would need to provide information from the health department
regarding the drainfield permits for each parcel, and approval from VDOT concerning entrances onto the public
street. I noticed that neither of these items was included with your application. Are you working on gathering
this information? Those two things will likely be the items that take the most time, so I thought I should go
ahead and mention them.

Hi Dennis,
I have a crazy subdivision situation I was wondering if you might be able to help me with! Ms. Kirby apparently had a
subdivision plat prepared for her property and got it recorded in 2012 without going through County approval. The
parcel she divided off had an existing home and it's been sold. Obviously,this is an illegal subdivision that shouldn't
have happened,so she has now submitted her subdivision plat for review. She is really struggling with understanding
what she needs to do to get this plat approved and claims her surveyor is not being helpful. I told her she needed to
provide VDOT approval but I'm not sure she fully comprehends what I'm asking for...so I was wondering if you might
able to take a look at this and let me know if VDOT can approve it? I have attached the County GIS Map...it's parcel 84-
50 and 84-50A1 (the piece illegally subdivided off). I have also attached the plat that was illegally recorded as she has
submitted the exact same plat for review. The plat refers to a private road that will serve both parcels, but the County
(as of right now) is not reviewing the private road because it was submitted as a rural subdivision...so I think we'd want
to make sure each parcel could access the existing pubic road independently should they want to do it that way in the
future.

I have only two large Plats, since I had already sent the one Plat to the courts (they kept that).
I did have to have that notarized to but it was notarized on a separate paper.
I went to the bank today and had the other two plats I have notarized
On the application it ask for a project name. I don't have a name and the tax map and parcel do I put the
map and parcel when it was at 50 acres or that it has been divided and it is two separated ones ( it is a
little confusing)
Would I have you all contact the surveyor or me.
This property had house already on it, so what would be the need for Ground water review,that seems
pointless.
The 11.97 acres was checked before it was sold. We had all of that stuff done what is the purpose of
another $330.
I will be in to bring it and pay the fees tomorrow or Friday

I printed off the recorded plat (D.B.4234, P.413) and reviewed it with my supervisor to figure out the next steps
for County approval. This subdivision would be classified as a "Rural Subdivision" under our Subdivision
Ordinance. Here is the application that needs to be submitted:

The application requires three full-size copies of the plat. The fee will be$1020--$690 for the application and
$330 for a Tier II Groundwater Assessment. This application will also require soils work to be reviewed and
approved by the Health Department. The Planning Division submits information to the Health Department and
it is generally submitted with the subdivision application (although some people submit it later).
I can see that there will need to be some changes in the notes currently on the plat. For example, County Code
requires that the plat have the owner's signature be notarized, as well as a place for the Subdivision Agent to
sign it on behalf of the County. There are other changes and those will be listed out in a comment letter once
the application has been received and the plat has been fully reviewed.
