RE: COMMENT RESPONSE to 1st Review, SUB202200183 Woodbrook Station — Boundary Line
Adjustment (BLA)

Please find below our responses to review of the plat referenced above (Ivy Proper Easement / BLA Plat);
we appreciate your comments and review. Included (below) are comments provided by Albemarle County
with responses (in red), accordingly:
1. [14-302(A)(7)] Departing lot lines. If TMP 45-94 shares a boundary edge with the subject property,
identify the departing lot lines and provide the appropriate labels on the plat map. TMP-94 does not share
a boundary with the subject, but it is depicted to more clearly define the adjoining public right-of-way,
Berkmar Drive.
2. [14-302(A)(10)] Development rights. Remove Note 11. Due to the property's location within the
Development Area this Rural Area -focused note is not needed on the plat and could cause confusion.
Addressed.
3. [14-302(B)(5)] Zoning. In the zoning notes for each property, revise the rezoning line to state:
"ZMA2003-00008 and associated proffers". Addressed.
4. [14-303(A)] Statement of consent. Revise the statement of consent to explicitly state: "The platting
or dedication of the following described land [insert a correct description of the land subdivided] is with
the free consent and in accordance with the desire of the undersigned owners, proprietors and trustees, if
any." Addressed.
5. [Comment] Reminder that revised plats must include the original date of drawing and the revision
dates) of each subsequent version of the plat. Addressed. Original (Oct. 24) and 2nd submittal (Jan 11)
dates are shown.

1. Please note proffer #1 of ZMA2003-008 remains in effect for both parcels unless rezoned or developed
in accordance with the Rio29 Form -Based Code Overlay District. This proffer requires the property owner
to establish the sidewalks, pedestrian pathway, and stairway shown on the plan entitled "Wood brook
Station Rezoning Application Site Concept,' dated October 24, 2005. The sidewalks, pedestrian pathway,
and stairway must be completed prior to the issuance of any CO's for any business or residence in the
development. The pedestrian pathway and stairway as shown on the plan entitled "Woodbrook Station
Rezoning Application Site Concept" are located on parcels under separate ownership, but this does not
recuse the owner from this proffer requirement. Acknowledged. Deemed not a survey / plat matter,
understood incidental to site design.
Additionally, proffer #2 of ZMA2003-008 will apply to any residential developments on either parcel
unless rezoned or developed in accordance with the Rio29 Form -Based Code Overlay District. This proffer
requires a cash contribution Albemarle County of $1,725 per dwelling unit for affordable housing. This
contribution is due and payable with each application for a building permit. Acknowledged. Deemed not a
survey / plat matter, understood incidental to site design.
