that you can do to assist at this point...someone will let you know when everyone has signed them and a copy is ready to
be picked up.

I think you can. E911 wanted me to reiterate their comment,which is as follows:
This site will require a private road name at the time the third structure is built. To minimize the impact of re-
addressing the existing structures we recommend establishing a private road name at this time. The applicant
will need to speak with the property owner of TMP 45-111A (Stellar One Bank) to develop a list of potential road
names that would have to be submitted and approved by this office.

Hello Scott,
You are correct that I approved the WPO plans. However,there is a condition of approval for the site plan that still
needs to be addressed.There is a detail from the approved Phase 1 WPO plans that discusses improvements for
downstream channel,which expired. Due to the number of complaints I received about the site, I recommend
notes/details on improvements for the downstream channel to be attached to the WPO plan. Let's shoot for a time to
discuss this on Monday.

On another topic, during m preparation of the staff report it has come to light t .t there are a couple of conditions of
preliminary approval asso'iated with the WPO plan that haven't been addressed. -m handling this by noting in my
report that they haven't .een addressed and saying that Engineering will make sure t' >t the conditions are satisfied
prior to granting appr. al of the site plan. In other words,there may be a few other ite to deal with before the site
plan can be signed. ichelle and I have talked about this in detail, and I think she can answ- any questions you might
have.
The site plan itself also has several conditions of approval that haven't been satisfied...official ARB approval (with
conditions satisfied), ACSA approval, an approved landscape and lighting plan, etc...these items are also noted in the
report as not currently satisfied and 'in progress'. None of these should come as a surprise since they have been in the
comments you have received. I wasn't sure if the WPO items had been covered before or not, so I wanted to make sure

After I sent the comment about landscaping for Northtowncenter I received a pdf with the
changes that addressed VDOT comments by removing the proposed landscaping with the Route 29
right of way from Scott Collins.
As long as the revisions were inserted into the plan for approval I have no objections to the

I am sending down (2)sets of Northtown Phase IIA plans for your final review and approval. We have approval from
Engineering and Fire/Rescue on the project. ACSA has approved the project, pending some completions of the
dedication of Phase I utilities,which is being wrapped up now. ARB had just a couple of final comments, which have
been resubmitted this week(attached is a comment response and their list of final comments). I think we are pretty
much there, once Margaret looks at the plan one more time. I was hoping that you could also wrap up your final review
while Margaret is finishing hers over the next week or so. Gander needs to get their Building Permit by the end of the
month, so we need to try and keep everything moving forward, if possible.

I'm trying to get my report written for this to go on the April 9th agenda. I marked up the copy of the site plan that I
have,can you send me a digital copy of the plan sheets dated 2/19? It can't show any revisions you've done since then

It's just not possible, I can't get the report written by next week...I have 6 other deadlines between now and next
Wednesday(the day the report would be due). Additionally,you have a certificate of appropriateness with conditions,
and many of the conditions haven't been met. And, I think the biggest issue is the WPO plan...many of the conditions of
approval of the preliminary were about WPO issues and it looks like that was just resubmitted 4 days ago.
To answer your previous questions about faster scheduling b/c it's on consent: It has to do with the required lead time
for the reports to go to the PC...the PC members get it a week in advance, which means it's due a week before that for
attorney review and all that good stuff. It also has to do with the availability of meetings...right now, there is only a 4/2
meeting(can't meet the deadline for the report) and a 4/23 meeting scheduled, so that's where we are.

It also just occurred to me that this has to go to the PC for final approval...it was a condition of the preliminary approval.
Due to changes in the ordinance and such, it will go on consent, but it still has to go. I need to wait for the other

