Subject: SUB 201400027 Creekside III, Phase IIC Lots 14 -16 — Boundary Line Adjustment
The County of Albemarle Planning Division will grant or recommend approval of the Boundary Line Adjustment
Plat referenced above once the following comments have been addressed: [Each comment is preceded by the
applicable reference, which is to the Subdivision /Zoning Ordinances unless otherwise specified.]
1. [14- 302(A)(9)] Building sites on proposed lots. The plat shall contain the following note: "Tax Map /Parcels
55E- 04 -14, 55E -04 -15 and 55E -04 -16 each contain a 6800 SF building site as required by section 4.2.1 of
the Albemarle County Zoning Ordinance." Verify that each lot will still contain this required building site and
include the typical building site diagram that was approved with the Final Plat for Creekside III, Phase IIC.
Rev1: Comment addressed.
2. [14- 302(B)(10)] Stream buffers. Label the stream buffer shown on the plat. Please also add the following
note, "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County
Water Protection Ordinance ".
Rev1: Comment not fully addressed. Please show the stream buffer on Lot 13 as well.
3. [14- 303(A)] Statement of consent to division. The County's standard consent statement was revised
effective January 1, 2014 to be in compliance with state code. Please revise the statement on the plat to
the following: "The platting or dedication of the following described land [insert a correct description of the
land subdivided] is with the free consent and in accordance with the desire of the undersigned owners,
proprietors and trustees if any." (see the new checklists for all subdivision applications)
Rev1: Comment not fully addressed. Include Lot 16 in the description.
4. [14- 303(C)] Boundary lines. Provide boundary line information for the proposed internal boundary lines.
Rev1: Comment addressed.
5. [14- 303(D)] Acreage of lots. The minimum lot size in Creekside III is 20,000 SF; revised lots 14 and 15 do
not meet this requirement.
Rev1: Comment not fully addressed. The acreage labeled on Lots 14 and 16 is not the same as what
is listed in the Area Summary, these numbers should match. It appears that Lot 14 should be 20,001
SF and Lot 16 should be 21,120 SF.
6. [14- 303(H)] Monuments. Provide the location and material of all permanent reference monuments.
Rev1: Comment addressed.
7. [14- 303(0)] Signature panels. The signature panel for TMP 55E -04 -15 has the incorrect owner listed below
the signature line; please revise.

8. [14 -312] Location of existing buildings. If any building is within 50' of the proposed lot lines, please show it
on the plat.
Rev1: Comment addressed.
Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is
kept up to date by the County Attorney's office. The Code may found on the County Attorney's website which
may be found under "Departments and Services" at Albemarle.org.
In accord with the provisions of Section 14- 229(B) of Chapter 14 of the Code if the developer fails to submit a
revised final plat to address all of the requirements within six (6) months after the date of this letter the
application shall be deemed to have been voluntarily withdrawn by the developer.
