(1 Elk Run Corporation, a Virginia corporation, being the owner of those •

r certain lots of land shown on a plat of Section One of Windrift Subdivision, which l

I plat is to be recorded in the Clerk's Office of the Circuit Court of Albemarle
County, Virginia, does hereby subject said lots to the following restrictions, ease-
ments and conditions which shall be applicable to and binding upon each and every

i one of said lots. These restrictions shall continue and run for a period •
of twenty r

(20) years from the date of their recordation in the Clerk's Office of the Circuit .
Court of Albemarle County, Virginia. •
1. APPROVAL OF PLANS. No residence, building; boundary, fence, wall, ..
. driveway, well, septic system, or other structure, whether or not of a temporary `
t character, nor any unlicensed vehicle, shall be erected or placed upon these lots,
and no alterations or additions to any such improvements or structure shall be made,
t until the building plans thereof (including exterior building material, exterior
t color scheme, grading plan, and location of said improvement, structure, alteration
or addition) shall have been approved in writing by the Windrift Architectural

3ti Control Committee. Provided, however, that if disapproval of a plan has not been 1

i sent by certified mail to the owner of the lot within thirty (30) days after the •

1 plan was submitted to the Architectural Control Committee, such plan shall be con-

elusively presumed'to have been approved. •
If no legal action with respect to any breach of these covenants shall
) have commenced and no notice of lis pendens recorded within sixty (60) days after .

completion of such improvement, structure, alteration, or addition, it shall be
I conclusively presumed that there has been full compliance with this provision. 1

2. SIZE AND NUMBER OF BUILDINGS. In no event shall any house constructed

E on these lots contain fever than twelve hundred (1200) square feet of living space,
exclusive of garage, patio, porch, and basement areas, nor shall any building be '
erected so that any cinder block construction is visible above the ground level,
unless express written permission is first secured by the owner from the Windrift ' 11111i

In addition, no prefabricated or modular house, mobile home, or trailer 1
F - tV which is designed primarily for residential use may be constructed or placed on any
ri 4 lot in this subdivision.,

Furthermore, in no event may there be erected on any single lot more than

one appurtenant structure, which structure shall not include any living quarters.
