HomeMy WebLinkAboutSP201300009 Other 2013-03-19 (2) (Page 1 of 6) 33 08069 THIS DEED OF EASEMENT, made this 21st day of August, 1990, by and between GEORGE HARRISON GILLIAM, Trustee for the Mill Creek Industrial Land Trust under trust agreement dated January 1, 1907, Grantor, and the ALBEMARLE COUNTY SERVICE AUTHORITY, Grantee, whose address is: W I T N E S S E T H: That for and in consideration of $1.00 and other good and valuable consideration, receipt of all of which is hereby acknowledged, the Grantor hereby GRANTS and CONVEYS with GENERAL WARRANTY unto the Albemarle County Service Authority a perpetual," non-exclusive easement and right-of-way 20 feet in width for underground sewer and water lines under the Grantor's property in Albemarle County, Virgin •;,=as more particularly described on the attached plat, "Plat Showing Existing Sewer and Water Line Easements Being Dedicated to Albemarle Co. Service Authority, Mill Creek Industrial Park" made by Roger W. Ray & Associates, Inc. dated August 16, 1990. Said plat consists of sheet 1 of 2 and sheet 2 of 2. Reference is made to the attached plat and description for the exact location and dimensions of the easements hereby granted and the property over which the same pass. The water line easement shall be centered on the line shown on the attached plat. The Grantor, its successors or assigns, agree that new trees, shrubs, fences, buildings, overhangs or other improvements or obstructions shall not be placed within the easement conveyed herein. The Grantor, its successors or assigns, agree they shall not construct other utility lines within five (5) feet of the water A and sewer line installed hereunder. As a part of this easement the Grantee shall have the right to enter upon the above described property within the easement area for the purpose of installing, constructing, maintaining, repairing, extending and replacing the lines and appurtenances thereto, within such easement and the right of ingress and egress thereto as reasonably necessary to construct, install, maintain, repair, extend and replace such lines.
