Yes, I discussed this with Graham, and DEQ does not object to stockpiling the soil /cinder fill on the 51h street station site - as
long as the County approves - the County would have the over - riding authority for the stockpiling of fill material on this site.

To follow up our phone conversation of last Friday afternoon, I have left a voice mail message with Ray Lilly, E &SC inspector for
Albemarle County concerning the temporary stockpiling of soil - cinder materials on the 51h Street Station site. Our intent is to
stage the materials there until the Corrective Measures Work Plan that we submitted on Feb. 6 is approved. Once approved,
the County will issue the grading permit for placing the material on the closed landfill surface at the two locations shown in the
Work Plan. At that time, the stockpiled materials will be transported to the Avon landfill. We hope to have stockpile approval
by the end of the day tomorrow. if by chance, the Work Plan can be approved by the end of this week, it may not be necessary
to temporarily stockpile the material. However, we still want to have the stockpile option, if the City Walk grading contractor
wants to start excavating the soil- cinder area this week. We plan to stockpile the material along the east and northeast sides
Of the abandoned Grand Piano building shown on the attached photos.

CONSTRUCTION NOTES FOR
EROSION AND SEDIMENT CONTROL PLANS
1. THE PLAN APPROVING AUTHORITY MUST BE NOTIFIED ONE WEEK PRIOR TO
THE PRE - CONSTRUCTION CONFERENCE, ONE WEEK PRIOR TO THE
COMMENCEMENT OF LAND DISTURBING ACTIVITY, AND ONE WEEK PRIOR TO
THE FINAL INSPECTION.
2. ALL EROSION AND SEDIMENT CONTROL MEASURES WILL BE CONSTRUCTED
AND MAINTAINED ACCORDING TO MINIMUM STANDARDS AND SPECIFICATIONS
OF THE VIRGINIA EROSION AND SEDIMENT CONTROL HANDBOOK AND VIRGINIA
REGULATIONS VR 625 -02 -00 EROSION AND SEDIMENT CONTROL
REGULATIONS.
3. ALL EROSION AND SEDIMENT CONTROL MEASURES ARE TO BE PLACED PRIOR
TO OR AS THE FIRST STEP IN CLEARING.
4. A COPY OF THE APPROVED EROSION AND SEDIMENT CONTROL PLAN SHALL
BE MAINTAINED ON THE SITE AT ALL TIMES.
5. PRIOR TO COMMENCING LAND DISTURBING ACTIVITIES IN AREAS OTHER THAN
INDICATED ON THESE PLANS (INCLUDING, BUT NOT LIMITED TO, OFF -SITE
BORROW OR WASTE AREAS), THE CONTRACTOR SHALL SUBMIT A
SUPPLEMENTARY EROSION CONTROL PLAN TO THE OWNER FOR REVIEW AND
APPROVAL BY THE PLAN APPROVING AUTHORITY.
6. THE CONTRACTOR IS RESPONSIBLE FOR INSTALLATION OF ANY ADDITIONAL
EROSION CONTROL MEASURES NECESSARY TO PREVENT EROSION AND

7. ALL DISTURBED AREAS ARE TO DRAIN TO APPROVED SEDIMENT CONTROL

8. DURING DEWATERING OPERATIONS, WATER WILL BE PUMPED INTO AN

18. PERMANENT STABILIZATION SHALL BE LIME AND FERTILIZER, PERMANENT
SEEDING, AND MULCH, AGRICULTURAL GRADE LIMESTONE SHALL BE APPLIED
AT 90LBS /1000SF, INCORPORATED INTO THE TOP 4 -6 INCHES OF SOIL.
