Dear Mr. Seery:
We are writing in response to your request for a letter from our office regarding the zoning
classification of that certain real property located in Albemarle County, Virginia and more
particularly described on Exhibit "A" attached hereto (the 'Property"). This letter is to advise you
that the Property is located within the zoning classification designated by the Zoning
Ordinance of Albemarle County (the "Zoning Ordinance"). The Zoning Ordinance permits those
uses outlined on Exhibit "B" attached hereto, and incorporated herein by reference, within zoning
classification . The The operation of a hotel is one of the uses permitted in zoning classification
under the Zoning Ordinance.
There are no outstanding violations of building codes of Albemarle County, Virginia
applicable to the Property.

appurtenances thereto, situated in Albemarle County, Virginia, described as "Block C-8, TMP
32-41Q", as shown and designated on that certain plat entitled "Plat Showing Boundary
Adjustment and Easements for Tax Map 32, Parcel 41D, 41P, 41Q & 41R, Hollymead Town
Center, Block C7, C8 & C9, Rivanna District, Albemarle County, Virginia", prepared by
Dominion Development Resources, LLC, dated April 27, 2007, last revised August 21, 2007,
and recorded in the Clerk's Office of the Circuit Court of Albemarle County, Virginia, in Deed
Book 3515, page 549.
LESS AND EXCEPT all that certain piece or parcel of land described as "VARIABLE WIDTH
RIGHT OF WAY HEREBY DEDICATED TO ALBEMARLE COUNTY FOR PUBLIC USE
(0.079 ACRE), as shown on plat entitled "PLAT SHOWING A RIGHT-OF-WAY
DEDICATION, A VARIABLE WIDTH SIGHT DISTANCE EASEMENT AND A VARIABLE
WIDTH WATERLINE EASEMENT LOCATED ON THE NORTHEAST CORNER OF
TIMBERWOOD BOULEVARD AND BERKMAR DRIVE", attached to Deed of Easement
recorded in the Clerk's Office of the Circuit Court of Albemarle County, Virginia in Deed Book
5177, page 278.
TOGTHER WITH non-exclusive easements as set forth in instruments recorded in Deed
