The Albemarle County Planning Commission will meet at 6:00 p.m., Lane Auditorium, Second Floor, County Office Building, 401 McIntire Road, Charlottesville, Virginia. You or your representative,must be present at this meeting; you may call this office during the week of the meeting to ask the tentative time the item is scheduled on the agenda. After the Commission has taken action on the proposal, a second public hearing will be scheduled for the Board of Supervisors. The Board's meeting begins at 6:00 p.m (evening meeting) or 9:00a.m. (day meeting). You or your representative must be present at this meeting; A letter of notification of this hearing will not be sent to adjoining owners; however, you may check this website: http://albemarle.orq/upload/images/webapps/zoning/for SIGN # 13 to see its status at any time. Alternatively, you may sign up for A-mail by going to www.albemarle.orq. (Go to the "Department" tab at the top and select County Executive. At the County Executive's page, you will see"Albemarle County A-mail" by going to the menu on the far right of the page. It is the last item. Select this item and sign up from there.) At least fifteen (15) days preceding the commission's public hearing, the Zoning Administrator or designee shall erect on the property, subject to the above-referenced application(s), a sign (or signs) indicating the property is to be subject to public hearing and referencing how to obtain additional information regarding such hearing. The sign shall be erected within ten (10) feet of whatever boundary line of such land abuts a public road and shall be so placed as to be clearly visible from the road. If more than one such road abuts the property, then a sign shall be erected in the same manner as above for each such abutting road. If no public road abuts thereon, then signs shall be erected in the same manner as above on at least two boundaries of the property abutting land not owned by the applicant. The filing of the petition or application shall be deemed to grant consent to the Zoning Administrator or designee to enter upon the property and to erect the signs. Ms. Quillen Page 2 May 16, 213 Upon a finding by the Board of Supervisors that failure to comply with the posting requirements of this section has denied the public reasonable notice of the public hearing, the Board may defer action on the petition or application until reasonable notice by posting is given. The applicant shall exercise due diligence to protect the sign or signs erected, pursuant to section 33.8, from vandalism and theft; maintain the sign or signs in the location or locations in an erect position as placed by the Zoning Administrator or designee; and ensure that such sign or signs remain legible. Failure to comply with these responsibilities may be grounds for the Commission or the Board of Supervisors to defer action on the petition or application until there is reasonable compliance. Any sign erected pursuant to section 33.8 shall remain the property of the Board of Supervisors. It shall be unlawful for any person, except the applicant performing maintenance required by this section or the zoning administrator or an authorized agent of either, to remove or tamper with any sign erected pursuant to section 33.8. All such signs shall be removed by the Zoning Administrator or designee within fifteen (15) days following the Board of Supervisor's final action on the petition or application or the applicant's withdrawal of the petition or application. First Set of Review Comments Staff will perform its initial review of your proposal and provide a set of written comments on or before May 3, 2013. After this initial set of comments is provided to you, you may request a meeting with other staff and myself to review the comments. If we have provided comments that indicate the need to resubmit, please resubmit within 30 days of the date of the comments. Resubmittals Resubmittals are often provided to address staff comments and, if you plan to resubmit to address staff comments, please do so on a resubmittal Monday. Resubmittal Mondays are the 1st and 3rd Mondays of each month. You can find the 2013 Resubmittal Schedule as well as a tentative Planning Commission hearing date which corresponds to the resubmittal date online at www.albemarle.org . Please be advised that the Planning Commission date is a"no sooner than" date and is subject to the Commission's schedule. Resubmittals are not necessary if only small changes are needed from the initial submittal, such as a minor change to an existing special use permit condition or proffer. However, resubmittals are expected if changes other than minor changes are needed. There is no additional fee for review of the first resubmittal. The following fees apply to resubmittals after the first resubmittal: Special Use Permits—where initial fee was $1000 --$500 for each resubmittal Special Use Permits—where initial fee was $2000 --$1000 for each resubmittal Zoning Map Amendment—projects less than 50 acres--$1250 Zoning Map Amendment—projects 50 acres or greater--$1750 Response Needed If staff has not heard from you within 30 days of the comment letter date, staff will follow up with a second letter requesting that you: 1. Request withdrawal of your application, 2. Request deferral of your application to a specific Planning Commission date as mutually agreed to with staff, or 3. Request indefinite deferral and provide justification for this request. If staff does not hear from you after the second letter, staff will schedule your application for public hearing with the Planning Commission with a recommendation based the latest submittal staff received on a resubmittal date. Public Hearing A public hearing date with the Planning Commission will be set after you have received written comments from each submittal and have advised us that the project is ready for a public hearing or as described on the prior page. Public hearings require notifications to adjoining property owners and a notice run in the newspaper. Unless a major change in the description of the property, proposal, or adjoining owners changes, your fee for the public hearing costs will be $630.96. This fee may be paid at any time before the Planning Commission public hearing is scheduled. Be advised that the fees must be paid before the application will be scheduled for the first public hearing. Please feel free to contact me if you have questions or need additional information.
