Easement Plat
The County of Albemarle Planning Division will grant or recommend approval of the Boundary Line Adjustment
Plat referenced above once the following comments have been addressed: [Each comment is preceded by the
applicable reference, which is to the Subdivision /Zoning Ordinances unless otherwise specified.]
1. [14- 302(A)(1)] Name of subdivision. Since this plat both adjusts the boundary and records easements,
please add `Easement Plat' to the project title for clarification.
Rev1: Comment addressed.
2. [14- 302(A)(2)] Existing or platted streets. Indicate where the public right -of -way for Broadway Street ends
and the private right -of -way for Marchant Street begins. Also note the right -of -way width of Marchant.

3. [14- 302(A)(5)] Public easements. Any public easements intended to be dedicated by this plat should be
labeled "Hereby Dedicated ".

4. [14- 302(A)(4 &5)] Private and Public easements. Verify that the entire proposed "20' access easement" is
within TMP 78-21B; it is difficult to tell if a portion extends onto TMP 77 -40P1.

5. [14- 302(A)(4 &5)] Private and Public easements. There are several discrepancies between the easements
shown on the associated site plan and what is shown on this plat, all easements must be consistent
between the two applications:
a. The 20' access easement is shown differently at its southern end. On the plat it follows the turn
on the property line, but on the site plan it does not.
Rev1: Comment still valid; the access easement shown on the plat much match what is
shown on the Site Plan in order for the Site plan to be approved. No site plan revision
has yet been submitted to show a different configuration.
b. The 20' access easement is partially wooded, but no grading or clearing is shown on the site
plan. However, the limits of disturbance extend the length of the proposed easement.
Rev1: If no improvements are proposed within the permanent access easement, the
limits of disturbance should be removed from this area on the site plan and the WPO
application.
c. No easement is indicated on Pireus Row, but the limits of disturbance on the site plan cover the
entire travelway /road.
Rev1: If Pireus Row is to be used as temporary access only, no easement is required on
the plat; a letter of intent /agreement is sufficient. If no improvements are proposed in
this area, the limits of disturbance should be removed from this area on the site plan and
the WPO application.
d. Portions of the temporary gravel access road, construction entrance and tire wash area near the
modified property line are outside of the adjusted boundary and proposed easement area; the
easement may need to be extended to cover these areas.
Rev1: These elements are referred to as temporary on some sheets of the site plan and
permanent on others, please clarify if they are temporary or permanent improvements
and make sure all notes /labels are consistent. If they are for temporary use only, no
easement is required in the plat; a letter of intent /agreement is sufficient.
6. [14- 302(A)(10)] Right of further division of proposed lots. Remove Note #2 regarding development rights;
development rights are only applicable in the Rural Areas.

7. [14- 302(8)(5)] Zoning classification. Add Entrance Corridor (EC) to the Zoning note. Please also indicate
that TMP 77 -40A is subject to Special Permits SP 77 -73 and SP 77 -77.
Rev1: Comment not fully addressed. TMP 77 -40A is in the Entrance Corridor; please revise Note #9.
8. [14- 302(8)(7)] Reservoir watershed /agricultural- forestal district. Revise the watershed and ag- forestal
district note to refer to TMPs 77 -40A & 78 -21 B instead of lot Y.

9. [14- 302(8)(9)] Flood plain. Revise the flood plain note to refer to TMPs 77 -40A & 78 -21 B instead of lot `x'.

plat.

RE: Boundary Line Adjustment (SUB201400016)
The engineering review has been completed. Please see below for the following comments.
1. The proposed 20' permanent access easement dedicated to RWSA is shown. This area is wooded
and it appears clearing and grubbing is necessary to use this access road. Also, it should be graded
to meet our travelway standards per 4.12.17. Please clarify why clearing, grubbing and grading for
the access road is not shown on the site plan or wpo plan.
2. Please clarify the terms of the subterranean easement. Why is only a portion of the subterranean
easement shown?
3. The submitted plan appears to be more than a boundary line adjustment. The title should be
changed to clarify other easements are being proposed.
4. On C8 of the site plan there is a proposed gravel access road connecting Pireus Row to N Moores
Creek Lane. A note on C6 of the site plan states that this road is for RWSA personnel only. It is
not clear if this is a permanent access road. If it is a permanent access road please clarify easement
from Pireus Row. This will need to be shown on plat.
