1) I have •. objections to SUB2013-181 (R/W vacation plat),rather I'm just waiting on VDOT's approval. Once
we -ceive VDOT approval we're good to go to the next step. After we obtain VDOT approval the
,plicant needs to submit the signed plat and all of the signed deeds to the County. A couple of the
Ideeds require Tom Foley's signature. Once we have Tom's signature on the applicable deeds we can
approve the R/W vacation plat. Applicant then records it in the Clerk's Office.
2) All platting issues with SUB2014-49(final sub plat)have been addressed. Rather I'm just waiting s VDOT's
approval,and an approved re: plan,and posting of bonds fir sidewalk and landscape strip, and all othe equired
s o .- attached co • ent letter, comments#1 and#11). "

I've contacted VDOT on how they wish to handle their review of the revised documents to address their final comment
on the right of way which were dated 4-29-14.To facilitate his review Troy has requested that you submit hard copies of
all three documents for verification purposes to assure they match up and fully address his comment: (SUB2013-181
Stonewater—final right of way plat), (SUB201400049 Stonewater townhome—final sub plat), (SDP2013-67-Stonewater
Townhome Final Site Plan).
*The two subdivision plats mentioned above appear to only need VDOT approval left prior to moving forward,thus 2
copies of each will suffice.
*The site plan mentioned above appears to have more reviewers without approvals than just VDOT. Scott, if you are not
ready to fully submit the revised site plan for everyone's review can you make the required changed to the site plan so
VDOT can use it to verify/match up the changes,thus allowing Troy to make a finding as to whether the 4-29-14
comment is addressed. Depending on how you choose to handle this, if the site plan submitted is only being modified to
address VDOT comments, I'll only need 2 copies of the revised site plan. If you choose to address all remaining
comments, please submit the full amount.

I left a voicemail today to discuss Stonewater's final reviews and your comments dated 4-29-14 for SUB2014-49. How do
you want to handle this, do you want a formal hard copy for your review(if so I'll request it from the applicant)?Or will
the attached revised PDF(labeled SUB2013000181 (Rev.4-29-14))from Kirk Hughes suffice for your review?
Also, please note that the revised plat which I'm referring to is for SUB2013-181_the right of way vacation plat for
Stonewater. This is the 1st plat which will be set to record dealing with the right of way issue once we have your
approval. I noticed your comments were listed/labeled to apply to SUB2014-49_final plat for the townhomes; however,
that is the second plat that will be recorded in the chain of events for this project once we get your approval. Being
we're working with the same portions of land and the same project, can I assume that the 4-29-14 comments for
SUB2014-49 that you sent me are also applicable to SUB2013-181, if so I'll save them in Countyview in both. Please
advise.

Kirk, attached is the cad file for the r/w change as well. We will also need to perform a slight modification of the
entrance curb from a 35' radius to a 30' radius to accommodate the change. They want to install the stoplight(if
and when warranted)with (1) pole across the intersection and need every bit of room to accommodate this.
Kirk, update your plat for the r/w change and you should be ready to record. Then we can get the site plan
approved.

Here are Mike's comments and a pdf showing the necessary ROW. I will try responding to the County today or
tomorrow on your plat and site plan. The signal issue as it relates to ROW was the only outstanding item for the
plat that I remember. I think the warrants for the signal may need a little more attention, but I have to review
my e-mails on that one.

Troy,
Based on the traffic volumes provided by the developer,we should be able to accommodate traffic signal
installation using the 30 foot curb radius(30'face of curb) and right-of-way lines proposed in the attached
drawing.
One item that should be noted is that the proposed signal can be designed using a single diagonal 75 foot mast
arm which will reduce (or possibly eliminate)any impact to the stop bar location.

Below is the answer from our traffic engineer who did the analysis:
"The projected left-turn volumes on Rio in our study are very low—the highest was 40 northbound lefts in the
PM peak hour. Protected-permitted phasing would work fine. The only reason to use protected only lefts is if
there is a sight distance constraint,which there might be for the southbound left-turn if/when there is a box
truck waiting to make the northbound left-turn."

Thanks for the preliminary layout for a potential traffic signal at the above referenced intersection. The design
engineer for the townhouse development has requested that we sit down together to discuss potential
options/alternatives to this design. After discussing schedules with Teresa, it looks like next Tuesday(4/15) in
the AM may be the only opportunity this month for her to attend this meeting. How does next Tuesday in the
morning look for your schedule? I suspect that the location of the meeting is flexible if we can schedule

SUB2013-181 Stonewater Right of Way Vacation Plat

* Based on the review of the townhomes' final site plan (SDP2013-67) which commenced today, staff has an
additional comment(Comment#23 —see below) which can either be addressed on SUB2013-181 OR
SUB2014-49 Final Subdivision Plat, OR on another plat unrelated to the two mentioned. Regardless this
comment must be addressed prior to the the townhomes' final site plan approval. I'm CCing you to start the
conversation with Scott on how it shall be resolved. It appears that Lori Schweller's March 25th email w/her
attached DRAFT/unrecorded `Second Amendment to Stonewater Declaration of Covenants and Restrictions
and Easements' will adequately cover the maintenance agreement portion of my comment,pending County
Attorney approval of the document; however, now we need to assure the required Landscape Easements subject
of my Comment#23 are depicted on one of the two plats mentioned above (SUB2013-181 OR SUB2014-49)
and set to record w/Lori's `Second Amendment to Stonewater coy and restric'...prior to the final site plan is
approved.
"SDP2013-67 Comment#23) [32.7.9.9(d), 32.5.2(n), 32.7.9.7(e)] Installation and Maintenance of Required
Landscaping and Screening. For the required screening along Rio Road and Penfield Lane provide the
dimensions of the landscape easements that these plantings are to be located in and label them on the plan. Also,
prior to final site plan approval the easements shall be set to record with a maintenance agreement approved by

the County Attorney. Prior ttitinal site plan approval on the plan prow.<the Deed Book and Page reference
number of these recorded easements.
Staff suggests the applicant depict these easements on the Right of Way Vacation plat (SUB2013-181) or the
final subdivision plat (SUB201400049). Also assure to provide a maintenance agreement for the County
Attorney to review OR assure that the previous Covenants and Restrictions document covers the additional
landscaping easements and then set that plat and legal document to record. "
