To Whom it May Concern:
In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
The Property is zoned Neighborhood Model District (NMD). The Property is subject to
ZMA201500007, approved November 9, 2016, which permits a variety of commercial uses,
residential uses with a density of up to 34 dwelling units per acre, and a maximum of 1550
units allowed across the entire Brookhill Development, without obtaining a conditional or
special use permit, variance, special exception or other authorization or approval. The
Property is subject to the Entrance Corridor (EC), the Steep Slopes, and the Airport Impact
Area Overlay Districts as described in Section 30 of Chapter 18 of the Zoning Ordinance.
Additional information pertaining to the NMD zoning district can be found in Section 20A of
the Zoning Ordinance.
• The Property is subject to Site Plan SDP202200010 (Block 1 D - Initial), approved April 14,
2022, and SDP202100064 (Block 1 C — Initial), approved September 23, 2021, for the
development of multiple commercial buildings, a hotel, fitness center, pool and community
building, and associated parking.
To the best of my knowledge, the Property is currently in compliance with all applicable
requirements of the Zoning Ordinance and COD. A review of our files found (i) that the
current use of the Property is vacant land, (ii) no violations or alleged violations or
regulations applicable to the Property, whether pending, contemplated, or having already
occurred, (iii) no fees due or pending with respect to any matter before the County Zoning
Office, and (iv) no pending application for rezoning of the Property or for a special or
conditional use permit or variance in connection with the Property. Further, no proceeding to
challenge the zoning or other governmental approval or use of the Property pending or
overtly threatened to the best of my knowledge.
The Property is recognized as one parcel of land under the Subdivision Ordinance of the
County, and may be conveyed, leased, or mortgaged as a separate parcel and currently
complies with such subdivision ordinance and other applicable subdivision laws. The
Property is not subject to conditions or special limitations imposed by the County in
connection with any subdivision of the Property. Any future subdivision applications must
comply with the Subdivision Ordinance. There are currently two pending subdivision
applications associated with the Property: SUB202200095 (Easement Plat) and
SUB202200157 (Boundary Line Adjustment).

• If the Property contained physical development approved with a site plan, then in the event
of casualty, the Property may be rebuilt substantially in the same form upon satisfaction of
all required building permits and site plans, as applicable.

Development Department Records Public Access link below. If unable to find the records,
then a request through the department's Records Manager, Paul Bjornsen, at
pbiornsen(Walbemarle.org may be made. If the request is not based in Virginia, it will take
longer to fulfill.
