As per your request I'm attaching recorded copies of the plat and documents.
I've revised SUB 2014-049 adding the references above and I'm attaching a review copy.
As to status for site plan (SDP-2013-67) approval, I recall the only outstanding comment was adding the above references
and submitting for approval.
This site plan needs approval in order to get a bond estimate to Charlotte Harper.

I have no objectio. to SUB2013-181 (R/W vacation plat),rather I'm just waiting on V I)OT's approval. Once
I , we receive V.5 OT approval we're good to go to the next step. After we obtain •OT approval the
applican eeds to submit the signed plat and all of the signed deeds to •- "ounty.A couple of the
:- . -quire Tom Foley's signature. Once we have Tom's signature on the applicable deeds we can

2) All platting issues with SUB2014-49(final sub plat)have been addressed. Rather I'm just waiting on VDOT's
approval,and an approved road plan,and posting of bonds for sidewalk and landscape strip, and all other required

Looking over the March 24 comment letter, I find the only pending item remaining on this plat is VDOT's
approval. At this time I still have not received VDOT's approval. Once I receive their approval we can move
forward.
With regard to the applicable legal documents which are to be set to record with the plat: it appears that I have
received the County Attorney's approval for them all, except"1---Parcel A-3 and B-3 Deed of Dedication".
Once I receive the approval of that doc I'll forward it to Lori and cc you.

Greg has completed his review of the legal document for the A-1 Greenbelt Trail Deed of
Dedication. It has been determined that the County only needs an easement that gives the
public a right of passage on the sidewalk that also will be regularly used by the residents
of Stonewater, rather than the standard greenway easement. Greg provided the attached
document for your consideration. You will need to plug in the legal description and Rio
Holdings' name..etc, but otherwise how does the attached document look?

The change requested on the deed of vacation has been made. No, per the site plan,the applicant will be
constructing the sidewalk within A-1. The greenbelt dedication deed (County form deed) does give the County
the right to establish sidewalks or trails within such easement, but the applicant itself will be constructing
sidewalks(and landscaping) within that easement in accordance with the site plan.

review of the document he questioned staff as to the legitimacy that the County should be responsible to
build the 10' sidewalk in within parcel A-1. As of today I have received word from Dan Mahon of Parks
and Recreation on this document. Both he and I are in agreeance that the County should not be
responsible to build the 10' sidewalk for greenway purposes contained in Parcel A-l. Please respond to
the above situation prior to staff moving forward with this aspect of the project. Was that truly the
applicants intent?

Kirk brought to my attention your Comment#3 in your latest plat review,which asks for verification of responsibility to
maintain the new easement areas A-1 and B-1 created from vacation of portions of Penfield Lane. Kirk's Note#13 on
the vacation plat is correct(those two areas will be maintained by the Association), but the notes on the townhome
subdivision plat will need to be revised to refer to a Second Amendment to Declaration, attached. Article IV of the
Declaration,which is referred to in Note#8 of the subdivision plat, deals with common area that will ultimately be
owned by the Association. Since Parcels A-1 and B-1 are easements over what will be Lots 42 and 43, respectively,they
are not Common Area as defined in Article IV of the Declaration. Instead, I have added a new paragraph to Article V
("Easements")to provide for their maintenance by the Association.
I should note that the greenbelt dedication deed states that the County may maintain certain improvements within that
easement(over Parcel A-1). We understand that the Association needs to maintain that area and all improvements
within it and that the County's right to maintain is discretionary.

Hi Chris,
Kirk said you might have a question about who maintains the sight distance easement areas. The deed we
sent to Greg, attached, based on a County form, states "If the Easement or any part of it is on common area to
be owned and/or maintained by an owners association, maintenance shall be the responsibility of the
association. If the Easement or any part of it is within the area of a lot, then the responsibility to maintain it
shall be the responsibility of the lot owner." Based on plat Note #13, the improvements in the sight distance
easement located within A-1 would, therefore, be maintained by the Association, and the anything in the sight
distance easement on Block B would be maintained by the (Lot 43) lot owner.