FERTILIZER SHALL BE APPLIED AT 1000LBS /ACRE AND CONSIST OF A
10 -20 -10 NUTRIENT MIX. PERMANENT SEEDING SHALL BE APPLIED AT
18OLBS /ACRE AND CONSIST OF 95% KENTUCKY 31 OR TALL FESCUE AND
0 -5% PERENNIAL RYEGRASS OR KENTUCKY BLUEGRASS. STRAW MULCH IS
TO BE APPLIED AT 80LBS /1OOSF. ALTERNATIVES ARE SUBJECT TO

19. MAINTENANCE: ALL MEASURES ARE TO BE INSPECTED WEEKLY AND AFTER
EACH RAINFALL. ANY DAMAGE OR CLOGGING TO STRUCTURAL MEASURES IS
TO BE REPAIR IMMEDIATELY. SILT TRAPS ARE TO BE CLEANED WHEN 50% OF
THE WET STORAGE VOLUME IS FILLED WiTH SEDIMENT. ALL SEEDED AREAS
ARE TO BE RESEEDED WHEN NECESSARY TO ACHIEVE A GOOD STAND OF
GRASS. SILT FENCE AND DIVERSION DYKES WHICH ARE COLLECTING

20. ALL TEMPORARY EROSION AND SEDIMENT CONTROL MEASURES ARE TO BE
REMOVED WITHIN 30 DAYS OF FINAL SITE STABILIZATION, WHEN MEASURES
ARE NO LONGER NEEDED, SUBJECT TO APPROVAL BY THE COUNTY EROSION
CONTROL INSPECTOR.
21. THIS PLAN SHALL BE VOID IF THE OWNER DOES NOT OBTAIN A PERMIT
WITHIN 1 YEAR OF THE DATE OF APPROVAL. (WATER PROTECTION

ADDITIONAL EROSION CONTROL NOTES
I
1. RETAIN A COPY OF THE APPROVED EROSION AND SEDIMENT CONTROL
PLAN AND THE VIRGINIA EROSION AND SEDIMENT CONTROL
HANDBOOK, 3RD EDITION ON SITE AT ALL TIMES.
2. ADHERE TO THE INSTALLATION AND MAINTENANCE STANDARDS LISTED
IN THE VIRGINIA EROSION AND SEDIMENT CONTROL HANDBOOK, 3RD
EDITION FOR ALL PRACTICES.
3. LAND DISTURBANCE IS 0.9 ACRES. IF LAND DISTURBANCE BECOMES
LARGER THAN 1.0 ACRES, A VSMP PERMIT, INCLUDING A STORMWATER
POLLUTION PREVENTION PLAN, WILL BE REQUIRED.
4. MAKE IMPROVEMENTS TO EXISTING CONSTRUCTION ENTRANCE AS
NEEDED TO MEET REQUIREMENTS OF DETAIL. CONSTRUCTION
ENTRANCE MUST HAVE WASH DOWN WATER PROVIDED BY
CONTRACTOR'S WATER TANK OR TRUCK. ALL WASH DOWN WATER
SHALL DRAIN TO SILT FENCE AS SHOWN.
5. TEMPORARY SOIL STABILIZATION SHALL BE APPLIED WITHIN SEVEN
DAYS TO DENUDED AREAS THAT MAY NOT BE AT FINAL GRADE BUT
WILL REMAIN DORMANT FOR LONGER THAN 14 DAYS. REFER TO THE
ALBEMARLE COUNTY GENERAL NOTES (ABOVE) FOR SEEDING TYPES
AND RATES.
EROSION & SEDIMENT CONTROL NARRATIVE
A. PROJECT DESCRIPTION
THE 5TH STREET STATION SITE MAY BE USED FOR THE TEMPORARY STOCKPILING OF CINDER -SOILS
AND NATURAL SOILS FROM THE CITY WALK PROJECT IN CHARLOTTESVILLE, VIRGINIA. THE
CINDER -SOILS WILL BE EXCAVATED DURING GRADING FOR THE NEW WATER STREET WHICH PASSES THE
CITY WALK DEVELOPMENT. IT WAS INITIALLY INTENDED TO STOCKPILE THESE MATERIALS WHILE
AWAITING DEQ APPROVAL FOR THE AVON LANDFILL CORRECTIVE MEASURES PLAN (CMP), WHICH
PROVIDES FOR THE PLACEMENT OF THESE MATERIALS ON THE CLOSED LANDFILL SURFACE. THE CMP
WAS APPROVED BY DEQ ON FEBRUARY 21, 2013 AND A PRE - CONSTRUCTION MEETING WAS HELD ON
FEBRUARY 26, 2013 FOR THE TWO APPROVED CINDER -SOIL PLACEMENT AREAS ON THE CLOSED
LANDFILL. IT IS STILL DESIRED TO HAVE COUNTY APPROVAL OF THE TEMPORARY STOCKPILING E &SC
PLAN, AS A CONTINGENCY iF NEEDED. THE FILL ACTIVITIES WILL BEGIN IN MARCH, 2013 AND LAST
FOR APPROXIMATELY SIX MONTHS.
