THIS SUPPLEMENTAL DECLARATION (this "Supplemental Declaration ") is made
this day of December, 2013, by Gaylon T. BEIGHTS, hereinafter called `Beights "; and

WHEREAS, March Mountain Properties and Old Trail Community Association, Inc.
previously executed the Declaration of Covenants and Restrictions of Old Trail dated December
10, 2004, of record in the Clerk's Office of the Circuit Court of Albemarle County, Virginia, in
Deed Book 2887, page 336. Such Declaration and all amendments, modifications and

1. [14- 302(A)1] Name of subdivision. Please name this phase " Creekside III Phase IIIX to correspond with
the correct road plans, WPO application, and previous phase naming convention.

2. [14- 302(A)4] Private easements. One sidewalk easement label points to an area where no sidewalk
easement is shown (at C3, C4, C5). Please add an easement in this area or remove the label. Additionally,
the road plans show that many of the required street trees (approved for bonus density) are proposed
outside of the 10' sidewalk (and landscape) easement; please extend this easement to include all street tree
locations.
Rev1: Comment not fully addressed. The road plans show a 12.5' sidewalk and landscape easement
in the same location as the proposed 15' sidewalk easement on this plat; the plat and plans must

2. Item #1 on sheet 2 indicates 10' sidewalk easement is proposed. Road plans (currently
unapproved) SUB2012 -00086 propose a 10' Sidewalk and Landscaping easement along the south
side of Birchwood Hill Road.
3. Item #7 on sheet 2 indicates 15' sidewalk easement is proposed. Road plans (currently
unapproved) SUB2012 -00086 propose a 12.5' Sidewalk and Landscaping easement along the
north side of Birchwood Hill Road.

Dear Ms. Ray:
We have reviewed the final plat entitled Creekside III, Phase IID dated October 14, 2013 as
submitted by Commonwealth Land Surveying, LLC and offer the following comments:
1. The lots being created by this plat are included in the road plans for Creekside III, Phase
III. As such, the final plat should not be approved until these road plans have received
final approval.
2. Per the road plans for Creekside III, Phase III, as sight distance easement is called for
across Lot 46 and future Lot 45 (not shown on plat in this submittal). Note 4 references a
sight distance easement; however, I did not see the easement shown on the final plat.
