Because of the Water Protection Ordinance buffe , the parcel is considered to be a non-conforming lot. So, depending on how the new lot lines are drawn, there may be a need for a special exception from the Board of Supervisors from the building site requirement found in Section 4.2.1. Here is a screenshot of the regulations: i 4.2.1 BUILDING SITE REQUIRED No lot other than a special lot shall have less than one II )building site, subject to the following: a. Composition of building sile. A building site shall be composed of a contiguous area of land a: may not contain any area of land that is: (i) in critical slopes: (ii) within the flood hazard overt district; (iii) under water during normal hydrological conditions; (iv) within two hundred (20 horizontal feet of the one hundred year flood plain of any public water supply reservoir; and ( within a stream buffer under chapter 17 of the Code, provided that nothing contained herein sh; be deemed to prohibit or impair the program authority from exercising its discretion as authoriz in chapter 17. b. Special exception. Notwithstanding section 4.2.5, any requirement of section 4.2.1(a) may waived or modified by special exception under section 31.8 upon the board of supervisoi consideration of whether CO the parcel has an unusual size, topography, shape, location or otli unusual physical condition; or tii) development in a stream buffer on the parcel was authorized provided in section 17-321 of the Code. (*20-4.2.1, 12-10-80; 11-11-87; 9-9-92: * 18-4.2.1, Ord. 98-Al 1 ), 8-5-98; Ord. 11-18(6), 6-1-I 1; Ord. 1 18(4). 7-11-12) The application fee for a two-lot subdivision is $540 and the fee for a special exception request from the Board (if needed) is $425. If you're interested in pursuing this division, then I suggest you contact a licensed surveyor that is familiar with our regulations.
