Here is where we stand on things:,"'' 1. We have written permission from our neighbor to the north to enter his property to complete required work as shown on our latest plan submission. A copy of this agreement is attached. 2. We have sent a letter to Mr. Harper re: the storm water tie-in fee. A copy of this letter is attached. 3. We have a planting plan. We do not yet have a response back from the County on our bond estimate request. I will follow up with Ms. Kilmer on that. Do you want four copies of the planting plan only or the entire E&S set? My plan is to deliver this all to you tomorrow or Friday, except for the bond piece. I am unsure of the turnaround time needed for that particular item. Referring to our last correspondence,the following items remain before plan approval; 1. Permission or easement from owner of parcel 56A2-01-53,where the plan currently shows work. Alternatively,the plan can be revised to removed any work from this neighboring parcel. See comment 1 in the attached memo. 2. Water Protection Ordinance requirements must be addressed. We have agreed that the plan could be approved without on-site collection and treatment or downstream channel protection, provided there is a written agreement between the church and the County General Services Department to make use of the county project and pay a pro-rata share when an amount is officially established. When you have your plan approved, and the bond has been posted and signed by the owners, county attorney and county engineer, a preconstruction meeting can be held. We understand that the County is still in the process of setting up the District and the mechanism for non-residential landowners to participate. Since the timing of our project requires us to move forward now, Crozet United Methodist Church (CUMC) acknowledges and agrees to pay the required one-time fee at a rate of $20,000 per added impervious acre when the District and administrative structure is set up and in place. We have calculated the additional net impervious area that our project is creating at a total of 0.543 acres. Based on our understanding, this would obligate CUMC to pay a one-time tie-in fee of $10,860.00. We also understand that acceptance of the terms of this letter will allow the church to proceed with the necessary work to tie into the existing system prior to submitting the required fee due to the fact that the administrative system is not yet set up. Certain work as part of the CUMC Site Development Project requires the Contractor to cross the shared property line on the north side of the project area. This work will be intermittent during the construction period (May through August 2013) and will have no material impact on any current activities on the Blue Goose property. Greg From: Greg Harper Sent: Friday, April 19, 2013 11:38 AM To: 'Mike Carmagnola' Cc: David Anhold; Paul Rogers; Glenn Brooks Subject: RE: CUMC Storm Water System Tie In Mike, I was able to speak with both Mark Graham and Glenn Brooks (Community Development Department)yesterday and we'd like to suggest a way to address the issue with the timing of your project versus the establishment of a County process allowing developers to "buy into" the recently-constructed Crozet Stormwater Wetlands Project. The County has begun—but not completed— the process of creating a pro-rata district, in which development projects naturally draining to the County project would pay a fee to the County in lieu of constructing onsite stormwater management.The fee would likely be based on the amount of additional impervious area created by the development with the intent that all future development within the watershed would, collectively and over time, pay for the County project. Unfortunately, we don't yet know the rate of the fee. However, early discussions and calculations suggest that the rate would be in the range of roughly$20,000 to$25,000 per(added) impervious acre. Therefore, if your site work resulted in an additional quarter acre of parking lot your fee would be $5,000 to $6,250. Note that this would be cheaper than designing and constructing onsite stormwater management. In order for you to receive a permit from the Department of Community Development, you are requested to submit a letter from the Church stating that the Church will pay the appropriate fee to the County once the County process is established. As you know, we are the first project to do this and plan to start construction in May. We will need to have the process in place or an agreement to undertake the process later when it is finalized. We certainly don't want this part of the project puzzle to hold us up. Please advise if there is anything further you need form me or the church. I would also appreciate an update so I can keep folks informed. Thanks Mike 2
