The plat has been revised to show the updated public drainage easement on Lot 19, to add a new 20' Public drainage easement on Lots 22 & 23, to add a new sight easement on Lot 23 and to dedicate R/W along a portion of State Routes 750 and 803. According to the Final Plat Review Comments, dated October 22, 2023, 1 believe the only thing remaining is item 17 (deed of dedication for the easements). Although a kernel must have a building site and a development right, a dwelling itself need not be established within the kernel. So, I believe the simple answer to this question is no, we would not allow for Lot 22 to have less than a 2 acre kernel from the parent tract. I could certainly take these questions to our Zoning and Legal teams for their advice as well, but this may take some time. Please let me know if you'd like me to do so and if you have any further questions at this time. I didn't think we could have less than 2.00 acres from the original parent tract for Lot 22. Will you all allow that to be less than the normal 2 acre "kernel" rule? Right now we just have 2.00 acre from the parent tract in Lot 22. Lot 23 will need to be revised if the proposed r/w dedication will take it below 2 acres. It appears an adjustment with Lot 22 will solve this issue. Let me know if you have further questions. Most of these are changes to the drain easements, but he also asked us to dedicate right of way along State Route 803 as highlighted in pink on the attached. VDOT had requested that dedication, but it's not a requirement. I'm wondering if that causes an issue with Lot 23, since the dedication would make it less than 2.00 acres. Scott was thinking it wouldn't be an issue if we state the original area less the dedication, demonstrating that the lot size would be met before the dedication. He will be able to update you on the status of that application, but it appears he did request changes on 12/16/2022 based on our County View data. I was looking into the Stockton Creek project and our Road Plan SUB202200140 had comments due 12/16. Wanted to see if you are close to issuing comments on that plan. We also received approved permits for all the well and septic drain fields from the Health Department and I believe that was the last item needed for the final subdivision plat SUB202200125. I can send you scans of those if you don't have them already. Looks like we are pretty close with this project so please let me know what else you might need from us in order to turn around review comments. Thanks, Joe
