BACKGROUND: The applicant will be constructing a new office building on Tax Map Parcel 055000000110 to
replace an existing office located on the adjacent parcel to the east of this site. The parcel is 1.76 acres with
one old uninhabited house, and is designated for Water Only to Existing Structures. The applicant is
requesting a Water Only designation to allow the new office to be served by public water. If the Water Only
designation is not granted, the new office building will be served by a private well. See the applicant's request
and supporting information provided in Attachment A. The parcel is located on the south side of Route 250
West in the White Hall Magisterial District, generally in the area between Western Albemarle High School and
the Yancey Lumber Yard/I-64 Interchange. This property, and the immediate surrounding area, is designated
Rural Area and is located south and west of the Crozet Development Area. This area contains old, or"stale"
commercial zoning which in many cases predates the comprehensive downzoning that occurred in 1980 to
implement the County's growth management policy, and in some cases predates the County's comprehensive
planning (pre-1971). This particular parcel is zoned HC, Highway Commercial. The proposed office is a by-
right use.
The Crozet Master Plan includes the following recommendation for the Rural Area fringe areas around the
Crozet Development Area: "that the Rural Areas outside of the Community of Crozet remain rural, including
the stretch of Route 250 West between the Development Area boundary and the interstate interchange." The
Master Plan provides the following Specific Recommendations for Route 250 West:
• Do not approve any rezoning for new development along the Route 250 West Corridor.
• Preserve the rural scenic character of Route 250 West.
• Develop corridor-specific design guidelines for Route 250 West in and near Crozet.
• Where special use permits or waivers to requirements are allowed, only approve uses which have the
least impact on the Rural Areas, environmental resources, and transportation systems.
There are two Jurisdictional Area Amendment requests that have been reviewed in this area. Water Only
service was requested and approved in 1987 to the Yancey Lumber Yard site after a fire occurred on the site.
The Water Only designation was granted by the Board to address fire response/safety issues at this site. In

2008, Water Only designation was requested to the then vacant parcel where Restore'n Station is now
located. The service designation at that time was Water Only to Existing Structure. The Board denied the
request for a Water Only designation to that parcel because there was no documented health or safety issue
associated with the request as outlined in the Comprehensive Plan's policy for extending public utility services
to Rural Area properties.
STRATEGIC PLAN: Goal 2 - Critical Infrastructure. Prioritize, plan and invest in critical infrastructure that
responds to past and future changes and improves the capacity to serve community needs.
DISCUSSION: The Community Facilities chapter of the Comprehensive Plan includes Strategy 9a regarding
the provision of public water and sewer service, which states: "Continue to provide public water and sewer in
jurisdictional areas." The explanatory text following Strategy 9a is provided below, and the specific criteria for
the provision of public water or sewer service to the designated Rural Areas is underlined.
"Water and sewer jurisdictional areas ensure the County's Growth Management Policy, Land Use Plan, and
Develop Area Master Plans are implemented by guiding the direction of public utility placement. The areas
also permit these services to be provided in a manner that can be supported by the utility's physical and
financial capabilities. The jurisdictional areas are those portions of the County that can be served by water or
sewer service, or both, and generally follow the Development Areas boundaries. Delineation and adoption of
utility project jurisdictional areas by a local governing body is provided for in Virginia Code §15.2-5111. The
boundaries of the Development Areas are to be followed in delineating jurisdictional areas. Change to these
boundaries outside of the Development Areas should only be allowed when: (1) the area to be included is
adjacent to existing lines; and (2) public health and/or safety is in danger."
Strategy 9a addresses the fact that public water and sewer systems are a potential catalyst for growth, and
that capacities need to be efficiently and effectively used and reserved to serve the Development Areas.
Continued connections of properties in the Rural Area should be the exception as the further extension of lines
into the Rural Area will strain limited water resources and capacity.
Water and sewer services by policy are intended to serve the designated Development Areas. There is no
documented health or safety issue identified on site that would be addressed by providing service to this site;
therefore, this request is not consistent with the County's policy for extending service.
As noted in the applicant's request and supporting information, the existing water line running along this
section of Route 250 is a non-looped, or"dead-end,"water line. This line periodically requires flushing
because of the low level of water use along this section of line. The flushing is to avoid water standing in the
dead-end line for long periods of time. The Albemarle County Service Authority has provided comments
regarding this condition (see Attachment D). ACSA has not indicated that this existing condition is a
health/safety issue.
BUDGET IMPACT: The approval of this request would have no budget impact to the County. The property
owner would bear the cost of the water connection.
RECOMMENDATION:
This request is not consistent with County Policy regarding the extension of Water and Sewer Service, and
staff recommends not setting a public hearing on this request.

