NOTICE TO COMPLY
Dear Mr. Fitzpatrick:
Under Section 17 -213 of the Albemarle County Code, this is your NOTICE TO COMPLY with the requirements of
Erosion Control Permit for the referenced property and to immediately take corrective measures that address the
erosion and sediment control deficiencies on this property. The specific deficiencies and measures required to
correct those deficiencies are as follows:
1. Deficiency: This site does not meet the requirements of the approved erosion and sediment control plan.
Dust control measures are inadequate to "reduce the presence of airborne substances which may present
health hazards, traffic safety problems or harm animal or plant life."
Required Corrections:
Conform to Section 3.39 of the Virginia Erosion and Sediment Control Handbook Third Edition 1992.
Unless subsequently amended in writing by this office, it is expected all of these corrective measures will
begin immediately .
Under Sections 17 -213, 214 and 215 of the Albemarle County Code, failure to make these corrections by the
required date can have the following results:
• Your permit may be revoked.
• You may be required to submit a new Erosion and Sediment Control Plan and have it approved before
additional land disturbance will be allowed. Review of a new plan can take up to 45 days for each submission
and it is not unusual for several submissions before the plan can be approved. This requirement would include
a new application, fee and bond for the work proposed under the plan.
• The County may issue a STOP WORK ORDER and seek relief in the Circuit Court. The Circuit Court can fine
the property owner up to $2,000 per violation, convict the property owner of a Class I misdemeanor and require
the property owner to pay an damages r sulting from a failure to comply with this notice.

Should you have a legitimate reason you can not complete the corrective measures by the above given date, you
must immediately contact me at (804) 296 -5861. Unless you have contacted us and alternative arrangements have
been agreed to in writing, we will expect the corrections to be completed by the above date.

Dear Mr. Fitzpatrick:
Under Section 17 -213 of the Albemarle County Code, this is your NOTICE TO COMPLY with the
requirements of Erosion Control Permit for the referenced property and to immediately take corrective
measures that address the erosion and sediment control deficiencies on this property. The specific
deficiency and measures required to correct that deficiency are as follows:
Deficiency:
Slope on north east side of project behind (behind Harris Teeter up to Area C) has failed to
adequately stabilize.
Required Corrections:
As the property line is on the slope, it is expected that each owner will be responsible for his/her
own portion of the work. The department has worked with each property owner through multiple
growing seasons to obtain permanent vegetative cover on the project. To date this method has
not worked, we still do not have a vegetative cover, and the project is eroding. Therefore, the
department must take action to obtain vegetation. This shall be done by applying sod and
following the Virginia Erosion and Sediment Control Handbook, Third Edition 1992,
specifications for soil preparation, quality of sod, and sod installation (see attachment).
HTC A will sod between the property line and the bottom of the diversion at the top of the slope
and be responsible for any maintenance or watering of the sod. Area B or Regency Centers will
be responsible from the property line down to the toe of slope.
This will require the coordination of both parties as this work is being required to be done
simultaneously. Therefore, a date that this work will begin will be coordinated and submitted to
the County no later than August 24, 2007. The work shall be completed no later than
September 7, 2007.

Dear Mr. Williams:
Under Section 17 -213 of the Albemarle County Code, this is your NOTICE TO COMPLY with the
requirements of Erosion Control Permit for the referenced property and to immediately take corrective
measures that address the erosion and sediment control deficiencies on this property. The specific
deficiency and measures required to correct that deficiency are as follows:
Deficiency:
Slope in front of school needs permanent stabilization and silt fence repair.
Required Corrections:
Repair silt fence, clean up sediment on sidewalk, and seed and straw mulch in accordance with
the approved Erosion and Sediment control plan and sections: 3.05 and 3.32 of the Virginia
Erosion and Sediment Control Handbook, Third Edition dated 1992
The work shall be completed no later than August 27, 2007.