B. EXISTING SITE CONDITIONS
CONTINGENCY TEMPORARY STOCKPILE WILL BE PLACED IN THE SOUTHEAST PORTION (9.2 ACRE
PARCEL) OF THE APPROXIMATELY 80 ACRE 5TH STREET STATION PROJECT. THE PORTION OF THE
PROPERTY TO BE DISTURBED IS A GRAVEL /BROKEN ASPHALT PAD BETWEEN AN ABANDONED BUILDING
AND AN EXISTING SOIL STOCKPILE. THE AREA IS ON A LOCAL HIGH POINT AND GENERALLY SLOPES
FROM SOUTHEAST TO NORTHWEST. THE AREA HAS APPROXIMATE SLOPES OF 1% TO 3% FROM
ELEVATION 428' TO 424'. CRITICAL SLOPES OF UP TO 2:1 ARE LOCATED APPROXIMATELY 50 -100' TO
THE NORTHWEST, WEST AND SOUTHWEST OF THE STOCKPILES, OUTSIDE OF THE LIMITS OF
DISTURBANCE. THE SiTE DRAINS INTO MOORES CREEK, WHICH RUNS ALONG THE EDGE OF THE
PROPERTY APPROXIMATELY 200' TO THE NORTHWEST OF THE STOCKPILES.
C. ADJACENT PROPERTY
THE CONTINGENCY TEMPORARY STOCKPILE AREA IS LOCATED AT THE SOUTH END OF BENT CREEK
ROAD, WHICH IS ACCESSED FROM 5TH STREET. THE 9.2 ACRE PARCEL IS SURROUNDED BY LARGER,
WOODED PARCELS OF LAND WITH THE SAME OWNER. THE PROPERTY TO THE SOUTHEAST IS THE
CLOSED AVON STREET LANDFILL. THE SURROUNDING PROPERTIES ARE BORDERED BY AVON STREET
EXTENDED TO THE EAST /SOUTHEAST, INTERSTATE 64 TO THE SOUTH, COMMERCIAL PROPERTIES ALONG
5TH STREET (STATE ROUTE 631) TO THE WEST /NORTHWEST AND THE WILLOUGHBY NEIGHBORHOOD TO
THE NORTH /NORTHEAST. MOORES CREEK WRAPS AROUND THE WEST AND NORTH PROPERTY LINES. A
CONSTRUCTION ENTRANCE WILL BE INSTALLED AT THE END OF BENT CREEK ROAD. NO ADJACENT
PROPERTIES WILL BE DISTURBED OR IMPACTED BY THE STOCKPILE AREAS.
D. PLANNED OFF -SITE ACTIVITIES
THE STOCKPILE MATERIALS WILL BE HAULED FROM THE CiTY WALK DEVELOPMENT SITE IN
CHARLOTTESVILLE, VIRGINIA. THIS IS AN INDEPENDENT EROSION AND SEDIMENT CONTROL PLAN FOR
THE TEMPORARY STOCKPILE AREAS ONLY. THE CONTRACTOR SHALL BE RESPONSIBLE FOR
IMPLEMENTING THE SEPARATE EROSION AND SEDIMENT CONTROL PLAN FOR THE HAUL SiTE. iF
ADDITIONAL OFFSITE AREAS ARE NEEDED, ANOTHER SITE PLAN AND EROSION AND SEDIMENT CONTROL
PLAN WILL NEED TO BE PREPARED AND IMPLEMENTED.
E. SOILS
PER THE NRCS WEB SOIL SURVEY, THE STOCKPILE AREA HAS A SOIL TYPE OF UDORTHENTS,
LOAMY.
F. CRITICAL EROSION AREAS
CRITICAL SLOPES HAVE BEEN IDENTIFIED TO THE NORTHWEST, WEST AND SOUTHWEST OF THE
STOCKPILES, BUT WILL NOT BE DISTURBED DURING THE EARTHWORK. THE MEASURES SUGGESTED FOR
EROSION AND SEDIMENT CONTROL WILL PREVENT ANY DEGRADATION TO THE SITE. THE CONTRACTOR
SHALL ENSURE THESE AREAS ARE NOT DISTURBED OR EFFECTED DURING STOCKPILE ACTIVITIES.
SHOULD THE DESIGNATED EROSION CONTROL INSPECTOR IDENTIFY AREAS WHERE ADDITIONAL
MEASURES BECOME NECESSARY, THE CONTRACTOR SHALL IMMEDIATELY COMPLY WITH SUCH REQUESTS.
