Thus it looks like we're in business...Please have the owner/managing member Peter Lunt sign the deed in the presence of a notary and submit that document to myself or Greg for County Executive signature. Once that has been signed by the County Executive we can have the Subdivision Agent approve this plat. Here are my thoughts on the two issues Chris has raised. Proffer 1 for ZMA 2006-011 refers to the open space being privately owned,which appears to be already satisfied for Open Space areas A through E as noted in Recital B of the Declaration. Proffer 1 also requires that the open space be privately maintained,which the Declaration addresses. I don't know if there is any other open space required to be dedicated to public use or if something has changed since the ZMA was approved, but it appears that the open space issue is outside of the scope of the declaration. ith respect to drainage,VDOT requires drainage easements for those required improvements that drain water off public streets,and regAim that the CotlitheettSetrnerit holder.Proffer&expressly requires the dedication of • `; e ; 'th the dedication of ROW fstecline of SR,631.: I don't know if resolution of these issues requires any changes to the declaration, or its exhibits (the plat and open space description). Until just now, I was unaware that the documents were transmitted to the county attorney directly. Regardless,that is fine...once he's approved it, provide me the approved documents for the file along with his approval letters of each document. Normally drafts of the documents are provided to the planner reviewing the project 1st, we then review them preliminarily to assure all proffer items and met with the documents. After our initial review we either work with the applicant to correct any omissions which may be required per the proffers and the plat...once all items appear to be remedied we then we send them to the County Attorney w/any comments or issues we may have found and await his approval/review. Like I said above, regardless the way you're doing it (working directly w.the County attorney) is fine,just assure you provide me the approved documents for the file along with his approval letters of each document.
