NOTICE TO COMPLY
Dear Mr. Short:
Under Section 17 -213, of the Albemarle County Code, this is your NOTICE TO COMPLY with the requirements of
the Erosion Control Permit for the referenced property and to immediately take corrective measures that address the
erosion and sediment control deficiencies on this property. The specific deficiencies and measures required to
correct those deficiencies are as follows:
1. Deficiency: Drop inlets throughout project do not have protection in accordance with the
Virginia Erosion and Sediment Control Handbook, Third Edition 1992 Section 3.07.

2. Deficiency: Structure D -5 is completely stopped up and backing up water.
Required Corrections: Clean and install drop inlet protection in accordance with the approved
erosion & sediment control plan and the Virginia Erosion and Sediment Control Handbook,
Third Edition 1992 Section 3.07.
3. Deficiency: Drop Inlet Station 32 +40 requires cleaning.
Required Corrections: : Clean and install drop inlet protection in accordance with the
approved erosion & sediment control plan and the Virginia Erosion and Sediment Control
Handbook, Third Edition 1992 Section 3.07.

4. Deficiency: Diversion north of project no longer exists
Required Corrections: Seed and straw mulch area in accordance with the approved erosion &
sediment control plan and the Virginia Erosion and Sediment Control Handbook, Third Edition
1992 Section 3.32 or Place silt fence in accordance with the approved erosion & sediment
control plan and the Virginia Erosion and Sediment Control Handbook, Third Edition 1992
Section 3.05 to protect the area.
Unless subsequently amended in writing by this office, it is expected all of these corrective measures will be
completed by no later than July 6, 2007.
Under Sections 17 -213, 214 and 215 of the Albemarle County Code, failure to make these corrections by the
required date can have the following results:
• Your permit may be revoked.
• You may be required to submit a new Erosion and Sediment Control Plan and have it approved before
additional land disturbance will be allowed. Review of a new plan can take up to 45 days for each submission
and it is not unusual for several submissions before the plan can be approved. This requirement would include
a new application, fee and bond for the work proposed under the plan.
• The County may issue a STOP WORK ORDER and seek relief in the Circuit Court. The Circuit Court can fine
the property owner up to $2,000 per violation, convict the property owner of a Class I misdemeanor and require
the property owner to pay any damages resulting from a failure to comply with this notice.
Should you have a legitimate reason you can not complete the corrective measures by the above given date, you
must immediately contact me at (434) 296 -5832. Unless you have contacted us and alternative arrangements have
been agreed to in writing, we will expect the corrections to be completed by the above date.