G. EROSION AND SEDIMENT CONTROL MEASURES
UNLESS OTHERWISE INDICATED, ALL VEGETATIVE AND STRUCTURAL EROSION AND SEDIMENT CONTROL
MEASURES SHALL BE CONSTRUCTED AND MAINTAINED ACCORDING TO THE STANDARDS AND
SPECIFICATIONS OF THE VIRGINIA EROSION AND SEDIMENT CONTROL HANDBOOK ( VESCR). UNLESS
WAIVED OR APPROVED BY THE PERMIT ISSUING AUTHORITY, THE MINIMUM STANDARDS OF VESCR
SHALL APPLY. A COPY OF THE APPROVED EROSION AND SEDIMENT CONTROL PLAN IN ADDITION TO
THE VESCR SHALL BE MAINTAINED ON THE SITE AT ALL TIMES.
H. STRUCTURAL PRACTICES
1. TEMPORARY CONSTRUCTION ENTRANCE - 3.02
AN ASPHALT PAD WITH A WASH STATION LOCATED AT POINT OF VEHICULAR INGRESS AND EGRESS
TO THE STOCKPILE AREA. THE PURPOSE IS TO PREVENT OR REDUCE THE AMOUNT OF MUD
TRANSPORTED TO THE PUBLIC ROAD.
2.SILT FENCE
SEDIMENT BARRIERS WILL BE INSTALLED DOWN SLOPE OF MINIMAL GRADED AREAS TO FILTER
SEDIMENT LADEN RUNOFF.
3.DUST CONTROL - 3.39
DUST CONTROL MEASURES SHALL BE USED OVER THE WHOLE SITE TO REDUCE SURFACE AND AIR
MOVEMENT OF DUST DURING LAND DISTURBANCE, DEMOLITION, AND CONSTRUCTION ACTIVITIES.
I. VEGETATIVE PRACTICES
GENERAL: A PERMANENT VEGETATIVE COVER SHALL BE ESTABLISHED ON DENUDED AREAS NOT
OTHERWISE PERMANENTLY STABILIZED BY CONCRETE OR PAVEMENT. PERMANENT VEGETATION SHALL
NOT BE CONSIDERED ESTABLISHED UNTIL A GROUND COVER IS ACHIEVED THAT IS UNIFORM, MATURE
ENOUGH TO SURVIVE AND WILL INHIBIT EROSION. NEW VEGETATION SHALL BE MAINTAINED FOR ONE
FULL YEAR AFTER PLANTING. NEW SEEDING SHALL BE SUPPLIED WITH ADEQUATE MOISTURE,
ESPECIALLY LATE IN THE SEASON, AND IN ABNORMALLY HOT OR DRY WEATHER. STABILIZATION
PRACTICES SHALL BE ACCOMPLISHED IN ACCORDANCE WITH THE APPROPRIATE VESCH STD. & SPEC.,
ALBEMARLE COUNTY GUIDELINES AND PER THE EROSION AND SEDIMENT CONTROL PLAN. SELECTION OF
THE APPROPRIATE SEED MIXTURE FOR TEMPORARY SEEDING WILL DEPEND UPON THE TIME OF YEAR IT
IS APPLIED.
1. TEMPORARY SEEDING - 3.31
TEMPORARY SEEDING SHALL BE APPLIED OVER CLEARED AREAS THAT WiLL NOT BE BROUGHT TO
FINAL GRADE WITHIN 14 DAYS. SEEDING IS TO BE PER THE ALBEMARLE COUNTY GUIDELINES.
SEQUENCE OF INSTALLATION: WHEN STOCKPILE AREAS WILL NOT BE DISTURBED FOR 14 DAYS
MAINTENANCE: REFER TO STD. & SPEC. 3.31; AREAS WHICH FAIL TO ESTABLISH
VEGETATIVE COVER ADEQUATE TO PREVENT EROSION ARE TO BE
RESEEDED.
REMOVAL EVENT: AS NEEDED FOR FINAL GRADING.
2.PERMANENT SEEDING - 3.32
PERMANENT SEEDING SHALL BE USED ON ALL AREAS THAT WILL BE LEFT DORMANT FOR A PERIOD
OF MORE THAN 1 YEAR. SEEDING IS TO BE PER THE ALBEMARLE COUNTY GUIDELINES.
