Kleinmichel 977 Seminole Trail #302 Charlottesville, V A 22901 RE: SP 2005-007 The Garden Barn (Signs #28&29) - Tax Map 21 Parcel5Bl Dear Ms. Kleinmichel: On July 6, 2005, the Albemarle County Board of Supervisors took action on SP 2005-007 to allow farm sales in accordance with Section 1 0.2.2( 45) of the Zoning Ordinance on Tax Map 21 Parcel 5B I in the White Hall Magisterial District. This special use permit was approved based on the following conditions: 1. The site shall be developed, and the farms sales use conducted, in general accord with the preliminary schematic plan entitled "Garden Barn Application Plan SP-2005-7," prepared by Gabriele Kleinmichel, and dated 3/29/05; 2. The applicant shall make the entrance improvements specified in a letter from VDOT Assistant Resident Engineer, Charles C. Proctor, III, dated 3/24/05 (excluding the requirement for a site plan showing the proposed improvements); and 3. Hours of operation each day shall be between 5:00 a.m. and 9:00 p.m. Please be advised that although the Albemarle County Board of Supervisors took action on tbe project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: . compliance with conditions of the SPECIAL USE PERMIT; and . approval of a ZONING COMPLIANCE CLEARANCE. In the event that the use, structure or activity for which this special use permit is issued is not commenced within twenty-four (24) months from the date of Board approval, it shall be deemed abandoned and the permit terminated. The tenn "commenced" means "construction of any structure necessary to the use of the permit."
