County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to act on any
VSMP permit by issuing a project approval or denial. This project is disapproved for reasons listed below.
The VSMP application content requirements can be found in County Code section 17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain
(1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
1. Submit SWPPP (please use county template)
a. Ensure (VAR10) CGP Registration Statement is complete. Include ref. to WPO2022-0013 in
SWPPP title. (Rev. 1, D Partially addressed. As follow-up:
i. Revise Sec. 1 of SWPPP (VAR10 Permit Registration):
1. Sec. I.A. to list primary and cc email (required). (Rev. 2) Addressed.
2. Sec. I.B.: check `yes' or `no' (whether permissible (for DEQ) to transmit
correspondence electronically to Julie Anderson). Recommend check `yes.'
(Rev. 2) Not addressed.
3. Sec. II.C.: Revise consistent with plan, which indicates 1.75 Area of land
disturbance. (Rev. 2) Addressed.
4. Sec. II.P.: List Albemarle, since located in Al (Rev. 2) Addressed.

ii. Sec. 3/Nature of Activity: Recommend Incl. ref. to Phase 1, 1.75 ac. Area of disturbance,
to avoid misunderstanding Aimit confusion. (Rev. 2) Not addressed. As follow-up,
please delete 26-pages, pp. 10-35 of SWPPP. Instead, use this link to retrieve 2019
VAR10 permit, and include /position 2019 VAR10 at Sec. 11 (CGP copy) of SWPPP. At
Sec. 3 of SWPPP, provide brief project description (Nature of Activity).
iii. Sec. 4/5 (ESC/SWM plans): Update, once review comments addressed. (Rev. 1, P

iv. Sec. 6.A./PPP Exhibit:
1. Phase I (of ESC): Relocate vehicle wash station coincident with PCE. There is
considerable distance between proposed vehicle wash station and PCE. (Rev. 2)

C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP. Thi;
plan is disapproved for relatively few reasons: Items 3.b.. 9 (New Rev. 2), items I.e. Item-4-b-
Plan..:.... Division eamiffient. Engi eeFi g defeFS W Planning. The stormwater
management plan content requirements can be found in County Code section 17403.
1. General
a. Revise title page of plan, Calc. packet to include ref. to WPO202200013. (Rev. 1) Addressed.
b. Revise title of plan, SWPPP, and Cale. packet to eliminate reference to WPO Master Plan, a term
without basis in state code. Please revise titles of plan, SWPPP and Cale. packet to read Duch
Premier Circle — WPO202200013, Phase 1. May include optional subtitle: `Conceptual design for
(Future) phase 2 and 3'. (Rev. 1) Addressed.
c. Retaining wall ht. >3' requires a building permit, retaining wall ht.>4-ft. requires sealed, detailed
retaining wall plans. Furnish retaining wall plans for WPO plan approval. Engineering reviews
retaining wall design from spatial rather than building code perspective. (Rev. 1) Persists.
Applicant response (letter dated 6/21/22): `Acknowledged. This will be coordinated for future

This is being coordinated with a structural engineer and will be submitted once completed.'
2. C2.2 identifies `SWM Facility to be abandoned.'
a. Please revise calculation packet narrative to clarify that existing stormwater pre -development
HydroCAD routings include the existing SWM facility, that this pre -development (entire) site
discharge reflects attenuating effect of existing on -site SWM facility. Please clarify existing
SWM dry detention basin role in context of pre -development stormwater runoff, as narrative text.
This pre -developed condition establishes baseline for all phases, both Phase 1 and future phase 2
and phase 3. Also, email, county to Applicant, May 4, 2022 5:52 PM. (Rev. 1) Addressed.
Applicant: `The existing detention pond is included in the pre -developed routing calculations. The
narrative has been revised to reflect this.'
b. Engineering recommends table for this phase 1 WPO plan to allow this /future WPO plan review
to track existing pre -development land cover across phased WPO plans. For example: (Rev. 1)
Addressed. Applicant: `The land cover table for the pre and post condition of Phase 1 is included
on sheet C6.0 under water quality and also in the routing calculations in the Calculations Book.
Since this is the only phase being permitted under this WPO the preference is to leave off the
estimate of future phases at this point. Those are subject to change and will be shown on the future
WPO plans for each phase. The current pre land cover condition will be used for each of those
phases.' Engineering accepts that the current pre -development land cover condition will be used
for each of those (future) phases, and is consistent with DEQ guidance (2022, Erin Belt).
i. Table columns for pre- /post -developed condition for each phase, and for entire site.
ii. Table rows for land cover type/s (impervious, turf, forest) — Values reported in acres.
c. Provide deed bk.-pg, reference for the existing SWM facility. If unknown, provide ref. to
SDP198600037 as plan label. (Rev. 1) Addressed.
d. Since existing SWM facility must remain operational for Premier Circle Phase 1 SWM
compliance: (Rev. 1) Withdrawn. Applicant: `The survey provided captures the existing
condition of the stormwater facility. The facility has been routed in the predeveloped condition
and calculations.' C0.0 source of survey, boundary, and topography: Timmons Group, Joseph C.
Medley, L.S., conducted 01/29/2021. As follow-up: Routing facility based on existing topography
(and Ex. SWM facility control structure dimensions /elevations) is sufficient to support compliant
design. No modification to the Ex. SWM facility is proposed with Premier Circle VSH Building
(Phase 1) WPO plan.
i. Provide As -built drawing of dry detention basin (Knights Inn (Red Carpet Inn) —
SDP198600037). County SWM facility ID, 22O1. Link to site plan.
[ Note: though county inspects facility, Albemarle cannot famish As -built required with
WPO plan submittal. ]

