This is your Written Warning in accordance with § 17-900 of the Water Protection Ordinance of
Albemarle County and Section 62.1-44.15:37 of the Virginia Stormwater Management Act.
This Written Warning is being issued because of the following deficiencies:
Deficiency: swppp must identify the qualified person(s) performing inspections, and their qualifications.
Corrective Action: Identify qualified person and qualifications.
Deficiency: The swppp must contain an "approved" plan that has a county approval stamp.
Corrective Action: the plan in the swppp must have an approval stamp.
Deficiency: swppp contains an appropriate pollution prevention plan, but it is not being followed.
Please comply with the pollution prevention plan so that field conditions match the plan.
Corrective Action: follow the pollution prevention plan, or amend the plan.
Deficiency: Swppp must be amended whenever field conditions deviate from the approved plan. The
amendment process was reviewed during the pre -construction meeting, and again on site during this
inspection with Wesley Teter and Alejandro Ovalle.
Corrective Action: Follow e&sc plan, or amend it.
Deficiency: the last inspection documented in the swppp is dated 1-13-23.
Corrective Action: perform and document inspections at required frequency.
Deficiency: stockpile(s) behind school in the staging area are not shown on plan. The E&SC plan must
be amended to show the piles, and piles are to be stabilized if they ever remain dormant for more than 14
days.
Corrective Action: follow the e&sc plan, or amend it.
Deficiency: Numerous E&SC measures shown in Ph 1 of the plan are not installed. If these controls are
not needed in "Ph I", amend the swppp to indicate when they will be installed.
Corrective Action: install "all" a&sc measures shown on the approved plan, or amend it.
Deficiency: a diversion along the south side of the sediment basin has not been installed pursuant to the
approved plan.
