Homer Ballard,' SUBDIVISION DECLARATION OF OWNER-DEVELOPER et al To: Subdivision The attached plat of the Subdivision of "Laurel Hills", property Declaration • of the undersigned, sometimes referred to as owners, has been made with the "Laurel Hills" Property free consent and approval of the owners and they desire to have it filed for Fee $ 5.50 record pursuant to Chapter 23 of the Code of Virginia (1950) and Amendatory Tax .50 Plat 2.00 Acts of Assembly in effect as of the date of this declaration, but with the Paid $ 8.00 reservations and conditions hereinafter set out, it being the intention and purpose of the owners that said plat and the recitals and provisions in this appended statement, shall, together, constitute the plan of subdivision of the aggregate area of land of the undersigned owners laid out and shown on the aforesaid plat and being the land acquired by said owners as hereinafter set out. A. DESCRIPTION AND SOURCE OF TITLE The land included in this foregoing Subdivision is situated on the West side of State Route 810, North of the village of Crozet in the White Hall Magisterial District of Albemarle County, Virginia, and is composed of 47.67 acres, consisting of two (2) tracts, as follows: (1) 39.40 acres, being a part of "The Home Place" of about 140 acres which was devised to Laura S. Ballard for her life by the second paragraph of the last will and testament of J. M. Ballard, dated March 25, 1933, probat- ed'in the Clerk's Office of the Circuit Court of Albemarle County, Virginia, September 3, 1935, and spread in Will Book 35, page 445, and at her death to Homer Ballard in fee simple. The said Laura S. Ballard is now deceased and said Homer Ballard, who is the same person as W. Homer Ballard, is now the 1 fee simple owner of the said property. This land is shown on said plat as being located North of Northeast of the stream shown thereon. (2) 8.27 acres, being the rest and residue of a larger tract of 1 9.77 acres which was conveyed to said William Homer Ballard by deed of Chesley A. Haden and wife, dated February 17, 1941, recorded in said Clerk's Office in Deed Book 250, page 60, after deducting therefrom 11 acres sold by said owner to Annie M. Gentry by deed dated July 27, 1944, recorded in said Clerk's Office in Deed Book 260, page 363. This tract of land is that area lying South or Southwest of said stream and indicated "Future" on said plat. B. EXISTING BUILDING RESTRICTIONS AND EASEMENTS Prior to the approval and adoption of said plat and this Declara- tion, the land in question was not subject to any building restrictions. However, there do exist the following easements: 1. Easement granted the Virginia Electric and Power Company by • deed of W. Homer Ballard and wife, dated October 26, 1950, recorded in Deed • ■ Book 292, page 511, of said Clerk's Office, insofar as same may affect the tract of land described in (1). j i 2. Pipe line easement reserved to Nicie D. Haden in said deed to 1 W. Homer Ballard across the tract of land described in (2) above insofar as same may now be in use, and the 30 foot right of way to Route 810 as shown on Book:334,Page:192