C4.1: Label area NW of phase 1 as turf. List turf acreage once existing impervious buildings /parking are
demolished. (Rev. 1) Addressed. Applicant: `The land cover table for the pre and post condition of Phase 1 is
included on sheet C6.0 under water quality and also in the routing calculations in the Calculations Book.'
3. C5.0
a. Label phases: 1,2,3. (Rev. 1) Addressed.
b. This /other sheets: Please incorporate 15 Apr 2022 SDP202200019 Engineering review comments
into WPO202200013 plan /calc. packet revisions. (Rev. 2) Persists. As ollow-up: Items discussed
20-Dec 2022 during video meeting may require linework revisions to WPO plan.
i. For example: Engineering will likely not approve 18" DIA HDPE pipe as adequate
replacement for existing 2 1 " DIA RCP as this restricts capacity of conveyance, when
compared with existing conveyance, unless LD-229 compares existing 2 1 " RCP with
proposed 18" HDPE with upstream UG detention. LD-229 may clarify that 18" HDPE
has capacity to convey the post -developed Phase 1 flow adequately to ex. SWM facility,
and should also indicate that 18" DIA HDPE has adequate capacity to convey post -
developed Phase 1,2,3 runoff to existing storm conveyance network once ex. SWM
facility is removed, and UG detention is installed in Phase 2. Lack of capacity may cause
flooding of Premier Circle or U.S. Rt. 29 SBL. (Rev. 1) NA. Comment applies to future
Phase 2 if Phase 2 proposes 2 1 " storm pipe upstream of existing 18" DIA RCP beneath
Premier Circle. Phase 2 design may need to consider this comment, now deferred.
c. Provide TW BW elevation labels, for retaining wall at SW edge of parcel. (Rev. 1) Partially
addressed. As follow-up: Three (3) BW retaining wall elevations provided on sheet C5.0. Please
provide corresponding TW elevations. (Rev. 2) Addressed.
4. C5.1
a. Label inlet structures 114, 116, 118, (Rev. 1) Addressed.
b. Revise CG-2 to CG-6 wherever grade concentrates runoff against curbing. (Rev. 1) Partially
addressed. Engineering discussed need for CG-6 with Applicant, who expressed reservation
concerning CG-6 in locations adjacent to Phase 2. Engineering recommends CG-6 wherever
grade concentrates runoff against curbing, and defers to Planning since requirement is listed at 18-
4.12.15.g. Requirement has been discussed with Planning Site Plan Coordinator. (Rev. 2)

