Common Area Open Space 2A has been renamed to Parcel "A" and is referred to later on as such. 2.) We landhooked Parcel "A" and TMP 61A -2 indicating the intent of this plat. It is further noted in Note #5. In the same note we still show it as "Reserved for Future R/W and we are creating an ingress /egress easement across it to continue the intent of the 20' strip. 3.) Added the Area Summary showing the revised total to TMP 61A -2. At your convenience please review and let me know if you have any questions. I believe this should get us to the point where once the Quit Claim is recorded we can move to add the recordation to the now "A ", "Y ", and "Z" plat followed by the update of the final plat with all current deed references. Per discussions with other planning staff there is not a specific template for it, rather it's suggested you utilize portions of your existing maintenance agreement from the Lochyln Hill Covenants and Restrictions to draft one for this residue or have your legal advisors draft one for this residue. Per discussions with the Subdivision Agent he is firm that a maintenance agreement shall be provided for this residue as this area is being handled as a Special Lot and would be required to be left as Common Area Open Space to qualify as a Special Lot. Notably prior to the ownership being transferred to Meadow Creek Dev it was owned by the City of Charlottesville and was publicly owned, thus a maintenance agreement was not required and it also qualified as a Special Lot. So if you want to leave it in the City's ownership then a maintenance agreement would not be required. The only other foreseeable way around having a maintenance agreement on this 3,680 SF residue is to add it to Lochyln Hill's Common Area Open Space, at which point the existing Maintenance Agreement for Lochyln Hill would already cover it. If you choose to go this route, it is advisable to add the residue to Lochyln Hill on this Parcel Y/Z plat, and then update Lochyln Hill's final plat to reflect the revisions to the subdivision. I asked if they will leave the note "Hereby Reserved for future right of way and shall be dedicated upon demand of the county" ...LJ agreed it would remain on the plat. But he does not want to do a maintenance agreement, nor does he want to do a BLA with Lochyln Hill Subdivision. His point is we don't need a maintenance agreement, rather its private property and they will maintain it as any private property would be required to be maintained. I said that won't do be we need a maintenance agreement for it. He requested I send him a standard maintenance agreement approved by the county attorney and they will fill it out and set it to record with the plat. This will be a Special Lot...as such it shall be reviewed as a special lot. I said I would get back into this on 3-11-14 and give him an answer on my findings and let him know. Previously you approved this January 29th; however, the applicant has made some changes and I want to assure VDOT's good with how it's shown. The only change I see that you would be looking at is the driveway easements, which is what we previously spoke about happening but the applicant never actually put them on the plat until today. Regardless I want to assure you get your eyes on the driveway easements locations b4 I sign off on it. Notably these driveways are existing lots with homs, and existing driveways, what they are doing is extending them to match up to the new public right of way location. If you need this revised plat officially submitted to your office through hard copy inner office mail, just say so, and I'll assure its done ... thanks Christopher P. The latest submittal has some changes which need to be reviewed by ACSA (additional 10' waterline easement) and Engineering. I'll forward the revised plat to them today. At 1St glance one thing that jumps out to me is that the plat does not specify the terminology of what exactly is a "DW /E -1, DW /E -2, DW /E -3 ", I deduce it's Driveway Easement 1, 2, and 3 but it's not actually spelled out anywhere on the plat, is it? It should be. Also will there be a deed associated with the new access easements being shown on this plat? Also it appears you are adding area to Lochlyn's Common Area Open Space 2 in the form of "Common Open Space 2A "...to assure that this doesn't create some type of spike strip you will need to provide the same note that was provided on the final plat for lochyln hill "Common Area Open Space 2A is Hereby Reserved for future right of way and shall be dedicated upon demand of the county. " Also, once this Parcel Y and Z plat is set to record, the final plat for Lochyln Hill (SUB2013 -136) should be revised to add the land to the subdivision assuring to update the acreage of the property and add the acreage to the Common Open Space 2 acreage to assure that it's covered in the Covenants and Restrictions etc... (The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review.) [Each comment is preceded by the applicable reference to the Albemarle County Code.] 1. [14- 303(A)] Statement of consent to division. Changes to the State Code and to the County of Albemarle Subdivision Ordinance require changes to the consent to division statement. Please revise the statement to read: "The platting or dedication of the following described land [insert correct description of the land subdivided] is with free consent and in accordance with the desire of the undersigned owners, proprietors and trustees, if any.
