BACKGROUND:
The applicant is requesting ACSA Jurisdictional Area designation for water service to a 2.33 acre parcel with one
existing single-family home (Attachment A). The parcel is located on the east side Route 250,just south of the I-
64 interchange eastbound on-ramp of the Shadwell Exit(Attachment B). The parcel is located entirely within the
designated Rural Areas(Rural Area 4) and is in the Scottsville Magisterial District. The existing well serving the
home has recently been tested and confirmed to be contaminated with E. co/i bacteria, and there also is the
presence of a petroleum smell in the water. The comments from the Virginia Department of Health are attached
(Attachment C). The source of the petroleum odor has not been determined as of the writing of this report.
Four adjacent parcels to the north of this property (Tax Map 78, Parcels 34, 35, 60, 60A) are within the ACSA
Jurisdictional Area for"Water only" and all of these parcels appear to have been included in the early 1980's with
the creation of ACSA Jurisdictional Areas. This area contains the Comfort Inn Motel, a parking lot and a
residential structure. Another parcel just to the east of this property (TMP 78-43A)was added to the ACSA
Jurisdictional Area in 2002 with a "Water Only to Existing Structures" designation. Water quantity issues (dry
wells)were the basis for that property to be added to the Jurisdictional Area.
STRATEGIC PLAN:
Objective 2.2 Protect and/or preserve the County's natural resources.
DISCUSSION:
The Comprehensive Plan provides the following concerning the provision of public water and sewer service:
"General Principle: Urban Areas, Communities, and Villages are to be served by public water and sewer
(p. 114)."
"Provide water and sewer service only to areas within the ACSA Jurisdictional Areas (p. 130)."
"Follow the boundaries of the designated Development Areas in delineating Jurisdictional Areas (p.130)."
"Only allow changes in the Jurisdictional Areas outside of the designated Development Areas in cases
where the property is: 1) adjacent to existing lines; and 2) public health and/or safety is in danger(p.
130)."
Water and sewer services by policy are intended to serve the designated Development Areas where growth is
encouraged and are to be discouraged in the Rural Areas because utility services are a potential catalyst to
growth.

Water supply and system capacities need to be efficiently and effectively used and reserved to serve the
Development Areas. Continued connections of properties in the Rural Areas result in further extension of lines
from the fringe of the existing Jurisdictional Area and into the Rural Areas, potentially straining limited water
resources and capacity.
The applicant has provided information confirming E. coli and petroleum contamination and some water quantity
issues. Information has also been provided from a well driller indicating limited opportunity for a viable new well
on-site. It should be noted that E. coli contamination can potentially be treated and eliminated in certain
circumstances. It is not clear at this time whether the E. coli contamination on this site could be remediated.
However, given the overall circumstances in this case, which includes a petroleum contamination and the general
history of water quantity problems on this site and in the immediate area, staff finds that this request meets both
criteria for the provision of service to Rural Area parcels (adjacency to existing service lines and documented
health and safety issue). Based on the documented presence of E. coli bacteria contamination and odors in the
water supply, staff recommends amendment of the ACSA Jurisdictional Area for water service only to the existing
structure, which is a single-family residence.
BUDGET IMPACT:
The property owner will bear the costs for the water connection.
RECOMMENDATIONS:
After the public hearing, staff recommends that the Board amend the ACSA Jurisdictional Area to include Tax
Map 78, Parcel 36 for water only to the existing structure (one single-family residence).

