Williams Mullen 323 2nd Street SE, Suite 900 Charlottesville, VA 22902-3200 RE: LZC202200055 - Parcel ID 046134-00-00-00400 (3.41 Acres) (the "Property"), Owner — Maplewood Investments LLC, 455 Second Street SE Ste. 201 Charlottesville VA, 22902 To Whom it May Concern: In response to your request for a Letter of Zoning Compliance for the above referenced Property, please be advised of the following: The Property is zoned Planned Residential Development (PRD). The Property is subject to ZMA202100006, approved June 1, 2022, which permits residential uses of the Property with a density of up to 30 dwelling units per acre or a maximum of 102 dwelling units, without obtaining a conditional or special use permit, variance, special exception or other authorization or approval. The Property is subject to the Entrance Corridor ("EC"), Steep Slopes, and the Airport Impact Area Overlay Districts as described in Section 30 of Chapter 18 of the Zoning Ordinance. Additional information pertaining to the PRD zoning district can be found in Section 19 of the Zoning Ordinance. • The Property is subject to Site Plan SDP202200049 (Initial), approved October 20, 2022, for the development of 72 multi -family residential units, and has one Site Plan, SDP202200067 (Final), currently under review. • The Property is subject to Special Exception SE202200019, approved June 1, 2022, which waives the 15-foot setback requirement for each story above 40' in height or above the third story, whichever is less, in a Planned Residential Development, for the buildings in the Maplewood Development, and is subject to conditions. To the best of my knowledge, the Property is currently in compliance with all applicable requirements of the Zoning Ordinance. A review of our files found (i) that the current use of the Property is vacant land, (ii) no violations or alleged violations or regulations applicable to the Property, whether pending, contemplated, or having already occurred, (iii) no fees due or pending with respect to any matter before the County Zoning Office; and (iv) no pending application for rezoning of the Property or for a special or conditional use permit or variance in connection with the Property. Further, no proceeding to challenge the zoning or other governmental approval or use of the Property pending or overtly threatened to the best of my knowledge. • The Property is recognized as one parcel of land under the Subdivision Ordinance of the County, and may be conveyed, leased, or mortgaged as a separate parcel. Any future subdivision applications must comply with the Subdivision Ordinance. January 10, 2023 LZC202200055 Page 2 • If the Property contained physical development approved with a site plan, then in the event of casualty, the Property may be rebuilt substantially in the same form upon satisfaction of all required building permits and site plans, as applicable. If unable to find the records, then a request through the department's Records Manager, Paul Bjornsen, at pbiornsen(Walbemarle.org may be made.