SEQUENCE OF INSTALLATION: WITHIN 7 DAYS OF ACHIEVING FINAL GRADE OR IF THE SITE WILL
AREA WILL REMAIN UNDISTURBED FOR ONE YEAR OR LONGER.
SOIL TESTING REQUIREMENTS: REFER TO STD. & SPEC. 3.32
MAINTENANCE: REFER TO STD. & SPEC. 3.32; AREAS WHICH FAIL TO ESTABLISH
VEGETATIVE COVER ADEQUATE TO PREVENT EROSION ARE TO BE
IMMEDIATELY RESEEDED, FOLLOWING IDENTIFICATION OF THE CAUSE
OF POOR GERMINATION.
J. PERMANENT STABILIZATION
TEMPORARY STOCKPILED MATERIALS FROM THE CITY WALK PROJECT WILL BE TRANSPORTED TO THE
CLOSED AVON LANDFILL SURFACE AND USED AS FILL IN CONJUNCTION WITH LANDSCAPING FOR THE
NEW BENT CREEK PARKWAY, WHICH WILL CONNECT AVON STREET EXTENDED WITH THE 5TH STREET
STATION DEVELOPMENT. ALL DISTURBED AREAS SHALL BE STABILIZED WITH PERMANENT SEEDING OR
HARDSCAPE FOLLOWING THE FINAL DISTURBANCE.
K. CONSTRUCTION SCHEDULE
1. ARRANGE A PRECONSTRUCTION MEETING WITH ALL REQUIRED PARTIES AT LEAST ONE WEEK PRIOR
TO THE START OF CONSTRUCTION.
2.ALL APPLICABLE PERMITS MUST BE ACQUIRED BEFORE ANY LAND DISTURBANCE TAKES PLACE.
3.INSTALL CONSTRUCTION ENTRANCE.
4.INSTALL SILT FENCE AND OTHER PERIMETER ESC MEASURES AS SHOWN ON PLAN.
5.AFTER ALL INITIAL EROSION CONTROL FEATURES HAVE BEEN INSTALLED, MATERIALS MAY BE
BROUGHT TO THE SITE FOR STOCKPILE.
6.THROUGHOUT STOCKPILE ACTIVITIES, APPLY DUST CONTROL MEASURES AND DEWATERING MEASURES
AS REQUIRED.
7.COMPLETE STOCKPILING ACTIVITIES AND INSTALL PERMANENT STABILIZATION MEASURES. SEED ALL
DISTURBED AREAS WITH PERMANENT SEED MIX.
&AFTER CONSTRUCTION IS COMPLETE, CONTACT THE PROJECT INSPECTOR FOR FINAL INSPECTION.
REMOVE REMAINING TEMPORARY SEDIMENT AND EROSION CONTROL MEASURES WITHIN 30 DAYS
AFTER FINAL SITE IS STABILIZED WITH VEGETATIVE GROWTH.
L. MAINTENANCE
IN GENERAL, ALL EROSION AND SEDIMENT CONTROL MEASURES WILL BE CHECKED AT LEAST EVERY
WEEK AND /OR AFTER EACH SIGNIFICANT RAINFALL. DURING CONSTRUCTION, THE CONTRACTOR'S
DESIGNATED RESPONSIBLE LAND DISTURBER (RLD) WILL BE RESPONSIBLE TO INSPECT AND REPAIR
DAMAGED EROSION /SEDIMENT` CONTROL MEASURES. THE FOLLOWING ITEMS WILL BE CHECKED IN
PARTICULAR:
1. THE SILT FENCE BARRIER WILL BE CHECKED REGULARLY FOR UNDERMINING OR DETERIORATION OF
THE FABRIC. SEDIMENT SHALL BE REMOVED WHEN THE LEVEL OF SEDIMENT DEPOSITION REACHES
HALF WAY TO THE TOP OF THE BARRIER.
2.THE SEEDED AREAS WILL BE CHECKED REGULARLY TO ENSURE THAT A GOOD STAND IS MAINTAINED.
AREAS SHOULD BE FERTILIZED AND RESEEDED AS NEEDED. REFER TO ESC TECHNICAL BULLETIN #4.
3.PROVIDE REMEDIAL STABILIZATION AND SEEDING FOR A PERIOD OF ONE YEAR AFTER CONSTRUCTION.
