On February 19, I contacted Ray Lilly to inform the county of this violation. I currently live on a farm located at 903 Hammocks Gap Road, Charlottesville VA 22911, and am enrolled in a State Plan to protect streams on my property. From this program, I was aware of the 30 feet buffer zone along streams, but did not know of the 100 feet buffer zone along rivers in Albemarle County. No trees were cut on the river bank. The few trees cut within the 30 feet buffer zone were deceased or dead, but we cut some healthy trees within the 100 feet buffer zone to open up a view of the river. There were practically no wooded shrubs growing in the buffer zone, as can be verified by examining adjacent properties. (please see attached diagram which provides an overview of the area we cut) Since receiving your letter dated February 22, I have read the Riparian Buffers Modification and Mitigation Guidance Manual and will follow the Mitigation guidelines from Chapter 5.1, p. 92 (replacement planting). The area we need to replant is less than 11,000 square feet. We plan to replace the 14 cut trees with flood tolerant large trees, small trees and woody shrubs from the list in the Manual. The table below summarizes our replacement plan. Trees cut Replacement 8 trees (12" caliper) 6 large trees (12" caliper) and 8 small trees (1.5-2" caliper) 6 trees (4-11" caliper) 12 small trees (1.5-2" caliper) In addition, we plan to plant 40 woody shrubs. All plants will be mulched with mulch depth of 3-4", and spread over 3' diameter for trees and 2' for shrubs. We also plan to plant flood tolerant grass in the spring, and the seeds will be protected with straw. Trees will be protected from deer with tubes and later on with cages made of three posts and plastic mesh. The ground is almost always very moist, but if necessary, we will water the plants Remaining vegetation: nothing was cut on the river bank. On either side of the cut area nothing was cut and the vegetation consists mostly of tall walnut trees (8-12" caliper). Within the cut area one large sycamore tree was left (>12" caliper). To minimize expense we have purchased B grade plants, mostly bare roots, as stated on p. 93 of the Manual. We are buying these plants as 1-2' seedlings from the Department of Forestry(please see attached page depicting our order from Dept of Forestry, which sells native plants). Most planting will be done in the spring, and we have ordered more plants than necessary in case some of them die. We are planning on planting more trees and shrubs in the fall, as some of the plants we want are currently unavailable. Trees will be planted adjacent to the stumps of the cut trees. Shrubs will be planted in between the trees. Thank you so much for your help, as we are anxious to repair any damage we may have caused to the environment.
