the Albemarle County Zoning Ordinance. I understand that plans which lack information required by said sections shall be deemed
incomplete and shall be denied by the agent within ten(10)days of submittal as provided in Section 32.4.2.1 or Section 32.4.3.3 as the
case may be.

Re: SDP 98-141 Rio @ Greenbriar Convenience Center Preliminary Plan
Dear Mr.Nelson:
The Planning Commission unanimously approved the above referenced site plan at its December
01, 1998 meeting. The Planning Commission also granted unanimous approval to the critical
slope waiver request associated with this proposal.
The approval of the preliminary site plan is valid for one year in accordance with Zoning
Ordinance Section 32.4.3.1. Therefore,the preliminary approval shall expire December 02,
1999. If the preliminary site plan approval expires, a new application must be filed and
processed.
Please address all of the requirements and conditions listed below and submit six(6)tentative plan
copies to the Department of Planning and Community development. This letter must be submitted with
the tentative plans, as a checklist,to document that you have addressed all requirements or conditions. If
you fail to address any of these requirements or conditions, the tentative plan will be denied. A
submission and review schedule is attached for your information.
The Erosion and Sediment Control Plan and the BMP Stormwater Management Plan, with the associated
applications and fees, may also be submitted with the six(6)tentative Plans. Failure to do so will result
in a separate application to be filed with the Engineering Department at a later date.
After the initial tentative plan submittal, each department/agency will contact you to discuss any
remaining conditions. After all aforementioned departments/agencies have granted a tentative
approval,you may submit the final mylars(2 sets), one blueprint copy, final site plan
application, final site plan fee, and a copy of all written tentative approvals to the Department of
Planning and Community Development by 5:00pm on any Monday. Assuming that the final site
plan mylars reflect all tentative approvals, signing of the plans will occur four days later
(Thursdays).
The final site plan will be subject to all final site plan requirements(Zoning Ordinance Section
32.6), in addition to the following conditions:

1. The Planning Department shall not accept submittal of the final site plan for signature
until tentative approvals for the following conditions have been obtained. The final site
plan shall not be signed until the following conditions are met:
❑ A. Planning Department approval to include:
❑ 1. Landscape plan.
❑ B. Engineering Department approval to include:
❑ 1. Provision of the location of the existing mailbox adjacent to Rio Road
East and a notation indicating its relocation;
❑ 2. The plan shall be signed, sealed, and dated by an architect, professional
engineer, land surveyor with 3(b) license, or landscape architect licensed
to practice in the Commonwealth of Virginia;
❑ 3. Engineering approval of grading plans and drainage computations;
❑ 4. VDOT approval of plans. Per VDOT, drainage computations are
required for review;
❑ 5. Engineering approval of an Erosion and Sediment Control Plan; and,
❑ 6. Engineering approval of a stormwater BMP plan, in accord with the
"Water Protection Ordinance". The Engineering Department can be
contacted at 296-5861 for information concerning the implementation of
the new ordinance.
❑ C. Albemarle County Building Codes and Zoning Services approval to include:
(Note: Due to their proximity to the property line at the south side of the site,
portions of the south and west building walls must be of fire-rated construction.)
❑ 1. Revision of required parking. Food stores require 1 parking space per 200
square feet of gross floor area. In Section 3.1, gross floor area is defined in part
as being measured from the interior faces of exterior walls. Required parking
must be determined on this basis. On the latest revision,the required parking is
correctly based on 1 space per 200 square feet. However, it appears that the
square footage was based on the exterior wall dimensions. The required parking
may be further revised if this is the case. [Contact John Shepherd for
clarification];
❑ 2. A description and photograph or diagram and show the location of each type of
outdoor luminaire that emits 3,000 or more initial lumens. Please be aware that
the installation of such luminaires in the future which are not shown on this plan
shall require an amendment to this plan; and,
❑ 3. A photometric plan with this site plan, demonstrating that the parking area
luminaires are in compliance with Section 4.17.4b of the Zoning
Ordinance.
❑ D. Virginia Department of Environmental Health approval to include:
1. Any food preparation facilities must have plans approved by Health Department
food staff.

❑ E. Albemarle County Service Authority approval to include:
❑ 1. Show the location of the existing 18 inch water main;
❑ 2. Provide plumbing fixture information so we can verify that the existing meter is
sufficient to handle the demand for the new building; and,
❑ 3. Relocate the existing meter such that it falls within the new island.
❑ F. Fire and Rescue Division approval to include:
1. Verification that adequate fire flow is available. Required fire flow is 1,450 gpm
@ 20 psi. based on 2,450 square foot building of Type 5 construction. Fire flow
verification is awaiting the City Public Works Department to run the flow test.