ii. Transfer land cover values from calc. packet pp. 42, 43 to plan, to tables, preferably,
recommended at item 2.b., above. (Rev. 1) NA. Applicant: `Since plan and calculations
have been revised to just be for Phase 1, this is no longer needed.'
f Calc. packet. p. 3 /Narrative
i. Edit to isolate Phase 1 independent of later phases. WPO202200013 provides discrete
design for Phase 1, but only conceptual design for later phases. (Rev. 1) Addressed.
Applicant: `Plan has been revised to now just be a WPO for Phase 1. Future phases are
referenced. Based on conversations with the County a Master Plan is not needed. The
current existing conditions land cover will be used as the pre -condition for each future
phase of development.'
ii. Delete reference to Master Plan as WPO202200013 is not being evaluated for overall
(Phase 1,2,3) site compliance, given development is projected to occur under different
owners at different points in time, as independent phases but with dependent SWM
design. Possible subdivision, discrete bonding /easement requirements that cannot be
assigned with accuracy to unknown future (or multiple) owners work against a single
WPO that covers all 3 phases. WPO202200013 is a VSMP /WPO plan that provides
overall (entire site) SWM strategy -concept, and that provides detail sufficient to approve
plan and grading for phase 1, only. Future phases will require separate WPO submittals
that will reference pre -developed condition first reported with WPO202200013, land
cover conditions that exist on this date, 5/5/22. (Rev. 1) Addressed. Applicant:
`Acknowledged. Plan has been revised to now just be a WPO for Phase 1. Future phases
are referenced. Based on conversations with the County a Master Plan is not needed.
The current existing conditions land cover will be used as the pre -condition for each
future phase of development.'
8. New:
a. Revise C0.0 reference to 3.25 Ac. Limits of disturbance, consistent with 1.75 Ac. ref, elsewhere.
(Rev. 2) Addressed.
9. New (Rev. 2): A SWM Facility Maintenance Agreement and Easement for existing SWM is required. Ref.
Engineering email sent December 22, 2022 12:52 PM, TG response, December 22, 2022 2:37 PM, partial
text: `I have looped in Joe in our survey group so we can update the plat on the next submission to show an
easement.' (Easement may be recorded with Premier Circle subdivision plat, SHB2022001961. Timmons'
response indicates it will coordinate a Maintenance Agreement for existing SWM facility with Albemarle.
D. Erosion and Sediment Control Plan (ESCP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan
is approved.
1. C3.3: Farthest area upslope of silt fence (SF), NW section of LOD, contour interval 485-480, appears
to lie >100' upslope of SF. Revise to provide temporary diversion leading to sediment trap, or other
VESCH measure/s, since SF alone appears to provide inadequate perimeter control. The maximum
slope length behind the barrier (SF) is 100' —please see VESCH Std. & Spec. 3.05, Silt Fence. (Rev. 1)
Addressed. Applicant: `Acknowledged. A swale has been added along the uphill side of the existing
parking lot to remain to direct water to a protected inlet.'

a. PLEASE coordinate with the County reviewer before working with a nutrient bank. The reviewer
must confirm if your project must follow the DEQ hierarchy requirements.
b. Letter of availability must be provided on the WPO approved plans.
c. Applicant must contact/coordinate nutrient credit purchase with Ana Kilmer,
akilmergalbemarle. org
d. Affidavit of Purchase must be provided to Ana Kilmer before a grading permit can be issued.
2. Post WPO Bond
a. Applicant must submit a `Request to Establish a Bond' forn and fee to CDD.
i. Complete the form and email it to akilmer(a),albemarle.org, along with proof of payment
(see below).
b. Payment can be made either online or with a check.
i. If paying online:
1. Go to the online payment portal.
a. Select WPONSMP as the application `type.'
b. Type in the WPO number and project name in the Notes/Details section of the
form.
C. Type in the `payment amount' as S294.34.
d. Click "Proceed to Secure Checkout" link to make payment.
2. You will receive a receipt in an email.
ii. Email a copy of the receipt to akilmerkalbemarle.org.
c. Once the bond request and payment are received, the applicant can provide the bond estimate
(completed on the County worksheet), or Engineering staff will complete the estimate. Once the
estimate is approved, Ana Kilmer will contact and work with the applicant to post the bond.
Obtain DEQ Permit (if required)
After nutrient credits have been purchased and the bond has been posted:
a. County staff will register the project with DEQ.
b. Applicantloperator listed on the Registration Statement will receive an email with instructions on
how to pay the DEQ permit fee.
c. Applicant must email a copy of the DEQ receipt of payment to charris6dnalbemarle.org.
d. DEQ typically will issue a permit within 2 weeks of receiving payment.
4. Request pre -construction meeting:
a. Complete and email the Request for a Preconstruction Meeting and Grading Permit
to charris(a,)albemarle.org.
b. Pay the fee via the online payment portal or a check at the pre -construction meeting. If paid
online, email a copy of the receipt to charrisAalbemarle.org.
All steps must be completed before the grading permit can be issued.
