I think this means our request for an individual driveway was approved. My hesitation is due to the reference to
"Figure3" in the approval letter. I believe it should refer to"Figure 2",which was an aerial view of the lot with the
proposed individual driveway sketched in.The image captioned "Figure 3" in our application narrative is a photo of the
existing neighbor's driveway.The confusion is likely due to my error in numbering the figures out of order in our
application narrative. If you agree, could you send us an updated approval letter referring to "Figure 2" or to "the
proposed individual driveway"?

As a follow up to my email below, I wanted to add the following:
The attached photo is from the Albemarle GIS-Web with 2009 orthography shows trees as well as existing Lot
20's home's proximity to both Markwod Rd. and the property line.
• Any shared driveway-even an angled one as I proposed in my previous email -would have a negative
impact on the existing home and its occupants - which include at least one small child -- because vehicles -
especially large vehicles like UPS trucks or LP gas trucks or construction vehicles—entering the shared
driveway would come disconcertingly close to the front of the home.
• Any shared driveway would necessitate removing several trees— and would possibly damage remaining
nearby trees --that currently serve as a buffer between the existing property and Markwood Rd. Please see the
attached photo showing the maturity of the existing trees that line the existing driveway.

• The current owners of Lot 20 ( es6 Markwood Rd) did not build the home or design the driveway and did
not realize their driveway was to be shared with future owners of lot 19. The current driveway functions more
as a private driveway due to the location of the existing home and, if shared, even when slightly wider, would
function as if occupants of lot 19 were entering on lot 20 then driving onto lot 19.
• A shared driveway would be more hazardous than individual driveways when driving and merging to the
shared junction.
• As I mentioned below, sharing of the driveway would necessitate removing some of the existing asphalt and
repaving, as well as adding more paved area. Our plan for a separate driveway would be unpaved from
Markwood Rd. to the parking area near the new home.

Subject: Individual Driveways for Windrift Section 1 Lots 19 and 20
Mr Newberry,
Thank you for your help with our request to get approval for individual driveways for lots 19 and 20. My wife
Lisa and I ask that you consider the following in regards to a justification for a waiver. We have looked at
possible shared driveway layouts that minimize impact to existing structures and trees, as well as minimizing
the intrusion onto the adjoining property's yard (lot 20). The existing home on lot 20 is located fairly close to
the shared driveway location, so in order to reduce the hardship that would be felt by its inhabitants, we have
placed the proposed driveway onto lot 19 at an angle away from lot 20. (see attached images of lots 19& 20
from Google Earth from April 2013 as well as a proposed shared driveway). Unfortunately, we could not find a
way to avoid the removal of at least 3 existing trees adjacent to the existing driveway. If we had an individual
driveway, it would be located further away from the existing home on lot 20 as well as all existing trees and not
require their removal. Since the existing driveway is paved, our home builder recommends that the new
driveway be paved where it adjoins the existing driveway and can then transition to gravel. If we had an
individual driveway, it would be completely gravel, which is less expensive and allows for more uniform
rainwater drainage. A representative from VDOT visited the site and said that he would approve a permit for an
individual driveway based on his inspection of the sight lines, etc. He did not see any issues with having an
individual driveway for this lot. The two lots in question are in a relatively rural area and there is plenty of room
to put an individual driveway on lot 19. We request that you let us know if you feel a waiver is likely to be
approved or not based on these considerations.

Hi Lisa,
I spoke with both Francis (the gentleman that you spoke with on Monday) and the Subdivision Agent about your
question. I'm going to need some time to do additional research about the requirements that existed at the time the
plat was approved,which appears to be July 11, 1977.
A waiver or some other consideration from the Planning Commission may be necessary in addition to VDOT's evaluation
of the potential for an individual driveway.
Please let me look into it further before providing an answer.

Issue:We would like to have an individual driveway on a subdivision lot although the final plat of the subdivision shows
a shared entrance with the adjoining lot.The lots are located on Markwood Rd.,Windrift 1 subdivision, lot#19, tax map
18-63.

My understanding after speaking with a gentleman at the Planning office on Monday, though, is that I would need to
apply for a waiver to code 14-404 (B)" Conditions when single point of access not required."
This application process seems quite lengthy and involved and expensive-5830.
