I am assuming the Residue Parcel 74 will retain 2 rights,one for the 19 acres and one for a dependency so the 2 rights that go with Parcel 'X'will be limited to 4 acrss total, not 6 as your email mentioned. Campbell' Subject: RE: SUB201300187 Jennifer Levien- BLA I discussed this with Francis and it looks like you can do the division as proposed, but you will need to revise the development rights note to say that the two development rights transferred with Parcel X to TMP 47-57 are restricted to 6 acres total and must be used within the 1980 boundaries of TMP 47-74. The residue of 47-74 uses the other available 19 acres from the 31 acre restriction. This assumes the remaining acreage from Parcel X will be allocated to the development right lots associated with TMP 47-57 if/when it is subdivided. Hope this makes sense, if not give me a call. I talked about it with the guys here and I could not get past how she could do it as a 17 acre lot and not as a 19 acre lot. I do have questions: 1. Rights of further division- I am totally confused with this comment. I understand the 31 acre rule but do not understand why"a 21 aces parcel must be accommodated". I think you are addressing this from the standpoint of how I allocated the development rights.That is the least important issue from our standpoint. We can adjust as necessary.The proposed owner of Residue Parcel 74, Emily Taylor, daughter of Mrs. Levien, needs 19 acres based on her existing loan agreement so we would like to maintain that acreage.They would also like to have one additional development right in order to build a grandparent's cottage should that become necessary. Therefore this Residue Parcel will require 2 development rights. We can reduce or eliminate the number of rights transferred to Parcel 57 with the 19.665 Ac. Parcel X if that takes care of the 31 acre rule problem. Since I do not understand your math I may be wrong on this but I have described what the Taylors need with the hope that a solution is available. 2. General Information—We do not like to have a revision date on a plat that has not been approved and recorded. It seems to indicate that a previous plat is out there that a revised plat supersedes. In the past, if changes have been made based on County comments we send a highlighted plat showing the revisions so that the planner can see what has changed and how the comment was addressed. I would not have anticipated a next official submission. How do I handle this? 3. Statement of consent—no question just letting you know I have updated the statement. 4. Acreage of lots—no question just letting you know that those acreages have been corrected. He said that you were doing the review and he would go over what we talked about. I understand from JT that comments may be ready on Jan. 21st so I wanted to send you the attached revised plat. Nothing has changed but a very minor(0.012 Ac.)change in the acreage of Parcel 'X'.This resulted from finding an iron at the SE corner of Parcel 57 that we missed on our initial traverse.When setting irons this week we found the iron with the help of Brian Chambers who is surveying Mrs. Levien's Parcel 57 for a two lot subdivision. I assume you will be reviewing that plat also. If you have any questions or need a clarification please respond or give me a call.
