Dear Mr.Morlando:
An erosion and sediment control inspection was made on the above note site on June 27, 2013,with the
County Engineer,Glenn Brooks. Mr.Brooks stated to me that the existing erosion and sediment control plan
is inaccurate and does not adequately address erosion control measures or the runoff control requirements of
your stormwater permit,due in part to unforeseen site conditions. Therefore,the Department under Section 17-
213 of the Albemarle County Code,must issue this NOTICE TO COMPLY with the requirements of your
Erosion Control Permit for the referenced project and to immediately take corrective measures that address the
erosion and sediment control deficiencies on the property. The specific deficiencies and measures required to
correct those issues are as follows:
1. Deficiency: Site construction has not taken place in a manner that will allow the existing
approved erosion control plan to be adequate.
Required Corrections: Submit a revised erosion and sediment control plan.The Department also
would like an on-site meeting with you,your engineer and Mr.Jonathan Burnham to address
existing site condition until a new plan can be approved. We would like for this meeting to take
place between July 8-11,2013.

Notice to Comply
Dear Mr.Nelson:
Under Section 17-213 of the Albemarle County Code,this is your NOTICE TO COMPLY with the
requirements of your Erosion Control Permit for the referenced project and to immediately take corrective
measures that address the erosion and sediment control deficiencies on the property. The specific deficiencies
and measures required to correct those deficiencies are as follows:
1. Deficiency: Mud is being tracked onto the roadway at People's Place and Richmond Road.
Required Corrections: Remove soil material from street and curb line. Install two(2)
construction entrance's,one on Richmond Road and one on People's Place as shown on the
approved plan.
2. Deficiency: Diversion dike or drainage swale not installed to prevent sediment-laden runoff from
washing out into the roadway at People's Place.
Required Corrections: Install diversion dike or drainage swale to channel sediment-laden runoff
into the sediment basin.
3. Deficiency: Silt fence has been destroyed by pipe material and equipment. Silt material can not be
allowed to wash onto the sidewalk and roadway on Richmond Road are People's Place..
Required Corrections: Install new silt fence and install silt fence not shown on the plan sheet in
areas that have been disturbed and left unprotected, like the water connection and soil stock pile at
Richmond Road entrance.
4. Deficiency: Sediment material from this project has entered the drainage structures on People's
Place.
Required Corrections: Clean material from the drainage structures.
The above noted corrections and/or repairs must be completed on or before the end of the workday

1. Deficiency,: Sediment basin not installed as shown on the approved plans.
Required Corrections: Install sediment basin as shown on the approved plans and make all
connections watertight.
2. Deficiency: Drainage inlet at toe of large fill area is unprotected.
Required Corrections: Install inlet protection on a wood frame around the structure.As I stated
at our on-site meeting if this type of protection fails,you will be required to install a riser section
on this structure.
3. Deficiency: Diversion dikes not installed.
Required Corrections: Install diversion dikes as shown on the approved plans to channel
sediment-laden runoff into the sediment basin.
4. Deficiency: Safety fence and signage stating"Danger Do Not Enter"not installed around
sediment basin.
Required Corrections: Install safety fence and signage.
5. Deficiency: Sediment material from this project has entered the drainage structures on People's
Place.
Required Corrections: Clean material from the drainage structures.
As I stated during our on-site meeting if major changes are required to the existing plan, a new plan will need
to be submitted, reviewed, and approved.
