The property owners are seeking to add 2.1 acres so they can expand their kitchen and still meet RA setbacks. I'm curious if you think it should be sent to DCR for their review under§ 10.1-606.3? In my mind,the BLA doesn't meet the definition of"development" under§15.2-2201. Perhaps the building permit to expand the house will apply, but I don't think this application should apply. At a minimum, I was going to suggest that the surveyor add a note to the plat that recognizes the property is located in a dam break inundation zone. Do you have any suggestions? Do you know how this application would be processed under the pending new regulations? Thanks, J.T. I'm assuming that the right-of-way was dedicated per the deed reference, but short of researching it at the court house, I cannot confirm that is correct as shown. Since a 50' right-of-way has apparently been dedicated in this area, it would be good to extend the 50' dedicated right-of-way if possible. With this being a boundary line adjustment, I don't know whether that is possible or not, and I don't have any real heartburn if we can't get it. Let me know if you need additional information. [Each comment is preceded by the applicable reference in the Subdivision/Zoning Ordinances, unless otherwise specified.] 1. [14-302(A)2] Vicinity Map. On Sheet 1, please show the map at a scale of 1"=2000'. 2. [14-302(B)10] Stream buffers. On Sheet 2,please show the stream buffers located outside of the flood plain on the southern side of Mechums River. I have attached a GIS map of their location. 3. [General Comment] I am awaiting approval from the Virginia Department of Transportation regarding the conveyance of right-of-way on State Route 678. 4. [General Comment] This property lies in the"dam break inundation zone" of the dam at Lake Albemarle. VA Code § 10.1-606.3 states the requirements for development within dam break inundation zones and this application may require the review of the Department of Conservation and Recreation. The Planning Commission is scheduled to review a draft ordinance for these requirements on October 8, 2013. With these considerations, I am waiting for comment from the County Attorney's office on how to proceed with this application. Please contact J.T.