Kirk-As we discussed,the Landscape and Sidewalk Maintenance does not need to be publicly dedicated. Maintenance
of sidewalks and landscaping are dealt with in the Declaration of Covenants. It would be more appropriate to label B-1:
"Open Space Easement for Landscape and Sidewalk Maintenance under Declaration recorded at Deed Book 4343, at
page 626". A-1 should have a similar label. A-1 also will be dedicated for the Greenbelt Trail. I do not see any problem
with the Greenbelt and the sidewalk uses overlapping. I will prepare a simple Greenbelt Dedication for A-1. Let me
know if there are any other comments relating to this as we proceed.

Also, I'm addressing your final comments below.
1. During our plan review, we are requiring the relocation of most of the water meters. The plat should reflect those
changes.(I'll address this concern with the final plat for the townhomes.)
2. There currently is a sanitary sewer main that crosses Penfield Lane. With the removal of some public right-of-way,
the plat should add easements to cover this sewer main.(made change to the plat)
3. The sanitary sewer easement associated with Block B needs to be extended to the property line with Stonehenge.
(I'll address this concern with the final plat for the townhomes.)

Attached is an exhibit for a variable width VDOT easement for the location of a possible future stoplight at the
intersection of Pen Park Lane and Rio Road. Based on the other stoplights on this roadway, it appears that the location
of one of the two signal poles and controls would be on the southwest corner of the intersection. I have drawn these in
as well to see how they fit within the easement. Please let me know your thoughts on this, when you get a chance. We
are trying to finalize the vacation plat and final construction plans for the TH units.

I just met with the traffic signal folks from NWRO concerning this right-of-way. Th: proposed right-of-way for
the signal is not going to be adequate for the signal equipment. In addition,with not having a design in place,
we will need right-of-way on the north side of Penfield Lane as well. They are going to provide me a detail
showing the area that they need available for a signal, hopefully next week.
Kirk, I don't believe that Rio is a primary road, so the right-of-way would not be dedicated to the
Commonwealth. I sure that Penfield is not.

Thanks Chris for your comments. Those which involve the Deed of Vacation of Street Dedication, I would like to
respond to as follows:
1. Attached is a Deed of Vacation which is already being circulated for signature. I sent this draft to Greg Kamptner
by email on December 30. I believe the Vacation is actually governed by Va. Code Section 15.2-2270. The public
right of way was granted by separate instruments(Deed of Dedication) and not with a Plat of Subdivision; and
pursuant to site plan approvals previously granted.The private easements do not need to be vacated pursuant
to a statute. As such,we are not vacating the subdivision plat. Therefore, owners of other lots in Stonewater,
besides the Declarant, do not have to join in the instrument.
2. The attached Declaration covers the easement recorded at Deed Book 3932-505. It is already being circulated
for signature by Tresdale,the successor to AHIP.
3. Similarly,the attached Declaration covers the easement recorded at Deed Book 3932-516 and is being
circulated for signature by Stonehenge.
4. There is no need to obtain consent from the lenders who have a deed of trust secured by the unsold Stonewater
parcels. The lien of the deed of trust is already subject to the public right of way dedication and to the private
easements.Vacating a portion of such right of way(s)does not require the lender's consent. Indeed,the
vacation enhances the lender's collateral. If we were vacating a portion of a lot however,you are correct that
the lenders' consent would be necessary.
5. The maintenance of the green belt trail (to the extent that it is on common area) is covered by the Declaration
of Covenants for the Subdivision.Which Declaration has already been reviewed by the County(for the first
subdivision). [I can send you a copy of the recorded instrument if you need it.] Maintenance of the dedicated
portion of course is governed by the recorded dedication agreement with the County, also attached. I am not
certain what other easements need to be reserved and would ask Kirk Hughes if the notes 13 and 14 are
necessary. The Declaration reserves future easements to the Declarant, but we do not yet know what those
may be so that there nothing else at this point to put to record.
6. Comments 6-13 I'll leave for Kirk or Scott Collins to respond. Thanks again.