RESPECTED SIR/MADAM, MY NAME IS JOHN CHAVAN. ME,MY WIFE AND THREE YOUNG CHILDREN(AGES 14, 10 AND 6)HAVE
RECENTLY MOVED INTO OUR HOME AFTER OUR HOME IN KESWICK BURNT DOWN ON JULY 13TH,2008 DUE TO LIGHTNING
(THE HOME REMAINS IN IT'S BURNT CONDITION TILL DATE.)
AFTER RECENTLY MOVING INTO OUR CURRENT HOME,WE NOTICED THAT THE WATER HAD A VERY FOUL SMELL OF
VARIOUS SUBSTANCES. THE WATER ALSO HAD A TERRIBLE TASTE TO IT. THEREFORE,WE THEN BEGAN BUYING WATER
AND BORROWING FOR OUR NEEDS.
I CALLED THE HEALTH DEPARTMENT AND OTHER WATER TESTING COMPANIES IN TOWN AND EXPLAINED OUR SITUATION. I
WAS IMMEDIATELY ADVISED TO CALL ESS(ENVIRONMENTAL SYSTEMS SERVICE,LTD)LOCATED IN CULPEPER,VA. AFTER
EXPLANING MY SITUATION TO THEM OVER THE TELEPHONE,THE ADVISED US NOT TO EVEN WASH OUR HANDS WITH THAT
WATER AND BRING IN A SAMPLE FOR TESTING,WHICH I DID IMMEDIATELY. THEY TOLD ME THAT THEY DO SOME TESTING IN
THEIR LAB AND SOME TESTS HAVE TO BE SENT OUT OF STATE.
I GOT A COPY OF THEIR RESULTS ON FRIDAY VIA MAIL. THE RESULTS WERE
ASTONISHING TO BOTH ME AND MY WIFE WHO ARE HEALTH CARE PROFESSIONAL AT •
THE UNIVERSITY OF VIRGINIA. THE CONTENTS OF THE SAMPLE ARE DETRIMENTAL
OUR HEALTH OR TO ANYBODY WHO COMES IN CONTACT WITH. INFACT,THEY ARE
SERIOUSLY LIFE THREATNING TO SAY THE LEAST. I WAS ALSO GIVEN A TELEPHONE
CALL BY ESS IN REGARDS TO THEIR FINDINGS AND ADVISED ME TO TAKE IT TO MY
LOCAL COUNTY ASAP.
THE VERY NEXT BUSINESS DAY IS TODAY, MONDAY, FEBRUARY 2ND,2009. I AM HERE
TO PLEAD WITH YOU TO KINDLY DO THE NEEDFUL AND HELP ME AND MY FAMILY THRU
THIS SERIOUS AND HAZARDOUS SITUATION. ME, MY WIFE AND MY CHILDREN HAVE
HAVE PUT OUR HEALTH AND OUR LIVES INTO YOUR CAPABLE HANDS.

Dear Mr. Chavan,
Your application to construct a new well filed on February 6,2009 with the Virginia Department of Health was reviewed
in accordance with the requirements contained in the Code of Virginia, Section 32.1-164,the Private Well Regulations,
and current agency policy and procedures for processing applications for private wells.
On February 6,2009,you came to the Albemarle Health Department in person and informed me that you had been
running out of water on a frequent basis. You went on to say that a State approved lab had confirmed the presence of
E coli Bacteria and that you believed the water had a pronounced petroleum smell. I informed you that it would be a good
idea to drill a new well in a different location and you later submitted an application to do so.
On that same day,I made a site visit to your property for the purpose of finding a suitable location for a new well to be
drilled. Upon arriving on the site,you showed me your existing well in a sub grade vault approximately ten(10)feet from
your house. I then asked to smell the water from your kitchen tap,and upon doing so, confirmed the obvious smell of a
petroleum product. Upon evaluating the site further up the hill behind your house,houses were noted to either side of
your property. After asking you where other neighboring wells were located,you informed me that your neighbors had
drilled several dry wells in the past few years and that the County had allowed them to connect to the public connection.
Based upon the information gathered on that day,I am denying your request to drill a new well and recommend
that you connect to the Albemarle County Service Authority Public Water line if you are able to do so. This decision is
based on the fact that the contamination and its movement cannot be positively understood without further study of the
underlying geology and what sources of potential contamination reside on surrounding parcels. Due to the possible
contamination of your well water with petroleum,I recommend that you stay at a friends or neighbor's house until the
situation is remedied. If you must stay at your residence,I strongly recommend that you and your family not ingest any
water that comes from your well.You should drink bottled water and should use this bottled water for tooth brushing.
If ccordance with the Virginia Administrative Process Act, Chapter 1.1:1 and Title 32.1-164.1 of the Code of Virginia,
this is to inform you of your right to appeal the decision specified in this letter.If you desire to pursue your right of
appeal, you may at your discretion be represented by counsel.The first step in the appeal process is to submit a written
request within 30 days of receipt of this letter a letter to Dr.Lilian Peake.All of the facts and other information which
would support your request for an appeals review should be included.
