The declaration doesn't need to be signed by us...I can't remember if there were other deeds(like drainage
easement)...those would need county signature, but the declaration doesn't. We just want a copy of the recorded
declaration once it's all complete.

The only revision that Steve needs to make to the drawings is to add the following note to the cover sheet (per Ellie's
comment 3):
Where a side setback of less than 4'11" is used, a 6' maintenance easement shall be recorded on all properties adjacent
to the side setback of less than 4'11".
Please ask Steve to add this note to the drawings and send the final version to me, so that I can in turn send them to our
attorney to draft the Supplemental Declaration.

I believe this addressed the issue, but in case things change please add a note referencing Note 3 from Table 9 of the

Regarding Comment 3,the alley turnaround (and associated 3' BSL) pretty much guarantees that the planned
townhouse unit on Lot 1 will be more than 4'-11"from the shared lot line with Lot 24. The Builder's preliminary permit
plan shows this unit at 10.5'from this side lot line.
Thus, I believe that Comment 3 has been addressed. Please confirm.

Thanks for the quick response. I think we can live with the response to#1 by shifting the building over slightly, I
completely agree with#2 (I was going to suggest deleting the setback language), and it sounds like#3 is a non-issue.
I look forward to getting the comments early next week with the hope of having approved plat drawings in the next 1-2
weeks.
I think the Belvedere Ph. 2 lots have slightly more breathing room than Ph. 1 had (although I don't know that for sure),
so hopefully the maintenance easements won't be an issue.

I checked with Zoning on this since all of these items are a little oddball. See answers in red. I'm currently reviewing the
plat revisions and hope to get comments to you on Monday.
On a side note, I realized I didn't comment on the maintenance easements on the Belvedere Phase II plat...I asked zoning
to determine what they want (they've been dealing with that issue at the permit stage I think), so they are supposed to
get back to me next week about it. Just wanted to give you the heads up since I haven't previously mentioned it in
reference to that plat.

Ellie—
I reviewed the plat re-submission with Commonwealth earlier this week, and I would like your thoughts on a few of
items:
1. In response to your Comment 7,the plat has a 3' B.S.L. on Lot 1 at the alley turnaround. Commonwealth tells
me that this BSL is off of the alley easement,and not the edge of pavement. Can this BSL be from the edge of
pavement and not the alley easement?
• Setbacks have to be from the row/easement unless expressly stated in the Code. There is no such
statement in the Belvedere Code,so this setback does need to be from the easement, not the edge of
pavement. This would be eligible for a variation if you need to change it...though, of course,that would
take some time to get approved.
2. In response to your Comment 8,the plat has a 7' B.S.L. along the alley side of the lots, and once again,this BSL is
off of the alley easement and not the edge or pavement. Since this BSL is required in order ensure a minimum 7'
driveway length, shouldn't this BSL start from the edge of pavement?
• Since this"setback" isn't really a setback, zoning wants us to change the terminology. They want to
setback line removed and a note added that states the driveways must be a minimum of 7' in length and
therefore the buildings can be no closer than that to the alley. But,yes, this is from the edge of
pavement, not the easement.
3. Per Comment 15, I have confirmed that the planned dwelling unit will fit on this lot 10. Please confirm that the
required maintenance easement may extend into the ROW.
• You are correct that the easement can technically extend into the ROW....so I guess what this really
means is that no easement is required since there is"public" area available adjacent to the property.
Also, I have our attorney working on the Supplemental Declaration that will address several of your comments.
Hopefully we can get the plat drawings approved, and then I'll get the supplemental declaration submitted.

I reviewed the plat re-submission with Commonwealth earlier this week, and I would like your thoughts on a few of
items:
1. In response to your Comment 7,the plat has a 3' B.S.L. on Lot 1 at the alley turnaround. Commonwealth tells
me that this BSL is off of the alley easement, and not the edge of pavement. Can this BSL be from the ed a of
pavement and not the alley easement? — - ask Nt--^ '4 za►�-[I'-S 641-I
2. In response to your Comment 8,the plat has a 7' B.S.L. along the alley side of the lots, and once again, this BSL is
off of the alley easement and not the edge or pavement. Since this BSL is required in order ensure a minimum 7'
driveway length, shouldn't this BSL start from the edge of pavement? AS c►*- ,
3. Per Comment 15, I have confirmed that the planned dwelling unit will fit on this lot 10. Please confirm that the
required maintenance easement may extend into the ROW. I S Fi LIS
Also, I have our attorney working on the Supplemental Declaration that will address several of your comments.
Hopefully we can get the plat drawings approved, and then I'll get the supplemental declaration submitted.
