THIS PARTITION DEED, made and entered into this 23rd day of
March, 2000, by and between James Richard Wakefield and Linda S.
Wakefield, husband and wife, parties of the first part, hereinafter
referred to as Grantors, and James Michael Wakefield and Beverly C.
Wakefield, husband and wife, parties of the second part, hereinafter
referred to as Grantees, whose address is 8135 Richmond Highway,
Gladstone, Virginia 24553
(EXEMPT FROM RECORDATION TAX: Section 58.1- 811(D) Virginia Code)
W I T N E S S E T H:
WHEREAS, the Grantors are the present owners, as tenants by
the entirety, of a parcel of land in Albemarle County, Virginia,
containing 93.60 acres, more or less, being the same property which
was conveyed to the Grantors herein by deed of Mary Stepp Wakefield,
et al., dated September 12, 1990, of record in the Clerk's Office of
the Circuit Court for said County in Deed Book 1133, page 614; and
WHEREAS, the Grantors desire to divide the 93.60 acres into
two unequal parts, with the first part labelled Parcel X, containing
7.9548 acres, as shown on a plat prepared by Roudabush, Gale and
Associates, dated March 15, 2000, of record as a part of this deed,
and the second part containing all the remainder of the 93.60 acres,
labelled on said plat as RESIDUE Parcel 29, containing 86.65 acres,
after the conveyance of the 7.9458 acres to the Grantees; and
WHEREAS, the parties hereto desire to effect a family
division of said property in accordance with Section 14 -208 of the
Subdivision Ordinance of said County so as to enable the Grantors to

convey said Parcel X to the Grantees, who are members of the Wakefield
family, being their son, James Michael Wakefield, and his wife,
Beverly C. Wakefield.
NOW, THEREFORE, in consideration of love and affection, the
Grantors do hereby GIVE, GRANT and CONVEY with GENERAL WARRANTY and
ENGLISH COVENANTS OF TITLE unto the Grantees, as tenants by the
entirety with full rights of survivorship as at common law, and not
as tenants in common, all that certain lot or parcel of land,
described as Parcel X on said plat, being a portion of the property
conveyed to the Grantors herein by aforesaid deed, of record in said
Clerk's Office in Deed Book 1133, page 614.
It is agreed by all parties that Parcel X shown on said plat
is subject to the provisions required by the Albemarle County
Subdivision ordinances, which require certain matters to be dealt with
by the Grantees, should Parcel X be transferred during the two years
following March 23, 2000.
As an appurtenance to Parcel X, and to the other land
bordering on the 30- -foot easement shown on said plat, the Grantors
convey unto the Grantees a non - exclusive right of way or easement for
access over the 30 -foot easement shown on said plat, leading out to
State Route 630. The right of way shall be maintained in its present
condition and width so as to allow for the reasonable and safe access
of standard passengers in all but severe weather. Snow removal shall
be deemed necessary maintenance as contemplated herein. Maintenance
and repairs shall include the roadbed, surface and drainage culverts
and ditches, not to be maintained by VDOT or by Albemarle County.

The parties hereto specify that the 30 -foot easement for

access shall be for the unexclusive use of Parcel X and Residue Parcel
29 and for other parcels that may be subdivided in the future.
This conveyance is made expressly subject to the easements,
conditions, restrictions, and reservations contained in duly recorded
deeds, plats and other instruments constituting constructive notice
in the chain of title to the property hereby conveyed, which have not
expired by a limitation of time contained therein or have not
otherwise become ineffective.
