I have spoken to the agent on this issue for your project and they confirm that the note is required to be placed on the
plat.
Their specific response to the question was: "Yes, the note needs to be on the plat. Those lots, and now one lot
are/is served by water and sewer, however they still need a "contiguous area of land that may not contain any area
of land that is: (i) in critical slopes; (ii)within the flood hazard overlay district; (iii) under water during normal
hydrological conditions; (iv) within two hundred (200) horizontal feet of the one hundred year flood plain of any
public water supply reservoir; and (v)within a stream buffer under chapter 17 of the Code, provided that nothing
contained herein shall be deemed to prohibit or impair the program authority from exercising its discretion as authorized in
chapter 17. ""
Please add the required note "The re • ed lot contain a building site that complies with Section 4.2 of the .Albemarle
County Zoning Ordinance."

Would you please ask the agent.
Many times we add parcels together that do not have complying building sites.
As to not showing this note, this would only apply when you are adding two existing parcels together.

It is my understanding that all lots being created/approved by the County (other than a special lot), including
BLA's, must have a building site on them.
Below I provided section 14-208.1 which dictates what is required for BLAs, upon my re-review of 14-302A9 I
have revised the required note, see below. But upon reviewing 14-208.1 you'll see it makes note of 14-302A9.
If after reviewing this section you still feel that this note is not applicable I can take your request to the
Subdivision Agent for discussion and get his final word on it. Let me know how you wish to proceed.
Original Comment [14-302(A)(9)] Building site on proposed lot. Please add a note that states "Tax Map 61-144 and
146D contain a building site that complies with Section 4.2 of the Albemarle County Zoning Ordinance."
Revised Comment [14-302(A)(9)] Building site on proposed lot. Please add a note that states "The revised lot contain
a building site that complies with Section 4.2 of the Albemarle County Zoning Ordinance."
Section 14-208.1 The following sections shall apply to each boundary line adjustment,when applicable:
A. General: Sections 14-100 through 14-108.
B.Administration and procedure: Sections 14-200 through 14-204, 14-212.1, 14-224.1, 14-225.1, 14-226 and 14-229.
C.Plat requirements and documents to be submitted: Sections 14-300, 14-301, 14-302(A)(1),(2),(3),(4),(5), (6),(7),(9), (10),(11),
(14)and(15), 14-302(B)(1),(2),(4),(5),(6),(7),(9)and(10), 14-303(A),(B),(C),(D),(E),(F),(G),(H),(1),(L),(0)and(P); if any
resulting lot will be less than five(5)acres,the soil evaluation required by section 14-309, 14-310, 14-312 and 14-314.
D. Onsite improvements and design: Sections 14-400, 14-405, 14-406, 14-416, 14-421, 14-426 through 14-429, 14-433 and 14-438.

I've reviewed your attached comments.
I have one comment-#3 (Building site on proposed lot). We are adding together two existing parcels of land. I don't
believe we have shown this note on previous Boundary Line Adjustments.

The County of Albemarle Division of Current Development will grant or recommend approval of the
boundary line adjustment plat referenced above once the following comments have been addressed:

1. [Section 14- 3028(5)] Zoning. TMP 06100 -00 -00 -14400 has an approved Special Use Permit w/
condition (SP2000 -60), assure this information is listed under the site's zoning.
2. [Section 14- 302A(3)] Existing or Platted Streets. On the plat label "Rio School Lane ".
3. [14- 302(A)(9)] Building site on proposed lot. Please add a note that states "Tax Map 61 -144 and
146D contain a building site that complies with Section 4.2 of the Albemarle County Zoning
Ordinance."
4. [14- 302(8)(1)] General Information. When the plat is revised, please provide the date of the last
revision on the plat.
