Review of Private Improvement Maintenance Instrument

The instrument required by Albemarle County Code § 14-317 for this subdivision:

is not approved because it fails to satisfy one or more of the following requirements(number references
are to Albemarle County Code § 17-317(A)):
1. Identify the plat to which the instrument applies; if the plat has been recorded,the identification
shall include a deed book and page number.
2. State that the improvement will be maintained in perpetuity.
3. State that the improvement will be maintained to a standard that, at a minimum, assures that it will
remain in substantially the condition it was in when approved by the county; for a private street,
shared driveway,or alley,the instrument also shall state verbatim: "The travelway shall at all
times be maintained so that it is safe and convenient for passenger automobiles and emergency
vehicles at all times except in severe temporary weather conditions."
4. If the instrument pertains to the maintenance of one or more private streets, alleys or shared
driveways, it shall define"maintenance"by stating verbatim: "For purposes of this instrument,
`maintenance' includes the maintenance of the private streets or alleys, and all curbs, curbs and
gutters, drainage facilities, utilities, dams,bridges and other private street improvements, and the
prompt removal of snow,water, debris, or any other obstruction so as to keep the private street or
alley reasonably open for usage by all vehicles, including emergency services vehicles."
5. Describe the condition of the improvement when it was approved by the county.
6. Identify the timing or conditions warranting maintenance of the improvement.
7. State a means to collect funds necessary for the cost of maintaining the improvement; at a
minimum,the means stated shall include the right of any landowner subject to the instrument to
record a lien against a non-contributing landowner,to bring an action at law to collect the funds,
or both.
8. Describe how maintenance costs will be prorated among the landowners subject to the instrument
(e.g.,"equally,"or on a percentage basis); if any lot within the subdivision may be further
divided,the instrument shall also describe how maintenance costs will be prorated among the
landowners after division.
9. State verbatim: "No public agency, including the Virginia Department of Transportation and the
County of Albemarle,Virginia,will be responsible for maintaining any improvement identified
herein."

The Planner for the Planning Services Division of the Albemarle County Department Community
Development has the following comments(The following comments are those that have been
identified at this time. Additional comments or conditions may be added or eliminated based
on further review.) [Each comment is preceded by the applicable reference to the Albemarle
County Code.]
1. [14 -316] VDOT. Approval from the Virginia Department of Transportation is required.
Rev1: VDOT approval has not been granted to date.
2. [14 -317] Instrument. Provide an instrument for the maintenance of the private streets
to be reviewed and approved by the County Attorney. A template is provided for your
use. Also, provide deeds of easement for the storm drainage easements.
Rev1: An instrument has not been submitted for the private streets and easements.
Provide the deeds for these improvements.
3. [14 -428] Dedication. Is Glen Valley and Fielding Run being dedicated with this plat? If so,
please state, the roads must be dedicated for frontage of the lots. If already dedicated,
provide the deed book and page number for the streets under which it was dedicated.
Rev1: Comment addressed.
4. [14 -435] Surety. All bonds must be posted for all improvements prior to signing of the
final plat.
Rev1: Bonds will need to be provided.
5. [Proffer #2] If affordable units are being constructed, they need to be shown /indicated
on the plat per this proffer for tracking purposes. If not, provide a supplemental table
that shows all the blocks to ensure that the affordable housing proffers are still being
met.
Rev1: Please provide a spreadsheet of the units in Old Trail to ensure that the
affordable housing is being met.

The road names 'Nobel Leaf Lane' and 'Nobel Leaf Way' are not acceptable in the current configuration. The
roads have to be connected before a road name could be shared in this fashion. Using either 'Nobel Leave Lane'
or 'Nobel Leaf Way' for one of the road names and 'Claire Mill Circle' for the other would be acceptable.

2. If SWM amendment proposes to treat runoff from Block 14 off -site, please modify easement note

3. Please indicate proposed water and sewer lines, proposed drainage lines and structures, fire
hydrants, and proposed stormwater management facilities after approved on Old Trail Village

proposed with Old Trail Village Block 14 site plan prior to the approval of the final plat.
5. Subdivision — water & sewer (by ACSA) and WPO (ESC and SWM, by the county) bonds will
need to be posted prior to the approval of the final plat.
6. A stormwater management maintenance agreement will be required for Old Trail Village Block 14
prior to final subdivision plat approval.

road name is not available for use. The road name 'Claire Mill Circle' is valid and has been added to the reserve
road name list.
