NOTICE TO COMPLY
Dear Mr. Wood:
Under Section 17 -213, of the Albemarle County Code, this is your NOTICE TO COMPLY with the requirements of
the Erosion Control Permit for the referenced property and to immediately take corrective measures that address the
erosion and sediment control deficiencies on this property. The specific deficiencies and measures required to
correct those deficiencies are as follows:
1. Deficiency: Silt fence is down on the south side of project and ditch line is eroded.
Required Corrections: Replace ditch line and repair silt fence in front of Powell Creek. Place
sandbags at drop inlet to get water into drop inlet and ultimately the sediment basin 3.
2. Deficiency: Slope on US 29 does not have silt fence in place.
Required Corrections: Install and maintain silt fence in accordance with 3.05 of the VESCH,
Third edition. 1992.
3. Deficiency: Slopes on Westside of SB -3, and stockpile areas are steeper than 2:1.
Required Corrections: Ensure all slopes throughout project meet 2:1 requirement in
accordance with Albemarle County Code.
4. Deficiency: Slope on US 29 SBL is disturbed with no silt fence in place.
Required Corrections: Place and maintain silt fence along toe of slope on US 29 SBL in
accordance with 3.05 of the VESCH, Third edition. 1992.
5, Deficiency: Areas throughout project have rills and gullies from recent rains; permanent
vegetation has not been established on west side of project.
Required Corrections: Repair rills, gullies, apply four inches of topsoil, lime, fertilizer, seed,
and straw mulch to areas that do not have permanent vegetation in accordance with 17- 207(2).

6. Deficiency: Outfall for SB -3 needs repair.
Required Corrections: Repair in accordance with the approved erosion and sediment control
plan dated 12- 31 -08.
7. Deficiency: Safety fence is in need of repair around SB -3,
Required Corrections: Repair safety fence around SB -3 in accordance with 3.01 of the
VESCH third edition dated 1992.
8. Deficiency: Silt fence has been covered west of SB -3.
Required Corrections: Install silt fence in area west of SB -3in accordance with 3,05 of the
VESCH third edition dated 1992.
9. Deficiency: Sediment Basin catching stockpile needs cleanout.
Required Corrections: Clean Sediment Basin in accordance with 3.14 of the VESCH third
edition dated 1992,

'Permanent vegetation shall be installed on all denuded areas within nine (9) months after the date the land disturbing activity commenced
except for areas that the program authority finds are necessary parts of the construction that are subject to an active building permit and areas
where erosion is prevented by a non- erosive surface. For the purposes of this section, a "non- erosive swfacc " includes, but is not limited to,
roadways and sidewalks covered by gravel, asphalt pavement, or concrete; trails or paths covered by gravel, stone dust, or nutich; buildings and
other permanent structures; and such other surfaces that the program authority determines would adequately provide a permanent barrier to
erosion."
Unless subsequently amended in writing by this office, it is expected all of these corrective measures will be
completed by no later than April 15, 2011.
Under Sections 17 -213, 214 and 215 of the Albemarle County' Code, failure to make these corrections by the
required date can have the following results:
• Your permit may be revoked,
• You may be required to submit a new Erosion and Sediment Control Plan and have it approved before
additional land disturbance will be allowed, Review of a new plan can take up to 45 days for each submission
and it is not unusual for several submissions before the plan can be approved. This requirement would include
a new application, fee and bond for the work proposed under the plan.
• The County may issue a STOP WORK ORDER and seek relief in the Circuit Court, The Circuit Court can fine
the property owner up to $2,000 per violation, convict the property owner of a Class 1 misdemeanor and require
the property owner to pay any damages resulting from a failure to comply with this notice. Should you have a
legitimate reason you can not complete the corrective measures by the above given date, you must immediately'
contact me at (434) 296 -5832. Unless you have contacted us and alternative arrangements have been agreed to
in writing, we will expect the corrections to be completed by the above date.

2. Deficiency: Silt fence is in need of maintenance at bottom of slope at entrance to Target right
of centerline.
Required Corrections: Repair and replace silt fence as necessary in accordance with 3.05 of
the VESCH,Third edition dated 1992.

3. Deficiency: Diversion dike at top of same slope as item 2 has been breached. .
Required Corrections: Repair diversion and seed and straw mulch in accordance with 3.12 of
the VESCH,Third edition dated 1992.
4, Deficiency: Areas throughout project have rills and gullies from recent rains; permanent
vegetation has not been established on various areas throughout project.
Required Corrections: Repair reels, gullies, apply four inches of topsoil, lime, fertilizer, seed,
and straw mulch to areas that do not have permanent vegetation in accordance withl7- 207(2)
Albemarle County Code.

5. Deficiency: Sediment trap behind soil stockpile is draining slowly and requires maintenance.
Required Corrections: Clean out and maintain sediment trap in accordance with 3.13 of the
VESCH,Third edition dated 1992..
