The County of Albemarle Planning Division will recommend approval of the plat referenced above once the following
comments, and those provided by other Site Review Committee, SRC, members, have been satisfactorily addressed. The
following comments are those that have been identified at this time. Additional comments or conditions may be added or
eliminated based on further review. [Each comment is preceded by the applicable reference to the Albemarle County
Code.]
1. [14-302(B)(8), ZMA2019000101 Yards. Carry forward the side yard language from the approved rezoning wherein,
the side setback is: 5' feet, unless the building shares a common wall; provided that (a) in the R-10 and R-15
districts if the abutting lot is zoned residential other than R-10 and R-15, Rural Areas, or the Monticello Historic
district, any dwelling unit that exceeds 35 feet in height shall be set back five feet plus one foot for each foot the
dwelling unit exceeds 35 feet in height; and (b) any minimum side setback otherwise required by this section may
be reduced in accordance with section 4.11.3.
2. [14-303(N)] Open space. The plat is creating an open space improvement which will be owned by the HOA.
Provide the following note on the plat: Unless specifically denoted as public, the streets and other required
improvements in this subdivision are private in nature and will not be maintained by either the Virginia Department
of Transportation or any other public agency. The maintenance thereof is the mutual obligation of the affected lot
owners. Failure to maintain the improvements in substantially the same condition as originally approved by the
County may constitute a violation of County ordinance(s).
3. [Comment] Reminder that revised plats must include the original date of drawing and the revision dates) of each
subsequent version of the plat.

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced Proffit Road Townhomes North Final Plat, as
submitted by Roger Ray & Assoc. Inc., dated October 14, 2022 and find it to be generally
acceptable.
A VDOT Land Use Permit will be required prior to any work within the right of way. The
owner/developer must contact the Charlottesville Residency land Use Section at (434) 422-9399
for information pertaining to this process.