reflect changes to address your comments as described below:
Planning
1 [Comment]It appears that a 24'access easement is being provided for the future Phase 118.For your
information,should this property be subdivided to split Phases IIA and 118,a minimum 30'private street easement
would be required,and private street approval would be necessary for frontage for Phase 118.Similarly,if you plan
to subdivide Phase IIA from Phase I,the existing 24'access easement would need to be increased to a minimum of
30'to qualify for private street approval.
-A 30'access easement has been provided from Phase I through Phase IIA to the limits of Phase
IIB. If Phase IIB is ever subdivided from Phase IIA,then the travelway located within this access
easement would need to meet the private road standards. Note added on Sheet 3.
2 [Comment]The parking and building setback lines along Route 29 have two different labels.In one area
they are refered to as 20'buffer and 50'building setback,and in another they are labeled 10'parking setback and
30'building setback;please correct on all sheets.
-Parking and building setback labels have been corrected on all plan sheets.
3 [32.5.2(a)]The boundary information provided does not include reference to TMP 04500000011180,and
the cover sheet provides the incorrect acreage for TMP 04500000011100;please verify and provide accurate
existing boundary lines and acreage information.
-TMP-45-111 and TMP45-111B have been referenced on both the existing conditions(Sheet 2)and
the cover sheet. Existing boundary lines and acreage information has been provided.
4 [32.5.2(a)]Add A/A(Airport Impact Area)to the Zoning note. Please also document the waiver granted for
disturbance of critical slopes including the associated conditions of approval by reference to the approval letter for
SDP 200400045 dated October28,2005.
-AIA(Airport Impact Area)has been added to the Zoning notes on the cover sheet. Critical slope
impacts were previously approved with the Phase I development plan(approval of SDp-2004-024
and SDP-2004-045). This was approved by the Planning Commission on October 18th,2005 and the
Board of Supervisors on November 9th,2005. The conditions of approval for the critical slope
impacts are located on the cover sheet.
5 [32.5.2(b)]While the maximum building height on HC zoned land is 65',any building height in excess of 35'
requires an additional 2'of setback for each 1'in height above 35'. The cover sheets states"'proposed building
height is approximately 40'to highest peak". It appears this is referring to the front façade treatment, which is
exempt from the setback provisions.Please provide the actual maximum building height(not approximate)to verify
that no additional setback is required.
-Cover sheet Building Height notes have been updated. The proposed building height is 28'-10"
from the ground elevation to the top of the parapet wall. The building peak(front facade
treatment)is 40'-0"from the ground elevation to the top of the structure. Since the front façade is
exempt from the setback provisions,the building is within the 35'requirement and no additional
setback is required.
6 [32.5.2(b)&4.12.4(a)]The number of parking spaces provided may not exceed the number of spaces
required by more than twenty(20)percent. The site plan indicates that the requirement is being exceeded by 54%.
Please either reduce the number of parking spaces to a maximum of 209,or request a waiver from this section of
the ordinance.
-Parking notes updated on the cover sheet. The total number of parking spaces provided with this
phase has been reduced to 196. With a parking requirement minimum of 174 spaces,the 196
spaces provided are within the 20%requirement.
7 [32.5.2(b)]Provide the maximum amount of impervious cover on the Cover Sheet.
-Maximum amount of impervious cover has been provided on the cover sheet. Impervious notes
have been provided to detail both the total impervious cover of the Northtown project as well as

outside of the site,some are in utility easements and some are directly on top of proposed utilities and drainage
structures.Please move plants into more suitable locations or provide approval from the associated agency(VDOT,
ACSA,etc)that they will allow the plantings within their property/easement.
-Landscape plan updated with all plantings removed from the existing and proposed drainage and
utility easements on the site.
16 [32.6.2(j),32.7.9.4(b)& Condition of approval]Existing trees may be preserved in lieu of planting new
plant materials in order to satisfy the landscaping and screening requirements of section 32.7.9 or to meet
conditions of approval,subject to the agent's approval. It appears the Preliminary Site Plan and first Final Site Plan
were approved with a condition that certain trees along the border of the 20'undisturbed buffer be marked and
preserved. The landscape plan should show the trees to be preserved,the limits of clearing,the location and type of
protective fencing,grade changes requiring tree wells or walls,and trenching or tunneling proposed beyond the
limits of clearing. The conservation checklist refers to these elements,but they don't appear to be present on the
plan.
-Plans have been updated to protect existing trees on the south side of the property. The retaining
wall and travelway layout have been modified to provide a maximum buffer area and ensure that
no disturbance takes place within the 20'undisturbed buffer. Limits of clearing and disturbance
have been added to both the grading and landscape plans.
17 [32.6.2(j)&32.7.9.5(a)]An area of at least five(5)percent of the paved parking and vehicular circulation
area shall be landscaped with trees or shrubs.Neither the areas of street trees and shrubs required by sections
32.7.9.5(d)and(e)nor shrubs planted between a parking area and the building shall be counted toward the
minimum landscaped area for a parking lot.As noted above,the square footage of'paved parking and vehicular
circulation area'has not been provided.Additionally,the 5%requirement refers to square footage of planting
space, not tree canopy(as provided on the plan submitted).Please provide all relevant information to verify this
requirement is satisfied.

show a retaining wall where it is currently proposed in Phase HA;this condition is applicable to the proposed wall as
well.

32 [Condition of Preliminary Approval]Grading to the edge of the undisturbed wooded buffer on the sides of
the site will likely cut tree root systems,damaging and eventually killing trees. On final plans,the grading should be
moved back,or specific trees surveyed and marked on plans to ensure survivability of trees within the undisturbed
buffer.

disturbance and the undisturbed buffer area.
