Dear Mr. Keller:
The Board of Supervisors took action on ZMA 2004-016 and SP 2004-061 at their meeting on March 16,
2005.
Your rezoning from Planned Residential Development with Special Use Permit - PRD w/SUP for Office
Use zoning district, to Neighborhood Model District - NMD was approved in accordance with the Code of
Development dated October 18, 2004. An application plan dated October 18, 2004 was approved as part
of the rezoning. Please refer to these documents for any future applications and requests on this property.
The Albemarle County Board of Supervisors also approved SP 2004-061 to allow development of a drive-
thru window as part of a financial institution to include a total of 3 lanes, with one being dedicated to an
ATM in accordance with Section 20A.6b.1 of the Zoning Ordinance, which allows for drive-through
windows serving or associated with permitted uses in NMD on Tax Map 61, Parcel 129F in the Rio zoning
district. This special use permit was approved based on the following conditions as recommended by the
Planning Commission:
1. The outside lane is dedicated to bypass traffic only; and
2. The drive-through window as part of a [mancial institution shall be limited to three (3) lanes
that follow through to the teller windows and the A TM machine.
Please be advised that although the Albemarle County Board of Supervisors took action on the
projects noted above, no uses on the property as approved above may lawfully begin until all
applicable approvals have been received and conditions have been met. This includes:

· compliance with requirements of the CODE OF DEVELOPMENT;
· compliance with conditions of the SPECIAL USE PERMIT;
· approval of and compliance with a SITE PLAN; and
· approval of a ZONING COMPLIANCE CLEARANCE.
In the event that the use, structure or activity for which this special use permit is issued is not commenced
within twenty-four (24) months from the date of Board approval, it shall be deemed abandoned and the
permit terminated. The term "commenced" means "construction of any structure necessary to the use of
the permit."
