The Property is subject to ZMA201500007, approved November 9, 2016, which permits residential uses with a density of up to 6 dwelling units per acre, and a maximum of 1550 units allowed across the entire Brookhill Development, without obtaining a conditional or special use permit, variance, special exception or other authorization or approval. The Property is subject to the Entrance Corridor (EC), the Steep Slopes, and the Airport Impact Area Overlay Districts as described in Section 30 of Chapter 18 of the Zoning Ordinance. Additional information pertaining to the NMD zoning district can be found in Section 20A of the Zoning Ordinance. The Property is subject to Site Plan SDP202200017 (Initial), approved July 20, 2022, for the development of 81 attached single-family dwelling units, and has one site plan, SDP202200058 (Final), currently under review. A total of 134 dwelling units are proposed on the Property. To the best of my knowledge, the Property is currently in compliance with all applicable requirements of the Zoning Ordinance and COD. A review of our files found (i) that the current use of the Property is vacant land, (ii) no violations or alleged violations or regulations applicable to the Property, whether pending, contemplated, or having already occurred, (iii) no fees due or pending with respect to any matter before the County Zoning Office; and (iv) no pending application for rezoning of the Property or for a special or conditional use permit or variance in connection with the Property. Further, no proceeding to challenge the zoning or other governmental approval or use of the Property pending or overtly threatened to the best of my knowledge. The Property is subject to Subdivision Application SUB202100150 (Final), approved December 14, 2022, SUB202200058 (Preliminary), approved June 20, 2022, and SUB202200113 (Final), approved January 6, 2023, to create multiple parcels intended for residential development and associated open space, easements, and rights -of -way. These applications subdivided the original 24.98ac indicated above. The Property is not subject to conditions or special limitations imposed by the County in connection with any subdivision of the Property. Any future subdivision applications must comply with the Subdivision Ordinance.
