Hi Kris,
You're welcome, glad we could sort that note out. In regard to the two questions:
1. The connector road has not been assigned an official road name yet. It was labeled as "Connector Road" on the
plat, and VDOT had no objections to using that as the label. Since you have the recorded instrument number
listed for the ROW, you can just the road label as -is. It's possible it will become part of Rio Mills Road, but it
might get assigned a unique road name, I can't say for certain at this point. If it gets a new name, that would be
determined at a future date when a structure is proposed on one of the adjoining parcels that needs an address.
The County's E911 department has a process for creating new road names, so they would make that
determination later.
2. Yes, since one of the lots will be less than 21 acres, the assessment is required even in this circumstance. If the
parcels were going to be served by the ACSA water utility, the assessment wouldn't be required. But TMP 46-
18E is located outside of the ACSA jurisdictional area, and the Code requires a groundwater assessment prior to
approval of a plat creating lots less than 21 acres that will be served by wells. I know no development is
proposed that would necessitate wells at this point, but the Code says prior to approval of a plat creating the lot.

Thank you for the response and explanation. We just felt there needed to be some sort of explanation on the plat that
no new lot lines are being created or moved with this action. This is honestly a more technical note for any future
reference of land surveyors retracing the boundaries. We'll change the note accordingly per the County's request.

We have a couple more questions regarding this application if you have a quick minute:
1. The "Connector Road" that connects Berkmar Drive and existing Rio Mills Road, will this become the new Rio
Mills Road?
2. The Groundwater assessment fee that is being required per response #8: This is an already physically extant lot.
With the understanding that per code, lots under a certain size require this action, would this be required under
this special circumstance?
Any help/guidance that can be provided with this will be appreciated.

Hi Kris,
Creating a new Tax Map Parcel is technically creating new property boundaries. One existing non-contiguous parcel of
land is becoming two separate parcels of land. I know that the parcel boundaries of Lot A and Lot B will match exactly
the current boundaries of IMP 46-186, but again, this is creating two new properties that are entirely separate from
each other. Once recorded, this will legally separate the land, which is in fact creating new parcels. I guess a simpler way
to put it is that creating new Tax Parcels = creating new parcels.
The County doesn't require any notes like that Note #11 for a plat that is doing a standard two -lot division. If the owners
really want to keep the note on the plat, then removing the second sentence that states "No new parcels are being
created with this plat" would be the easiest thing to do.

Question regarding the comment about Note #11(this applies to SUB202200026 as well): To clarify, no property
boundary lines are being newly created or moved with this plat. We are simply showing the existing physical parcels that
are already physically divided by the Berkmar Drive right-of-way. We feel we need to communicate this in some way.
We understand that this technically is creating new Tax Parcels, but does not create any new physical parcels. Can you
make a suggestion on how this should be worded to satisfy the County?

Hi Kris,
Creating a new Tax Map Parcel is technically creating new property boundaries. One existing non-contiguous parcel of
land is becoming two separate parcels of land. I know that the parcel boundaries of Lot A and Lot B will match exactly
the current boundaries of TMP 46-186, but again, this is creating two new properties that are entirely separate from
each other. Once recorded, this will legally separate the land, which is in fact creating new parcels. I guess a simpler way
to put it is that creating new Tax Parcels = creating new parcels.
The County doesn't require any notes like that Note #11 for a plat that is doing a standard two -lot division. If the owners
really want to keep the note on the plat, then removing the second sentence that states "No new parcels are being
created with this plat" would be the easiest thing to do.

Question regarding the comment about Note #11(this applies to SUB202200026 as well): To clarify, no property
boundary lines are being newly created or moved with this plat. We are simply showing the existing physical parcels that
are already physically divided by the Berkmar Drive right-of-way. We feel we need to communicate this in some way.
We understand that this technically is creating new Tax Parcels, but does not create any new physical parcels. Can you
make a suggestion on how this should be worded to satisfy the County?

A two -lot subdivision plat has been submitted for review. This plat is proposing to subdivide Tax Map Parcel 46-18B into
two separate parcels. Currently, TMP 46-18B is one parcel bisected by Berkmar Drive.
This plat is also dedicating some land to public right-of-way associated with the Rio Mills Road/Berkmar Drive connector
road, which is a public road that was proffered through the Brookhill project.
