I want to assure you know the status of the project being you requested information on the site and inquired about a fence being put atop the hill. After our last discussion staff took a closer look at the requirements of the ordinance with regard to screening. Staff also looked into how/why the other sites had fence requirements atop the hill.Namely,those other proposals relied upon critical slope waivers, and as part of those waivers fences were required due to the large amount of disturbance of the slopes which contained substantial amounts of trees for screening. The critical slope section of the ordinance has recently changed, where as now these slopes onsite are classified as "managed", thus the development could disturbed the slopes without a waiver provided they meet the design standards of the County. Regardless,the Acme site does not propose to disturb any of the slopes,thus no waiver would be processed or required to develop the site. Upon final review of the plan the current proposal preserves the required 20' undisturbed buffer between the commercial lot and the residential district, as is required by the ordinance. The proposal goes even further to preserve existing vegetative screening by preserving upwards of 50' of existing vegetation on the managed slope. Thus the screening requirement at the rear of the property are met. Planning staff has taken your request for a fence into consideration and added it to the approval letter as a recommendation(#13) for the applicant to make a decision as to whether they would like to provide the fence.
