Subject: SUB - 2013 -150- Bocock/Hitz - BLA
The County of Albemarle Planning Division will grant or recommend approval of the
Boundary Line Adjustment Plat referenced above once the following comments have
been addressed: [Each comment is preceded by the applicable reference, which is to the
Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14- 302(B)(2)] Name of plat prep the plat l i 1,c name and seal of
the person who prepared the pl -" Rev 1. Comment addressed.
2. [14- 302(B)(10)] Stream buffers. Per County maps it appears there is a stream
(Stony Run) present in various areas subject of this plat. Depict the 100' stream
buffer on each side of the stream and provide the following required note to the
plat: "The stream buffer(s) shall be managed in accordance with the Albemarle
County Water Protection Ordinance".
Rev 1. Comment not adequately addressed. Staff forwarded the revised plat and
associated map to Engineering for their review and they provide the following
comment: "Per USGS maps and having a Drainage area over 50 acres the County
requires a VWPO Buffer easement shown on Stony Run Creek. All streams in
Albemarle County, both perennial and intermittent, have 100' buffers on either
side of the stream measured from the edge and /or top of bank. Should the
applicant wish to contest this determination, a 3rd party specializing and licensed
in stream determination will be required to submit certified documentation
proving the stream does not exist in this location and in addition, the GIS location
for the actual location of the headwaters of the stream so the maps may be
corrected as required." Rev 2. Comment addressed.
3. [14- 302(a)2] Vicinity map. Vicinity Maps shall be at a scale of 1 ":2000'. Revise
the vicinity map to meet the requirements of the ordinance.
Rev 1. Comment not adequately addressed. It appears that the map has been
magnified but staff is unable to tell if it is truly 1": 2000'. If it is, please provide a
scale under the vicinity map. Rev 2. Comment addressed.

the County of Albemarle Subdivision Ordinance (Jan 1, 2014) require changes to
the consent to division statement. Please revise the statement to read: "The
platting or dedication of the following described land [insert correct description
of the land subdivided] is with free consent and in accordance with the desire of
the undersigned owners, proprietors and trustees, if any. " Rev 2. Comment
addressed.
If the applicant would like to continue utilizing the previous ordinance language:
"Any reference to future potential development is to be deemed as theoretical. All
statements affixed to this plat are true and correct to the best of my knowledge. "