Froehling & Robertson, Inc. (F&R) respectfully requests that you consider our application for "Water Only"
service for our new facility that will be located at 6183 Rockfish Gap Turnpike. F&R's current office at 6181
Rockfish Gap Turnpike (less than 100 feet from where we plan to construct our new facility) has been
connected to County water since 1994,and our consumption has consistently been around 10,000 gallons per
month. While our new office will be a bit larger than our current facility, we expect that our water usage will
remain within historic norms.
We recognize that some may argue that our request is outside the current guidelines regarding growth in this
portion of the Albemarle County Service Authority (ACSA) Jurisdictional Area, we feel that there are several
extenuating circumstances that would make granting access appropriate.
Public Health and Safety—In an effort to keep water from stagnating in the underutilized section of the line
that would service our new building, the ACSA periodically opens a fire hydrant and allows thousands of
gallons of water to escape. We would argue that by allowing F&R to connect to this line and draw out 10,000
gallons per month,it would eliminate—or at a minimum significantly reduce—the water quality problems that
the agency has heretofore been addressing by simply letting water run into the drainage system along
Rockfish Gap Turnpike.
Economic Benefit to the County—Allowing F&R to connect to the County water system will have both long-
term and short-term economic benefits for the County. In the short-term, F&R will pay roughly $20,000 in
connection and related fees. In the long-term, F&R will be paying for the 10,000 or so gallons of water that it
uses each month. Furthermore, by being connected to the system, it will eliminate the losses associated with
the periodic water releases regimen in terms of both the water wasted and the man-hours utilized to perform
these actions.
Environmental Benefits—As noted above, thousands of gallons of water are regularly being released from a
fire hydrant near the location of our new building. This action inevitably results in unnatural erosion of ditches
and creeks. If this water were instead provided to F&R, it would be recirculated through a modern septic
system,providing no disturbance to the surface.

Thank you for considering our request in this matter. We feel strongly that providing our company with
County water access would produce a net benefit not only for F&R but also for the County, its residents, and •
the local environment. -
Additionally, we believe that historic precedent has already been set for allowing Water Only connections to
the County water line based on the fact that our current office has access to County water and water lines •
already exist in the area in which we are going to build. As a result,we would argue that providing this service is
to our new facility would not run contrary to the general principles of the County's Comprehensive Plan which •;
seeks to discourage the extension of public water and sewer systems into Rural Areas.

Dear Board of Supervisors,
Froehling & Robertson, Inc. has operated in Albemarle County at 6181 Rockfish Gap Turnpike (T.M. 55-109A)
since 1972. Fortunately, the size of our operations have increased steadily over the past 40+ years, and as a
result we have outgrown our aged facility and are planning to construct a new office and lab on an adjacent
parcel (T.M. 55-110).
in order to use this new site and continue to grow our business, we would ask that the County approve our
request that public water service be supplied to our new property, T.M. 55-110 (application is attached). Please
note,this parcel contains an existing structure, but it does not currently have access to County water.
Our current property (T.M. 55-109A) has public water service. This service is provided by an 8" AC water line,
slated for replacement in the near future by the ACSA, that runs along the northern edge of Rt. 250 across from
both our old and new properties. Furthermore, our engineer has confirmed with the ACSA that the line has
sufficient capacity to suit our needs. The static pressure at the adjacent fire hydrant is 92 psi, so adequate
pressure is available and would only require a pressure reducing valve for any water service connection. As a
result, it would be a simple matter to extend water to the T.M. 55-110 parcel. It shall also be noted in
conversations with the ACSA, that currently there is limited demand on this water main (which ends at the end of
Hillsboro Lane), so increased demand on this dead end water main would be a benefit to the public water system.
Currently the subject parcel is 'Water Only to Existing Structures',so a 'Water Only'designation would be needed
to serve the proposed facility.
Personally, I am a Crozet resident, and over 60 percent of my staff also resides in Albemarle County. The
expansion that we are proposing will allow for the addition of up to 5 more professional staff. For all of the
reasons spelled out above, we respectfully request the Board of Supervisors to change the classification of T.M.
55-110 parcel from 'Water Only to Existing Structures' to 'Water Only' so that our new facility can be served by
public water.

I have reviewed your request for information and would like to provide the following responses:
• The information portrayed in this e-mail is for informational purposes only and shall not constitute a
recommendation of approval or denial.The ACSA holds no position on the ACSA Jurisdictional Area
Amendment Request presented by F&R and is presenting this information in response to a County request.
• At this time the water main is flushed periodically through manual means(flushing through a fire hydrant)and a
portable automatic flushing assembly.The flushing usually occurs during non-freezing months.A in-house
design is underway to replace a section of main at the end of Hillsboro Lane to accommodate a permanent
automatic flushing assembly.At that time the minimum daily flushing volumes will be determined.
• In general the water main along Hillsboro Lane lacks sufficient usage.There is a cluster of services around Free
Town Lane,but service taps from that section to the end of Hillsboro Lane are at a lower density for the length
of water main.
• Additional services beyond the services near Free Town Lane would slightly improve this situation.
• The proposed connection at F&R may have a small benefit to this situation.Additional demand placed on this
main would slightly reduce the volume of flushing required.
• It is noted that F&R would use on average 10,000 Gal/Month.The existing F&R building is on public water and
uses an average of 9,600 Gal/Month. It is unclear whether this would be an additional usage,or if it represents
the existing usage.
The ACSA will not have a representative at the May Board Meeting.

Would it be possible to at least get a written description of the of the current situation regarding this line. The
applicant's original request and subsequent justification letter(both attached makes reference to the limited demand on
this dead-end line and the Authority's"periodic release regimen." I typically attach the applicant's request to my staff
report to the Board of Supervisors. Since the Board will see these letters, I believe they will want to at least have some
